The Alaska Supreme Court put the kaibosh on the Republican attempts to kill the legislature’s investigation into Sarah Palin’s firing of Walter Moneghan:
The Alaska Supreme Court refused to halt an investigation into Governor Sarah Palin’s firing of the state police chief, paving the way for tomorrow’s planned release of the findings.
The Supreme Court dismissed the case brought by five state Republican lawmakers who sought to stop the probe, claiming it was unconstitutional and tainted by partisan politics. The investigation, known as Troopergate, took on national importance after Republican presidential nominee John McCain picked Palin as his running mate.
The Alaska Legislative Council, a bipartisan committee of 14 lawmakers that conducts business when the Legislature isn’t in session, voted unanimously on July 31 to investigate Palin’s July 11 firing of Alaska Public Safety Commissioner Walt Monegan. The commissioner said he was dismissed for refusing to fire state trooper Mike Wooten, who was involved in a divorce and custody battle with Palin’s sister.

With any luck, the information released tomorrow wil make it impossible even for the wingnuttiest republican leadership to make that work.

Key thing to keep in mind is that two things have to occur for this whole story to be something unlike, say, Fitzmas:
1) The Legislative Council has to vote to release the report officially.
2) It actually has to have some meat to it.
Neither are guaranteed, though prospects look good.

So far there is only an order affirming the Superior Court. The Order says that an opinion will follow. I will be interested to see whether the opinion is unamimous. Palin appointed one Justice this past January. Three other justices have been on the Court for at least ten years. The Chief Judge recused herself because her husband represents one of the people who received a subpoena.
BTW, certain law professors and legal scholars submitted an amicus curiae (friend of the court) brief in support of the Republican legislators. Interestingly, however, none of these legal eagles were from Alaska. I suspect that Alaskans would not be pleased about out-of-state lawyers telling them how to interpret their state constitution. After reading the brief, I would hope that these law professors would be fired from their teaching positions.

My prediction, the report is scathing and damaging, but makes it clear that final conclusions can not be drawn because key witnesses are refusing to comply with the subpoenas.

BTW – Now Palin’s exonerating herself – which is the most laughable thing I’ve ever heard of.
Anyone who thinks that Wooten is despicable is buying the bogus characterization the Palin’s are pushing. They had to be admonished to stop their smear campaign by the family court judge who told them their false accusations and constant harassment of Wooten was tantamount to "verbal child abuse".
Various investigations of Wooten and found him guilty of like 1 out of 10 things the Palin’s accused him of, and his suspension was quite brief – indicating there was little substance to what he was accused of.
After the Palin’s smear campaign failed to get Wooten fired – they they try to have Monegan fire Wooten. And after he says, "I can’t legally do that" – they fire Monegan.
It’s after the firing they have come up with,100s of different, contradictory explanations as to why Monegan was fired. You don’t do that when you’re telling the truth. You just don’t.
Sure, Palin wasn’t putting a hit out on Wooten or Monegan – but they have been lying since the divorce proceedings began, and abusing their power for years (this is not the only incident).
