The problem with that of course is that the vast majority of the American public doesn’t care that much about a Supreme Court justice. This is an activists fight more than anything.

Miers will be confirmed unless she does horribly in the hearings. Senate Republicans will not vote Miers down and risk an angry veto pen for the next 3 years. In a year most conservatives will have to appologize to Miers. Those too proud to admit they erred will continue to snipe like the fever swamp does.

Yeh, they’d have to apologize for putting her in a job that she is completely unprepared for. Voting the “right” way is not enough, at least for those who take the highest court seriously.
