Not much going on these days.  I got caught up on Game of Thrones.  We’ve also started watching “Chuck”, which I have never seen an episode before yesterday.  I passed one of the two Microsoft certification tests I have to take.  I’ll take the other one next week, time permitting.  The washing machine, the refrigerator, and the garage door opener have all stopped working.  We bought them all with the house about six years ago, and only the GDO is economically repairable (less than 40% of the cost of a replacement unit).

Some news on the Bradley Manning front–the same Military Judge that heard US v. Lakin (the birther who refused to deploy) has been assigned to hear US v. Manning.  That judge is COL Denise Lind, JA.  At a recent hearing motion, she denied a Defense motion to dismiss the Article 104 Aiding the Enemy charge, which has been preferred as a non-capital charge, but she did instruct the Trial Counsel (Prosecution) that they must prove that Manning knew specifically that the enemy would receive the information, and that it was his intent that they get that information, as opposed to merely showing that he knew they get a hold of it.

Lind said Thursday that prosecutors must prove during trial that Manning knew he was giving information to the enemy. If they fail to do so, Lind indicated she would consider a defense motion to dismiss the charge.

At that same hearing, Judge Lind dispensed with Defense motions dealing with multiplicity of charges, which she denied but instructed the Defense to maintain the issue for sentencing if there is a conviction.  Also, she dealt with an issue regarding Defense requests for damage control documents from various agencies.  Since Manning is charged with unlawfully accessing classified information and unlawfully disseminating that information, and not charged with doing any specific type of damage, the Trial Counsel argued such arguments are irrelevant.  The Government needs only to prove that, excepting the aforementioned Art. 104 charge above, he accessed CI, unlawfully placed it on an unauthorized system, and then distributed that CI to parties who were not cleared to receive it, and that he did each of these acts with full intent and knowledge of their unlawfulness.  The information I have does not indicate whether or not the Defense will be able to raise these questions at a penalty phase if necessary, but considering that the Defendant can make an unsworn statement at penalty phase, there is no reason (that I know)  why not.

For reasons known only the Defense team, they have not filed any motions under Article 10, UCMJ, which would deal with pre-trial confinement and/or length of detention.

    I posted this on the last thread, but it was towards the end, but I really liked the movie so I just had to post it again. It is record-breaking.

    DAMNNNNNN!!! The Avengers estimated to make 200.3 Million dollars by the end of the weekend for the biggest opening weekend EVER in North America!!!! Its on tap to make 1 billion probably by the end of the month. Ya’ll need to see this movie, it’s that good.

    I asked, like what? Claiming that Obama wasn’t a US citizen? He was BORN in the US, to a parent who was a US citizen. People are still pushing that and you say Obama is divisive?

    @lamh35: Saw The Avengers last night. Damn, but I like Robert Downey Jr these days. What a smartass. And Scarlett was worth lookin’ at.

    The whole cast was good, even the guys that previous commenters thought didn’t quite pull their weight. Lots of good funny moments. One of my faves, when Capt America was assigning duties to everyone, he came to the end, and simply said, “Hulk … Smash.”

    Oh, and thanks to everyone for the advice to wait through ALL the credits.

    @lamh35: This is just a general response to the Avengegasm. There’s another part in the Dark Knight trilogy coming soon. Cassidy the other night said Nolan was “p0wned” by the avengers crew. Let’s keep in mind that Batman is a single superhero who hasn’t been bitten by any radioactive bugs. He doesn’t become green, or beat with a radioactive heart or whatever. I watched Batman Begins and The Dark Knight again last weekend, and “p0wned” is a high bar.

    ETA: I realize this is going against the grain. But if you are going to go against Heath Ledger as the Joker, or Gary Oldham as Commissioner Gordon, not to mention Bale as Wayne/Batman, you have a considerable bar to raise.

    It was pretty good. like I said, it may have single-handedly saved The Hulk from those crappy movies before. Also it was an awesome blend of if not all MAJOR charctrs, then 5-6 major actors egos to wrangle together.

    It was fantastic.

    I’ll admit that I haven’t seen any of the Dark Knight movies, and actually I’m glad I didn’t because I saw the Avengers as a Marvel comics fan and with no Dark Knight to compare it to.

    I’m am noticing that both the Harry Potter fans (Avengers has bested Harry as best opening of all time) and Dark Knight fans have all expressed the same things you have as if just because the Avengers is pretty good, that that somehow makes Dark Knight less than.

    I can’t say that Avengers is better than Dark Knight. The themes are too different to compare in my opinion, but the Dark Knight fans all aghast over Avengers is kinda getting old.

    Go see Avengers, it was good.

    @TooManyJens: We do that all the time. Just make sure that you put them in the refrigerator, covered over night, and get them up to the appropriate temperature when you cook them, and keep them there for at least three minutes. I’m not a cook, and smarter people than me may disagree (listen to them if that happens) but I’ve never gotten sick from doing that.

    A new USA Today/Gallup Swing States Poll finds President Obama just ahead of Mitt Romney in the dozen key battleground states, 47% to 45%.
    That’s much closer than the lead of 9 points for Obama in in late March.
    “But the poll also finds a reversal in what has been a key GOP asset in the five previous battleground surveys taken since last fall: an edge in enthusiasm among voters. For the first time, Democrats are more likely than Republicans to say they are extremely or very enthusiastic about voting — a shift from a 14-percentage-point GOP advantage at the end of last year to an 11-point deficit now.

    This kind of reversal in enthusiasm of the party challenging an incumbent, is very bad news for Romney and the GOP. Especially regarding the all important GOTV
    efforts in a divided electorate.

Like I said, I admit to never seeing the Dark Knight movies, nor to be honest the entire Harry Potter series, but I have noticed on alot of the entertainment blogs I read that the DK and HP fans are serious affronted somehow that The Avengers has been getting some deserved attention. There is seriously more than enough room for good comic book movie. Like I said it’s gotten a little tiresome (and it’s only been less than 72hrs) that’s all I’m saying.

    Still, I plan to see DK this summer and I’m gonna make sure I see the first 2 films in the series before I do.

    Sometime back I ranted about a vibration problem I have in my apartment. It’s 11:30 P.M. or so as I write this and the vibrations have been happening since early this evening and now they get heavier as the night goes on. Tomorrow I will go to see the property manager and ask him what they (management) intends to do about the problem. (I have mentioned the vibrations in complaint letters about the vent fans, so they know about the problem.) I’m convinced they are somehow associated with the ventilation system. I’ve been in this apartment since 1999 and haven’t felt this sensation before October 2011. They fixed the ventilation fan motors but they haven’t done anything about the vibrations I feel. I feel them in all my chairs and when I lay down in bed — I cannot sleep with the vibrations. I just cannot. Maybe I’ll copy this comment and send it to the property manager in e-mail. I can’t take staying up until the vibrations stop and 1 or 2 A.M.

    Any comments would be appreciated.
    End of rant.

Orioles infielder Chris Davis, who went 0 for 8 at the plate with 5 strikeouts (the “platinum sombrero,” in ESPN’s memorable phrase), was still the hero, because he pitched the 16th and 17th innings and got the win. And the loss went to Red Sox outfielder Darnell McDonald, who pitched the 17th inning for Boston. First time since 1925 two position players have pitched in the same game. Davis’s win is the first for an American League position player since 1968.

    Now Baltimore is on top of the AL East with a .679 win percentage. ¡Caramba!

    I don’t know if anyone read my comment from an earlier thread (the French Election result thread I think), but on the subject of the possible problem solving job offer I got, but I reviewed and compared the benefits, I’ve come up with 4 big questions that I need answering (pay rate, benefits eligible, hours per pay period, estimated time when position would start) and I’ve had some sense knocked into my head by my gramdmother. So I’m gonna go for it. Sending my supe a letter tonight for her to read tmrw. And get the ball rolling in this.

    Hope you saw the response by someone else who said to get something in writing, e.g. certain number of hours (or shifts) a month, etc. Otherwise you could get left hanging if they just use you as a fill-in.

    After that, I have four tests for MCITP Windows Server 2008 Administrator. I expect to start working on those tests in the next couple of months.

    @Steeplejack: Yeah I did I asked her in the email if the position would be a guaranteed 70 hrs or 80hrs a pay period, u have to work at least 64hrs a pay period to receive FT benefits. Right now the supervisor in Microis doing bench work. Like I said, I admit to never seeing the Dark Knight movies, nor to be honest the entire Harry Potter series, but I have noticed on alot of the entertainment blogs I read that the DK and HP fans are serious affronted somehow that The Avengers has been getting some deserved attention.

    I’ve never read any of the Harry Potter novels, so, my opinions of the films were strictly on their merits as cinematic works.

    I got bored with them and never saw the last three installments.

    You will be happy to know that I got a great haircut today. Tried a new place (new to me) that had some good Yelp reviews, told the guy I wanted it “short but not military short” and–boom!–he delivered. Won’t know absolutely for sure until I take a shower and wash my hair tomorrow morning (no blow dryer and none of that Dapper Dan pomade they can’t resist putting on as a finishing touch), but all signs are good. And it feels so great to have all that hair off my neck and ears. (I was way overdue–last haircut was in early February.)

    @lamh35: The Avengers and The Dark Knight Trilogy are very different things. People seem to think that because they’re all superhero movies you can just lump them together. In this case, you can’t.

    The Avengers is fun fun silly willy. There’s nothing terribly thought provoking in it beyond contemplating how Chris Hemsworth got the Thor gig when everyone else in the cast has real talent and skill. (Robert Downey, Jr. and Jeremy Renner are pretty much tied at the other end of the spectrum.) The attempt to inject some moral questioning into it through the vehicle of Nick Fury’s motivations falls flat, although it does provide a very entertaining scene with Tony Stark and Bruce Banner badgering Captain America.

    With The Dark Knight, Christopher Nolan is trying something completely different. He’s asking some rather bigger questions, specifically on the question of what actually constitutes sanity and what the nature of heroism actually is. In this, he was aided by the unbelievable performance of Heath Ledger as The Joker, for my money the best turn ever in a superhero movie.

    For my personal taste, I prefer The Dark Knight. I disagree strongly with some of the arguments that it advances, but it engages me at a level The Avengers doesn’t. That said, spending much time comparing them and arguing which is better is rather pointless since you’re effectively arguing over which style of movie you prefer rather than which one was better executed.

    The movie that’s out right now that I would compare The Dark Knight to is The Raven. I recommend the latter very highly for anyone that wants to see a movie that is both very suspenseful and that also delves into the questions of what is art, where the border between truth and fiction lies and a take on what constitutes sanity that comes at it from a very different angle than The Dark Knight. If that’s not your thing, don’t see it. There are other John Cusack movies I’d recommend instead, like War, Inc.
