The federal court for the Eastern District of New York has officially issued an emergency stay, halting President Donald Trump’s executive order banning immigrants from seven Muslim-majority countries from entering the U.S, The Verge reported Saturday.

The court ruled on a habeas corpus petition filed by the ACLU on behalf of two Iraqi men who were detained at JFK airport Saturday following Trump’s ban. Both men, Hameed Khalid Darweesh and Sameer Abdulkhaleq Alshaw have been granted entry to the United States since.

Acting-President Bannon is going to be pissed.

ETA: As a couple of commenters have noted, this stay of the EO is limited to a certain class of individuals and is just the start of the fight, but it’s good news. At least it gives the brave people who are at airports fighting this a solid basis to demand that Dolt 45’s orders stop being enforced here and now.

    People go through hell and back to get a GC. It takes years if you don’t have a US citizen relative (spouse/parent) and even then it is not easy. This order just pissed on all legal immigrants, no matter their country of origin telling them that they don’t amount to anything. Their lives, their struggles are worth zilch to this Republican President. There are quite a few GC holders in the armed forces too.

    IIRC, we kinda abandoned habeus in the Military Commitssions Act of 2006.
    The President or his designee may determine without review that any individual is an “enemy combatant”
    and that designation puts that person beyond the reach of a habeus motion. Do I have that right?

    Wonder if there’s going to be any legal recourse if 20 million of us are tossed off health insurance? I think that what was done Friday was completely shitty, a straight-up violation of both immigration law and human rights charters, and desperately needed to be smacked down.

    @amk: I doubt it…if anything Canada wants to try and minimize collateral damage done to NAFTA, so I would think Trudeau will be as reasonably accommodating as he can without stirring the pot.

    You can get a lot done when you utterly don’t care about — and are likely ignorant of — the full ramifications and consequences for your actions. Obama was very careful to figure out exactly what he could get away with in his executive orders; Trump utterly doesn’t care, and will happily direct the executive branch with illegal orders.

    Things are bad enough, and they’re going to get worse, but we don’t need to go overboard with the hyperbole that Bannon is going to throw us all in Gitmo or trash Habeas Corpus. We still have legal protections even though Trump is trying to trash them.

An 8 point drop in approval in his first week, protests at major airports, his EO being overturned… it’s utterly humiliating and he only did it because someone (Bannon) convinced him it was a slam dunk and would make all the girls horny for him.

    True and true and true. But when the courts rule against him, it gives folks like customs agents and TSA officers more room to ignore, defy, slow-walk, or “misunderstand” directives. It also gives MoCs more cause to oppose Trump and eventually force him from office. That’s where this is heading…he is into dominance and he has only gotten worse every time he gets more power. Well, now he has ultimate power…but he’s going over the line with it. The courts will oppose him and obviously the majority of the American people oppose him…so it’s a matter of time…

    An ABC News transcript of its interview with President Donald Trump on Wednesday quoted him as saying that two people were fatally shot in Chicago while his predecessor, Barack Obama, was giving his farewell speech at McCormick Place — a claim shown to be false by Police Department records.

    The passage in question was not included in the broadcast aired Wednesday night, but the network posted a longer transcript on its website that contained the remarks in question. An ABC spokesman confirmed to the Tribune on Thursday that the transcript accurately depicted the president’s words, but the network did not immediately share the video with the Tribune.

    “So, look, when President Obama was there two weeks ago making a speech, very nice speech,” Trump said, according to the transcript of the interview. “Two people were shot and killed during his speech. You can’t have that. They weren’t shot at the speech. But they were shot in the city of Chicago during his speech. What — what’s going on?”

    “Based on careful analysis and research over the last NN months, it has been determined that [Deadbeat Shitgibbon] will by lying at least 90 percent of the time in the following interview/speech/segment. It is quite possible — in fact, highly likely — that NOTHING he states as factual will actually be true.”

    Yes, absolutely. He has gotten even worse with every step, with every increase in power. He was a near-joke at the start of the primaries…then started winning and got even more obnoxious. He got to the ‘finals’ and was throwing so much crazy out there, many thought that Kasich or Cruz were going to win the nom. Then he wins the nomination and goes berserk attacking the family of a dead soldier and a former beauty queen. And so on, and so on…

    Now, here he is, drunk with power, with Flynn and Bannon whispering in his ear constantly, existing off of wacko TV news and crap like Breitbart and Alex Jones. He’s got the GOP (Ryan, McConnell) by the balls, Putin has him by the balls, and the majority of the country is doing things it has never done before…like swamp airports in the middle of the night, fed up with his shit.

    Knowing that Trump’s only way to respond to “attacks” (in his view) is to double down, he’s going to go nuts again all week next week. I don’t know exactly what that looks like, but it seems likely that he will lash out at “Obama judges” and political correctness and what not. I can see even more executive orders coming out…

    …and in the meantime, the drumbeat grows louder for GOP MoCs to step up and oppose this madness, business execs start complaining, the Indivisible campaign continues, even more marches are scheduled, more media folks openly report on the “president”s state of mind (they’re already reporting on him acting like a petulant child!)…

    …to which I say, good. Keep calling your MoCs about every little thing but above all encourage them to oppose Trump 100%. Join the ACLU. Think about the next march. And if you have a creative way to shame a national R for going along with all this crap, fire away!

    Those signs became apropos the minute the networks called the election for this moron. Almost everything he’s done since he was elected made me ashamed of my country for containing enough stupid people to do this to us and the world.
    The answer is YES, YES, YES, WE MISS YOU. I WANT TO BEG YOU TO COME BACK, but Michelle would beat the crap out of me.

    Thank god for the ACLU and the courts.

    You know, I thought he’d be terrible, but I also thought that at least his desire to be loved would stop some of his most reckless impulses, but it’s the exact opposite.
    I guess if you stop and think about it, the further along he’s gotten on this journey to the presidency, the worse he became. The media kept telling us that he would moderate every time he reached a new milestone, but the opposite was true. He is a petulant brat who “did it his way”, he’s ignored conventional wisdom at every turn, and he won anyway, so he still feels he can do as he pleases, and he will still win. The difference is now he’s no longer a candidate, his words and actions have real consequences to real people. His supporters may love that he’s doing all these things he said he’d do, but for the rest of us, he’s confirming every fear we had. The Theresa May’s of the world may want to be friends with him, but they have a domestic audience that is appalled by him. I can only imagine the local broadcasts all over the world with heartbreaking stories of people stranded because of this order. I guess the G7 and other international confabs around the world are about to become huge protest zones. He thinks he’s unpopular now, he aint seen nothing yet.

    @Another Scott: Too late for sternly worded letters. What made the diff today were outraged citizens mobbing airports and contributing to the ACLU via cell phone while the ACLU lawyers interrupted a judge’s weekend. By the end of the day, Dem senators, congressmen and governors were out there too, and 4 or 5 GOP senators were loudly opposed. A real public humiliation for Trump,who, we now know, will double down. Meanwhile, CNN, the WaPo, and even the NYT have finally found the jars they buried their nuts during the reign of W, and are getting used to using words like “lies” and “false” on ledes. I am hoping they learn to use “chaos”, “incompetent”, “unconstitutional” and “illegal” before millions die or the world
    abandons the dollar as a reserve currency. Let us jope thay even if this notthe beginning of the end, it is the end of the beginning.
