Jailed cattle rancher Cliven Bundy claims President Barack Obama, Nevada Sen. Harry Reid and others have stifled his constitutional rights as he sits in solitary confinement on charges stemming from a 2014 federal standoff, according to a lawsuit filed Tuesday.

Bundy, 70, is seeking $50 million for the “illegal, unconstitutional, intentional and malicious acts” of the defendants, and wants an indictment against him quashed and his immediate release from jail in Portland, Oregon.

Bundy added that he’s been in solitary since his arrest earlier this year — which constitutes “cruel and unusual punishment,” claims the suit, filed in U.S. District Court in Nevada.

In all honesty, I hope he loses every aspect of the case except for the solitary confinement bit. We use that entirely too much as a basic tool, and it’s obscene, cruel, and extremely harmful as well as being unnecessary in most cases.

    Granted, I’ve been slacking on my Bundy following, but I haven’t seen documentation that he’s in fact in solitary confinement. Which obviously doesn’t mean that he isn’t, but an allegation in a complaint doesn’t mean that he is, either.

    Since there are people who need to be isolated from others for their own protection (like their age, in Bundy’s case), there needs to be a way to do it that’s less punitive.

    That’s the amazing thing about this lawsuit — it isn’t a motion, its a separate civil suit claiming a violation of Cliven’s constitutional rights based on the insane conspiracy theory that Reid and Obama are trying to steal the Bundy Homestead — and that the district judge is actively assisting the Senate Minority Leader and the President of the United States of America, in their devious plot to steal his land. Welcome to crazy town.

    Now, if Cliven was actual represented by a criminal defense attorney — perhaps a proper motion could be filed on his behalf, for his release from solitary confinement. (Of course, I’m not sure I believe he is being held in solitary confinement).

    I don’t think it’s right to use solitary confinement as a punishment either. However, this mooching piece of shit has demonstrated his ability to foment violence and mayhem by appealing to a network of fellow morons. If he is in fact in solitary, maybe that’s why — to prevent him from causing more trouble even while locked up.

    @NCSteve: Mencken says somewhere that the French neutered Christianity by translating the Bible into clear and comprehensible French, whereas the English of the King James Version was in an elite idiom even when it was new and has only grown less familiar over time, so that Christianity in the English-speaking lands is tantamount to applied Biblical exegesis.

    Now go skim — very quickly — the largest representative corpus of Biblical exegesis you can conveniently access.

    Now imagine those same techniques applied to other corpora of post-Renaissance English, such as — oh, I don’t know, the Constitution of the United States?

    Growing up with American Christianity, with having single verses of the Bible unpacked for you at the rate of a page and a half or two pages each, then at some point setting down to read the thing for your own self and starting at Page 1 and giving up somewhere long before the New Testament…

    …makes one an easy mark for the “annotated” Constitution of W. Cleon Skousen. When Bundy or any of the millions like him quote the “Constitution” and it is some bizarre gibberish that cannot be found either in the original text or in the body of law that has grown up around it since 1787, they are quoting Skousen, or perhaps some intermediate exegete. But that is what you have to do with the Bible, so surely the same techniques and the same criteria of auctoritas apply?

    It’s all storytelling. The only question is, are the stories evocative?

I think he’s being housed in a local facility, pre-trial. Which, is not uncommon, for smaller federal districts.

    I don’t want him in solitary confinement, but man that complaint snippet really satisfies. The tears are delicious. His lawyer is awesome and by awesome I mean his prose is entertaining but not convincing. I’ll leave it to the actual lawyers to rip apart kleenex thick legal theory advanced in the complaint:

    Now liberal magazines like The American Prospect are admitting that Trump’s “man card” could play with women! If Ben Sasse doesn’t get in, this may certainly be right.

    When one considers that in the 2012 presidential election, men comprised only 47 percent of the electorate, this would appear to be politically suicidal. Yet such an assumption is predicated on the notion that women will vote based solely on a candidate’s attitude toward women. It has long been known that the biases of a dominant culture (in this case, that of the white male) are often internalized by marginalized people.

    Were all women opposed to all things misogynist, the television genre that elevated Trump to national name recognition wouldn’t have the viewership to sustain it. As Jennifer L. Pozner discusses in her book, Reality Bites Back: The Troubling Truth About Guilty Pleasure TV, the most successful reality shows are often the most misogynist, and Trump’s vehicle, The Apprentice, was no exception. In its celebrity version, the show drew a significantly higher level of female viewership than male, according to a 2010 survey.

    This goes hand-in-hand with my suggestion that Trump “double down” on his tell-it-like-it-is branding rather than pivoting to be more “presidential”. More name calling, more taunts, more free media, more more more. If he takes his primary strategy and super-sizes it, it’s the key to victory, especially when it comes to exuding dangerous, unpredictable and dominating masculinity.

    The woman card may turn out to be the winner if Hillary continues to play it this way: a proposal for major new support for families to obtain quality child care. Men, of course, care about this, too, but I think it will have extra resonance as a policy proposed by a woman. Child care too often gets short shrift as a factor holding back middle and working class families, and really should be looked at as on par with health care as a social and economic problem desperately in need of solving.

    Sooooo….

    In in Cinque Terre. After a morning of hiking, a fun beer and wine lunch and a nap, we guzzled yet another bottle of wine with a meal after a couple of predinner Grey Goose martinis (we had to run down the mountain in a very romantic pouring rain), got some glorious prosciutto, melon and misto salume, followed by about a gallon of a glorious and unfinishable seafood stew of prawns, pulpo, monkfish and mussels. Followon with dessert wine, tiramisu, coffee and grappa. So now am sitting fairly undressed on my balcony about 200 feet above the sea, quarter moon visible.

    I love it here and never want to come back. Ever.

    The people here are awesome, the twenty-somethings beautiful, the food is great and in a great socialist failure, they pay attention to infrastructure.

    The troll’s constant effort to disrupt every thread IS kind of like Bundy’s legal arguments. Bundy reminds me of Orly Taitz, who did get slapped down by the courts for making nonsensical arguments. The general rule for zealously representing one’s clients is, after advising what the best legal strategy would be, to make the arguments the client wants to make. But they have to be legitimate; they can’t just be made out of wholecloth. They have to have evidence and real legal theory and precedent underlying them, They can’t just be b.s. But it would take a sanctions motion to get them implemented and it might be the prosecution’s strategy just to let them be ridiculous because it makes it much more likely that they’ll be dismissed.

    At the last Bundy gang hearing in Oregon, one of defendants who is representing himself interrupted proceedings to demand that the judge provide them with her judging credentials, as he does at every hearing. This time, Ammon’s supposedly real lawyer Mike Arnold helpfully suggested that the judge could clear up this open question by ‘renewing her vows’.

    She said no and for some reason did not kick Arnold out on his ass.

    Late last month 5 of Odalis Sharp’s kids took off while she was taking a shower and had a neighbor take them to the Sheriff’s office. They are in state custody and she may be facing abuse charges.
    Her daughter was in the car with Lavoy Finicum. This is one messed up family.

    Michael Emry was at Malhuer and also considers himself an “embedded reporter”. He recently moved to Oregon and set up a website The Voice of Grant County dot com. Pretty sure he went there in support of the sheriff and to go after the reporter Les Zaitz who has done such a great job and whose family has been getting threats. Emry was arrested last Friday with a fully automatic .50-caliber machine gun and another firearm with the serial number wiped out.

    There are a number of ‘Patriots’ running for office all over that state.

    I have to admit that making Cliven Bundy spend all day alone with only himself as company does seem like cruel and unusual punishment. I think they should bring Phyllis Schlafly in to keep him company. They could discuss how the Constitution is unconstitutional and deep subjects like that.
