Via Wonkette, “Brave Army Man Sues Nobama to Avoid War”:

U.S. Army Maj. Stefan Frederick Cook filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector with the intent to stall and eventually prevent an upcoming deployment to Afghanistan.

In the 20-page document — filed July 8 with the United States District Court, Middle District of Georgia — Cook’s California-based attorney, Orly Taitz, asks the court to consider granting his client’s request based upon Cook’s belief that President Barrack Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of U.S Armed Forces.

Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command, and that Plaintiff would thus be simultaneously unable to perform his duties in good Rule 65(b) Application for Temporary Restraining Order 22 conscience and yet be simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

Not that I blame the man for trying to get out of going to Afghanistan, because that is not a healthful situation by any means, but — asking Orly “Alfa Birfer” Taitz to represent him in court?

And then adding the double-reverse triple-axel moonbat “Any American military action in Afghanistan constitutes a war crime” plea?

It’s as though Major Cook didn’t want anybody to like him anymore!

    That’s not what he said–it appears that his argument is that since the Preznit is not legitimate, therefore the operation is illegitimate and constitutes a prima facie violation of the Geneva Conventions.

    Or something… I don’t want to think about it too deeply, lest my head a splode…

    The most troubling aspect of this is how could an obvious dickhead like Stefan Frederick Cook rise to the rank of Major?

    We got a last-chance saluting demon LtCmdr (Navy equivalent of a major) gifted to our outfit in the Delta. We tried, as gently as possible to make him understand that insisting on military courtesy and standing in formations was a great way to get people killed. Someone blew up his motherfucking jeep at around two AM one humid morning and he pulled in his horns. I say “around two AM” because it was difficult to know precisely how long it would take the gasoline in the jeep’s underseat gas tank to melt the adhesive on the medical tape that someone wrapped around the spoon of the pin-out baseball grenade.

    It’s not a matter of Taitz “getting involved” in the case. This is Taitz’s case full stop. For several months she has been trawling for someone in the military (or the parent of someone in the military) to be her plaintiff in a case like this. Cook is just her sucker.

    This ought to be the end of his military career. An officer, strike that, a fucking major, not some grunt with two chevrons on his sleeve, pulls this “Ooo, now I’m a conscientious objector” nonsense out of his ass and gives as the reason for his enlightenment the wingnutiest of wingnut gripes?? They ought to bust him down to 2nd Looey, then drum his ass out.
    This CO shit really burns my ass. I’m not disputing that there are lots of folks in the world who just don’t believe in the concept of warfare, for lots of different reasons. I have no problem with those folks but hey, if you are an honest god Conscientious Objector, how about you DON’T JOIN THE FUCKING ARMY?? Or, if you absolutely, positively have to have Army service on your resume, you go in via the medical corps or chaplaincy. God, I hated the whole bunch of whiny assholes who tried to pull that shit during the first Gulf War. “B-b-b-but I just signed up for the free college money, I didn’t ever think I’d have to GO TO WAR!” And most of those pricks didn’t spend a year or so of their lives digging and refilling sandy holes in the Arabian desert, as I fervently believe they should have, but instead were separated out, nice and clean. Maybe someone should have clearly defined the term SERVICE to them before they signed the enlistment papers, hmm?
    Now this, from an officer, no less. What a sad fucking insult to his uniform.
    And, yes, I realize that the last decade has been quite the shit sandwich for military folks being yo-yo’d in and out of combat zones and I have all the sympathy in the world for them. But that’s not what’s happening here. This is an asshole with an oak leaf on his cap who’s supposed to be, among other things, inspiring troops under his command who has instead decided to take his marching orders from FatFuck Limbaugh. Again, what a sad fucking disgrace.

    Crazy political lawsuits can’t really be compared to personal injury lawsuits. There are many ludicrous political lawsuits, filed by self-educated crazy prisoners, paranoid schizophrenics, etc.

    The thing about personal injury lawsuits that gets the wingnuts exercised is that sometimes malfeasant companies lose, and have to pay.

    Crazy political lawsuits are inherently hopeless, so nobody really cares.

    I’d actually like to see this lawsuit reach the merits on the birth certificate issue. Any court in the country would accept the “certificate of live birth” as proof that Obama’s a natural-born U.S. citizen and put an end to this (although of course it wouldn’t put an end to the freeper nonsense).

    That was my first thought as well.

    I like to think of birthers as folks with ovens in their backyard who reduce the whole of an individual to the magnitude of their armpit hair and all of human economics to the production of tractors. I can’t imagine serving in combat under such a person.

    long ago, as a young law student naif, I once protested to a professor: “But there must be SOME arguments so dumb that NO lawyer would actually MAKE them — aren’t there?”

    My classmates snickered. The prof, a humorless type, answered blankly, “No. There aren’t.”

    Then, there was another professor — a wittier one — who used to note frequently and matter-of-factly in his lectures, just sort of in passing, that “people are sheep.” I found that offensive, so on my final exam I wrote, in a context I can’t recall, that “people are not invariably sheep.”

    I got a good grade on the exam, but I can’t count the number of times over the years I’ve regretted my own words and wished to tell that wise man how right he was.

    A sad world, so it is.

    I did a quick Google, Grumpy Realist. There have been several such suits it seems. One which was dismissed as frivolous (March 2009) was brought by Gregory S. Hollister against Barry Soetero (hmmmm). The court even brought out that it was actually an action by Philip J. Berg.

    Opening graph of the decision: This case, if it were allowed to proceed, would deserve mention in one of those books that seek to prove that the law is foolish or that America has too many lawyers with not enough to do. Even in its relatively short life the case has excited the blogosphere and the conspiracy theorists. The right thing to do is to bring it to an early end.

    Another suit has been filed by Charles F. Kerchner also claiming the commander in chief problem. Kerchner is a retired Navy officer; his lawyer is Mario Apuzzo.

    Taitz is also involved with a suit brought by a Lt. Easterling in February 2009. Easterling supposedly was on active duty in Iraq. Again, the commander in chief thing.

    They just can’t, can’t give up. Oh, and in my search I passed by Pam “Atlas Shrugs” ‘s place and she’s claiming that various documents about the birth certificate have been scrubbed from the web.

    Pass the pop corn, please. (But really this is getting old and stale.)

    After watching all the episodes of Generation Kill over the last few days, I’m not longer surprised whatsoever at some of the absolute dumbfucks who manage to work their way up the ranks of the military.

    Not that this invalidates your larger point, but you might want to read the Gen Kill book after watching the DVDs.

    IIRC when watching Gen Kill there were some things that didn’t make it into the film version that were rather relevant to understanding the interactions between the Recon Marines and their officers, for example that the latter normally would not deploy into the field with the squads under them and OIF was very unusual in that regard. Also in the afterword to the most recent version of the book Evan Wright wrote that one of the screwup officers from OIF (I think it was “Casey Kasem” but I could have that wrong) when he returned for his 2nd tour of duty came to be highly regarded by his men for his effectiveness during the 1st battle of Fallujah. So the DVDs can be a little bit misleading if interpreted in isolation from the book.

    Also, not all war memoirs are 100 percent unvarnished truth, to put it mildly – see Paul Fussell’s “The Great War and Modern Memory” for an extended explication of just how strong of an influence deeply entrenched literary archetypes and narrative conventions can have on even somebody who is trying their best to tell it like it was. I’ve been wondering ever since I first read Gen Kill how much of those same influences made their way into Evan Wright’s writing.

    I wish CNN had more concern for their reputation than for their bottom line. They’re acting like a bunch of fucking whores. When Fox News Channel is doing hard news while CNN is discussing Michael Jackson, it’s time for CNN to go out of business.

    It’s as though Major Cook didn’t want anybody to like him anymore!

    OMG… Last fall, before the election, my son accepted a new player on the soccer team he volunteers to coach. For an average of 15 hours a week. Into which he easily puts $500 dollars a year of his own money because many of the kids can’t afford the “luxuries” of properly fitting shin guards, shoes or season fees. The players of which he picks up and takes home from practice is approximately 50%.

    The new dad, an FBI invesitgator (who reminds me of the DEA brother-in-law on “Breaking Bad”), and incidentally a transplant from Eastern New Mexico–which is actually West Texas–noticed his “Obama/Biden” sticker on his beat up 1994 Toyota.

    “Obama?!!! What the hell is that? You’re one of those libruls? DON’T YOU WANT ANYONE TO LIKE YOU?” he asked, incredulously, with all the self-assurance of a gun tot’n, duelly-truck driving red neck under the delusion McCain-Palin was the natural choice for all sane people.

    What can I say, I raised a smart kid, and he handled it well.

    And after two seasons, guess who wants his kid to play for the “librul” coach who treats his kid with compassion, dignity, and respect.

    I remember when CNN first started up they played Three Stooges movies between newscasts. They seem to have gotten tired of paying royalties and replicated the Stooges with their staff.

    It really annoys that anyone over the rank of 2nd Lieutenant would be involved in a suit like this. I hope he gets busted to E-5 and made to clean out latrines for a couple of years while they lose his discharge papers over and over.

    all I need to know about Republican “thought” was answered the first time I listened to Limbaugh. He totally contradicted himself in two consecutive sentences. There is no logical inconsistency that they cannot stomach as long as it suits their purpose.

    The fact that this Major is trying to get out of his legal and moral responsibility by this groundless lawsuit isn’t going to phase them in the least. I don’t know why we would even consider such an outcome. However, this sort of thing is stripping off the rational republicans a few at a time.

    It’s pretty disturbing that one of our national parties is imploding. I’ve always wondered how political parties really went out of existence and new ones formed in this country. We may be watching it happen again.

    Sorry to burst anyone’s bubble, but the only thing that you can do to eject a commissioned officer (LT – General) from the service is to dismiss them. That has the effect of a Dishonorable Discharge (the equivalent of a Felony conviction) and the loss of all pay and allowances (i.e., retirement, veterans benefits, etc.). This is not done lightly and is rather a Big Stick.

    Not that this fool does not deserve it.

    You are all obviously Obama Supporters and that is OK…its America and at least for now you are still sorta free to do what you want. All Obama has to do is quit hiding whatever he is hiding and show us the documents indicating he is a natural born citizen. I do not see this as too much to ask of our “President”. Most of us non-democrats base our reasoning on Facts and not on emotion so once the facts are available it won’t be an issue. The fact that no one can get to the records and that Obama has spent hundreds of thousands of dollars to keep them concealed indicates there is something he does not want us to know. Spouting off the typical liberal emotional outburst does not make the facts go away. If this was George W. Bush that was in question you would all be cheering him on saying what a great role model for the military and all Americans.. So what is the difference if it is Bush or Obama, it just needs to come clean.

    How did that work out for you all? you know, the part where you all created your own reality? Think it might have had something to do with the bright idea of selling all that worthless paper for trillions, as long as you held your Magic Feather with your nose and believed really hard?
