    Terri doesn’t even deserve the kind of consideration we give animals? She’s somehow not even worth that amount of consideration?

    Terri deserves as much consideration as any other person. 15 years of keeping her body going as her brain was replaced by spinal fluid is a lack of basic decency, dignity and consideration.

    Her parents I can understand, any parent is going to hope and pray their child is going to be okay regardless of the facts, but what’s your excuse TnTexas?

    When you get right down to it…..many would love to be able to administer morphine or something to quicken the inevitable process….but it was the same people screaming about letting her die slowly that scream about letting people die quickly.

    You’re behaving a bit spittle-flecked yourself, John. Even Allah has noticed, by way of a comment at Ace or Protein Wisdom.

    The logic of your position– that “no one’s home/the lights are out/her forebrain is dissolved” –would seem to call for a quicker quietus than dehydration/starvation, which even the *reptile* brain, if that’s all that’s truly left to her, experiences.

    If you think it’s legitimate for a judge to order that a woman be dehydrated and starved until dead, I don’t see how you can think it’s illegitimate to order that she be executed quickly.

    Get a fucking grip, he isn’t ordering that she be starved to death. This isn;t the state executing someone.

    This is the judge, according to the rule of law, as dictated by the legislature of Florida, who were all elected by the people, that Terri would not wanted to have been in this state indefinitely, after an evidentiary hearing.

    Jeebus.

    The Judge, as he shouldn’t, isn’t ordering the state to starve her. He is merely acquiescing to Micheeal and Terri’s wishes, as per the established law.

    Quit smearing this judge and the legal system.

    It means may be allowed, is able to. It doesn;t mean “must,” or “is demanded”, or “is required.” That is how you are framing it- remember, Michael Schiavo is the petitioner, he asked the court to decide if he was able to do this because it was her wishes. They proved it was her wishes, and the order allows him to do so.

    You are framing it as if the judge is ordering her death, or that he MUST. If Michael Schiavo wanted to put the tube back in right now, he could.

    Your inflammatory rhetoric, and yes, your smearing of the judge through outright misrepresentation, is what is enabling the lunatics and jackasses to call for violence, to pretend Terri is being murdered, and to act like she is being executed.

    When judges want to say “may,” they say “may.” When they want to say “shall,” they say “shall.”

    I haven’t seen many examples of can, must, or should in law. Just may and shall.

    That’s actually an interesting question. Hadn’t the court determined that there was clear and convincing evidence she would want to die in that situation? If that’s the case, Michael’s wishes were irrelevant. I don’t know if he retained plenary power over her.

    That doesn’t mean that shall doesn’t mean shall.

    I don’t think Michael’s wishes are relevant at this time, and certainly weren’t ruled to be relevant at the Judge Greer made his intial ruling. The Judge RULED, based on the testimony of Michael Schiavo, among others, that there was clear and convincing evidence that TS wanted to be starved to death if she ever entered into a PVS. I’m not sure even MS could stop it at this point.

    At any rate, “shall” does mean “shall.” It’s just that what “shall” means is not as narrow as you think.

    Or, no, the judge ordered that T. Schiavo has to be killed, citing the legal principle of whatever judges cite when they get it in their heads to order citizens to off their spouses. I guess the judge doesn’t like that T. Schiavo, and her husband played right into his hands..

    I don’t think the Judge had evil intentions. He had to make a ruling, and he ruled. But that’s different than Terri Schiavo, slowly dying in a hospital bed, telling the judge to end her life by removing her feeding tube.

    The judge listened to testimony, and made a ruling. And it MAY have been exactly what TS wanted.

    Thanks for the honesty and the clarification, John.

    Not sure if it matters, but you and I see eye to eye on the facts of this issue.

    But what’s been bothering me as I have perused the blogosphere during the past few days, is that there seems to be an awful lot of labeling and broad strokes of teh brush. Too much emotion-driven ranting as well. (Ann Althouse has been a notable exception).

    Also, quite a bit of naivete. Even from “teh blogfather” (Glenn). Did he really think that the left has a monopoly on idiots? We need less generalization and flame throwing, and much more calm and reasoned posting. We are individuals – not labels.

    one thing that troubles me, and I think it’s very ironic, is how clear teh MSM bias is to most of us who tend to be conservative/libertarian oriented, yet how BLIND so many of us are to our own bias when dealign with the left. By all means, let’s criticize and debate,a nd stand up for what we think and believe – but we should do it in a manner that is effective and fruitful. I think many who I would say are likeminded to myself, fail in this regard. Another example of this would be how quickly the polls re: this issue were torn apart, because they did not fit the views that so many wanted to see. That becomes very obvious when you “switch sides” on aparticular issue, and makes me wonder if we haven’t done the same on other issues.

    It’s not about LEFT and RIGHT. It’s about PEOPLE of all stripes. We should each try to be better in this regard. Better informed, and more fair to those we disagree with. As “objective” as possible. We have a responsibility to debate and argue in a mature, civil, and hopefully productive way.

    I would very much like to see more introspection, and less generalization about those we disagree with.
