The count is in and the US Senate just advanced the Employment Non-Discrimination Act (ENDA) in a 61-30 cloture vote. Unfortunately, the bill is headed for the House where Speaker John Boehner dropped his two-cent nonsense earlier today with his claim that:

The Speaker believes this legislation will increase frivolous litigation and cost American jobs, especially small business jobs,

His office later added,

We have always believed this is covered by existing law, . . . this is not a new issue or a new position — it’s a longstanding position, and, frankly, not ‘news’ at all. This has been his position, on the record, for years, stated publicly many times.

Sounds like the same tired Republican defense against supporting equal rights for just about anyone but stodgy old straight white dudes. Got it.

My mother stayed at an Econolodge on her way to see my sister in Connecticut, and they had rubber ducks on the counter for you to take with you and to take a picture with it somewhere and post it to their facebook page and potentially win a gift certificate or free night’s stay. And so, here is my brother’s Wire-Haired Pointing Griffon (gundogs used in among other things, duck hunting) with a rubber duck balanced on his nose:

Okay, Rand Paul’s latest stunt been mentioned here already, but I can’t resist sharing Mr. Pierce’s response to the lesser Paul:

After refreshing vague memories from a college fencing class with a most instructive Wikipedia entry, my bet would be Rand gets caught attempting to rig the electrified tip, blames it on one of his assistants, and then shorts out his body cord when he gets a glimpse of his opponent and loses control of his bodily functions.

Chris Christie can scream at all the teachers he wants to without hurting his standing among the wingers. In fact, it probably helps among the wingers. So does all the mean stuff Romney people said about him in Game Changin’ II: Electric Bugaloo.

What could hurt Christie is spending too much time on the librul MSNBC network with noted RINOs like Joe Scarborough. Steve M:

My guess is that in 2016 he’s either going to win the nomination as a wingnut or lose it as the bipartisan huggy bear he’s turned himself into in the ads running relentless on local TV right now. He’s a few inches to the left of the GOP crazies right now, and I think he’s going to inch rightward after he wins — although he may spend too much time listening to Morning Joe pundits and stop before he goes all the way to the right. In which case he’ll lose.

I was wondering the other day when it was that Joe Scarborough became the king of all things independent centrist bipartisan, all things Halperinian, Burkean, Fournierian. After all, back in the day he was all about having quacks explain to us how Terri Schiavo was doing fine, how her husband might have tried to kill her, and so on. Then I realized that Operation Schiavo Freedom was led by serious people as much as by wingers. Halperin and Ambinder in 2005:

Simply saying that “Congress has no business here” does nothing to get those butterflies out of our collective stomach when we see the image of a smiling, very alive, woman in her hospital bed.

Once again, clearing away the personal part, the Republicans are on the offensive and the Democrats are on the defensive. That’s a Notable fact.

The real danger in Christie’s palling around with establishment media elites isn’t just that wingnuts will see Christie chuckling with Mika and decide he’s an east coast phony, it’s that Scarborough and Halperin have terrible political instincts. They’ll have him cutting Social Security, keeping unfortunate brain-dead people on life support for years, and supporting all the other stupid, unpopular shit that everyone outside the “Morning Joe” greenroom opposes.

Sounds like Eric Holder and the Justice Department decided to break a boy just because they can:

SAC Capital Advisors has agreed to plead guilty to insider trading violations and pay a record $1.2 billion penalty, becoming the first large Wall Street firm in a generation to confess to criminal conduct. The move caps a decade-long investigation that turned a once mighty hedge fund into a symbol of financial wrongdoing.

The guilty plea and fine paid by SAC, which is owned by the billionaire investor Steven A. Cohen, are part of a broader plea deal that federal prosecutors in Manhattan announced on Monday. It also will impose a five-year probation on the fund and require SAC to terminate its business of managing money for outside investors, though the firm will probably continue to manage Mr. Cohen’s fortune.

If only we had a more business-friendly President in charge, this kind of creeping socialism would have been beaten back long ago.

Another Perspective on the NSA Leaks

James Fallows gets a lot of good emails from insiders. Here’s one from someone he knows about last week’s NSA leaks concerning the infiltration of Google and Yahoo:

I obviously can’t be quoted by name on this … and indeed, since this email is being read (Hi guys!), I can probably get fired just for sending it, but let me just stress how shocking these NSA revelations are.

Look, I’m not a shrinking violet. I work for DoD. I support much of the war on terror. Some of these assholes out there just need killing. And gathering info on them that allows us to schwhack them is okay with me.

But there is law. And my view is that you have two choices. Either you change the law openly, publicly, or if that is impossible and you consider violating the law imperative, then you make a claim of “exceptional illegality.” The later is a tough case, but the best example is torture. I support the torture of Khalid Sheik Mohammed. I do not support the claim that such torture is lawful. But if I had been the responsible official, I would have ordered it and thrown myself on the mercy of the court.

But the thing about the NSA revelations is that this isn’t exceptional illegality. It is routine, somehow justified by legal opinions written by John Yoo-style hacks.

And worse, it is so routine that 29 y/o contractors have access to it.
