    I just got back from the doctor’s office for a checkup and I’m even healthier that I thought I might be. I’m actually in better shape than I was last year.

    It looks like I’ll be able to stick around and aggravate you guys for a looong time yet.

    1. My daughter returned safely from her first cross-country trip!
    2. Not as hellaciously hot as it was all last week.
    3. I am reaping quarts of blackberries and raspberries daily from my yard.
    4. There are probably some other things for which I can be thankful/grateful.
    5. I do not depend on the vicissitudes of Congress for my happiness, although I suppose Congress could make my future less bright. I will endeavor to be “in the moment.”

    I’ve been rewatching the Ken Burns National Parks mini series again. It’s a really good peek into a large chunk of American history. It’s a very beautifully made documentary. I watch that and Anthony Bourdain’s No Reservations when I am massively bummed out,it helps.

    I have a bad feeling that I’m going to have to hire a lawyer. The insurance company of the lady who plowed into my car Friday won’t return my calls or emails. I managed to reach their 800 number and they said they’re sending an adjuster out to look at my car tommorrow,but the claims rep was supposed to call me on Monday and so far she’s unreachable. Meanwhile I have no car and I really cannot afford a rental indefinitely. This wasn’t my damned fault,why should I have to pay for a damned thing? Gah. Time to watch more DVDs,lol.

    @JC: On the bright side, the Bush tax cuts are still set to expire. So there’s another opportunity to raise revenue coming up. Not saying it’ll happen, but at least there’s another shot — and it doesn’t require getting a bill past the House.

    I think next year we’ll see a big push on “tax reform,” and we’ll see what that yields. The Grand Bargain there is probably a tradeoff between lower rates and fewer deductions and incentives, what Obama called “expenditures in the tax code.” The Republicans will probably renew the push to make the additional upper-income tax cuts permanent, but a larger discussion of tax policy could outflank them.

    Why are you doing that? That’s why you have an insurance company. Call them, and they do all that shit, and if it was the other person’s fault, they’ll get their money from the other persons’s insurance company, and if lawyers need to be involved, they have lawyers.

    And ask your insurer to cover a rental.

    Remember, the other company doesn’t want to talk to you – you’re not their customer. Your insurance company does want to keep you as a customer. If you were rear-ended, that’s pretty open and shut the other person’s fault.

    That’s part of the reason to reform the tax code. The ‘Bush Tax Cut’ issue has become toxic for both sides. Rewriting the tax code simply eliminates it as an issue.

    Having just gone through something similar, it was a huge relief to finally hire a lawyer to take care of it. Dealing with the other person’s insurance, my insurance, the health insurance companies (who don’t want to pay for any injuries because they’re from a car accident so the car insurance should pay, or so they say), was a huge hassle. They’d call at all sorts of hours all the time, but if you tried to call them they wouldn’t return calls or they’d put you on hold for two hours (yes, TWO hours).

    When the lawyer was hired, all those calls magically stopped. Plus, the lawyer knew the ins and outs of how to deal with the other party’s various representatives, and in one case the other party (who said they were “too busy” to be deposed).

    Also, what EVERYONE who had been through it before said was DO NOT SETTLE for AT LEAST six months. It takes time for injuries to show up and the minute you settle, you can’t claim for anything else. You can settle for the property bit (car, any other losses) but settling for the injury part too soon can be detrimental to you.

    be aggressive with the fuckers. Find out who the company’s CEO is and send him/her an e-mail setting out the history and threatening to sue them for bad faith if they don’t get their shit together.

    Bad faith is, yes, an actual claim that can be brought against an insurance company that fails to fulfill its contractual obligations. Generally it’s brought by the insured person but I’m pretty sure a claimant can assert it as well.

    Just FYI. A few years ago my wife was rear-ended, sounds similar to A Mom Anon’s story. We called our insurance, they cleared us for a rental, got an adjuster out the next day, got our car approved for the repairs, and we paid the deductible. They contacted the other person’s insurance and the police, the police put the fault on the other driver, their insurance paid our insurance and our deductible which was refunded to us or credited to our next bill, I forget, and the rental cost. Apparently there was some irregularity on the other persons’s end (college student out of state, who wasn’t covered to be out of state permanently, so they actually sued the driver for the full amount of the claim, something like that – but we got that through someone who happened to know the other driver) but we didn’t have to deal with any of that.

    Didn’t cost us anything but inconvenience and the temporary loss of our deductible. No mark on our insurance since it wasn’t my wife’s fault, and we had the car back the next week, and a rental the whole time it was out for repair. I think it was 2 phone calls from us total, and everything else came from our insurance company.

    Unrelatedly, but connected to the hiring a lawyer part of the thread, I just received a letter from opposing counsel in a case accusing me of trying to squeeze money of his client by threatening to drive up costs unnecessarily. I simply had detailed some of the discovery avenues that would need to be pursued in order to prepare for litigation. I then suggested that these expenses could be avoided on both sides if we settled. The thing is, if we go to trial, I will have to pursue the avenues I detailed. Unnecessarily, my ass.

    Wild blueberries are ripening. We just started picking and have 6 qts in the freezer. More berry picking tonight. Except for mosquitos it’s lovely and quiet out in the woods. After getting her fill of slurping up blueberries, one of our dogs found herself a moose jawbone. She looked pretty funny and proud of herself trying to balance the bone as she carried it back to our pickup. Yes, she got to take it home.

    Ash Can: They are still only trying ideological persuasion at the elite level. They are going to have to cut the astroturfing money spigot off and get Fox, Limbaugh and the rest of the Wurlitzer to start hammering the teatards to get this thing under control. I also question whether the overlords actually have a consensus that the teatards are a problem. There is undoubtedly also a contingent who believe the beast can be controlled without killing it. At this point, I do believe that killing the beast is their only real option, but, unfortunately, I think too many of the overlords are still in denial.

    In 23 days, I will be done with BigLaw, hopefully forever. The idea of not having a paycheck scares the shit out of me, but I am confident that there is demand for what I do.

    Well,it took my huband calling corporate and threatening to hire an attorney,but I now have a rental car reservation and the adjuster has moved me to the first appt tommorrow. Heh. Pisses me off though,it’s almost like they didn’t want to deal with a mere”girl”. The claims rep called and the lady who hit me totally lied about what happened so this could get ugly. According to the cops,she was at fault(she slammed head on into the back of my car)so there shouldn’t be an issue,but it pisses me off that she’s totally lying her ass off.

    Solo. The theory is that there are a growing number of small and midsize companies going international, who need international tax planning and transfer pricing services and will be happy to pay a lot less than BigLaw/Big Four prices. Plus I have very extensive tax controversy experience.

    Big trade today. Colby Rasmus, star of the future, Trever Miller and Brian Tallet for Edwin Jackson (starting pitching), Dotel, Mark Rzepscysnski, and Corey Patterson.

    This counts as good news because my Mom swears that Rasmus doesn’t really understand baseball. Not sure it was needed because all the starting pitchers except for Carpenter are pitching over their heads.
