    Telecomm immunity is coming, maybe as soon as this week, saith Glenzilla. Question: How can the Legislature usurp the function of the Judiciary? I always think of immunity as something worked out within the judiciary context. Even if this goes through, has anyone heard of any effort to challenge the law?

    Tiger’s birdie on 18 to force a playoff was teh awesome yesterday.

    He does know how to bring in the ratings doesn’t he? I missed almost the entire last day (at the beach with the kids, dutifully skipping Sportcenter and 8th grade) but caught the last hole.

    I remember watching him make the best golf shot of all time. Even if you can only catch him for a few minutes here and there, it’s often worth it.

    Martin – totally agree. I only caught the last couple of holes as well on Sunday and only caught parts here and there of the Open the other days. He did the same thing on Saturday as well.

    I know it is just golf for most people, but the comparisons to the great historic players from other sports are justified.

    Good piece on cnnsi today about how they need to drop the full round playoff and go with a four hole playoff same day as the final round. The Monday playoff really saps the drama.

    If Greenwald is correct then our courageous Congressional Democrats are about to bravely vote immunity for the telecoms. The money quote:

    Oh I went to NQ and now I feel sick. All these mental gymnastics, clicking of the heels and wishing Obama’s citizenship away. Reference to a Hawaii “state law”, with no link, a law that at first blush seems to contradict jus soli citizenship.

    Someone really thinks he was born in Kenya? Did Ann Dunham ever even visit Kenya?

    These people shouldn’t be allowed to vote if they don’t actually live on planet earth.

    The TPM website had an article that said the federal courts will decide if they should be immune. Not FISA courts, and not blanket immunity. A court(s) and judge(s) will iron this out. Not sure if that’s good or bad.

    @Dork – Link? I smell a fig leaf, something to make it look like it’s being done on the up and up. The sole recourse I can imagine at this juncture is to challenge the apparently imminent law itself. Which seems like a sensible thing to do, as the courts may not take kindly to having their authority usurped, no matter what their political/ideological persuasion.

    That one’s been floating around Wingnuttia for a little while. I think it morphed from the tax resisters’ contention that the 16th amendment is invalid because Ohio was not a state at the time of ratification (don’t ask, I don’t understand it.)

    Question: How can the Legislature usurp the function of the Judiciary? I always think of immunity as something worked out within the judiciary context.

    The idea of immunity for certain actors originates in common law, but I believe the various types are pretty well codified by statute now, confirming or changing the common law ideas. So for example, traditionally the government has sovereign immunity from suits, that has been partially waived by the Federal Tort Claims Act and if you can find an exception in there to sue under, you can sue.

    Ties in nicely with the bullshit arguments that he made regarding the Habeas Corpus decision. Apperently one of the three branches of goverment is worth squat in the eyes of some of its members.

    So – where is the “flood” of Habeus filings that we were supposed to see from Gitmo? Didn’t every Right Wingnut Website use that as part of their Standard Talkingpoints Post? Aren’t they qualified to start filing them today? Aren’t the trial lawyers and left-wing interest groups drooling over themselves to get these filed immediately?

    So, how come I haven’t seen one single post about any of them today?
