A persuasive case by Paul Campos that the $1.6 million payout to a Playboy model was not covering up an affair with Elliot Broidy, but with… Donald Trump https://t.co/z14iLQ8bMo
— Jonathan Chait (@jonathanchait) May 8, 2018
When this report appeared yesterday, I figured we could wait a bit, see what the professional news media would do with the theory:
…The Wall Street Journal published a story on April 13 revealing the existence of another nondisclosure agreement involving an affair between an adult entertainer and a client of Cohen’s. The NDA employed the pseudonyms David Dennison and Peggy Peterson — the same names used in the Stormy Daniels NDA — and was otherwise very similar to the Trump-Daniels agreement…
Whatever source revealed the existence of this NDA to the Journal also disclosed that, according to another document in Cohen’s office, the Dennison in this agreement was not Donald Trump but rather Elliott Broidy, a top Republican fundraiser, while Peterson was Shera Bechard, Playboy’s Miss November 2010. Apparently, Bechard had been Broidy’s mistress until he got her pregnant, at which point she hired Davidson, who contacted Cohen to demand the payment of hush money.
By a stroke of good fortune, Cohen already had a sex-scandal-with-an-adult-entertainer-hush-money-NDA template in his hard drive, since he had recently drafted at least one for Donald Trump. Indeed, Cohen didn’t even bother to change the pseudonyms. (That economical use of attorney resources explained away what otherwise could have been a very awkward detail in the narrative.)…
Let me offer an alternative explanation of the affair and the payoff. It is still just a hypothesis, but, I would argue, it fits more comfortably with what we know about the various players than the reported version of events: Donald Trump, not Elliott Broidy, had an affair with Shera Bechard. Bechard hired Keith Davidson, who had negotiated both Playboy playmate Karen McDougal’s deal with the National Enquirer and Stormy Daniels’s NDA with Trump. Davidson called Cohen, and the two of them negotiated a $1.6 million payment to Bechard.
At this point Cohen needed to find a funding source. Cohen asserts he took out a home equity loan to come up with a mere $130,000 to pay off Stormy Daniels, so it seems clear he couldn’t have fronted the $1.6 million for the Bechard deal himself. So Cohen reached out to Elliott Broidy, a very rich Republican fundraiser with several pending and highly lucrative business deals with foreign governments: deals that hinged on whether Broidy could convince the U.S. government to take various actions. By stepping up to take responsibility for the affair and to fund the seven-figure settlement, Broidy was ensuring that he could continue to peddle his influence with Trump to governments around the world.
Which is to say, it was a cover-up concealing a bribe. Indeed, it turns out that Broidy not only has a history of bribing public officials, but of bribing them in an uncannily similar fashion to the method which I hypothesize he employed in this case…
People thought the Stormy Daniels story was a tawdry distraction from the Russia story but it turns out it’s all one story

So far, not much! Possibly those professional newspeople are busy doing the legwork. Professor Campos has posted a couple of times at his usual outlet, Lawyers Guns & Money:
Imagine the conversation. “You can take this hit a lot easier than me. I’ll do something very nice for you, okay?” pic.twitter.com/MK7ANDXAIf
— Schooley (@Rschooley) May 8, 2018
(Write your own joke about whether a guy like this would be averse to bragging he’d banged a Playboy model)
the other compelling loose thread here: there is no chance in hell Cohen had his office tossed for simple campaign finance crimes – whatever put him on the radar and served as cause for that raid would be enormously illegal, & the Broidy-Cohen-Trump laundering theory would fit
— Kilgore Trout (@KT_So_It_Goes) May 8, 2018
Repeating the obvious:
If a President wanted to swiftly extinguish these increasingly grave questions, why not release even a redacted version of your tax returns to prove some distance between these payments and your lawyer?

Semi-off topic, but this seems utterly insane. We may as well just roll over and play dead. (And no, I’m not suggesting we give up. I’m suggesting that the Trump Admin is giving up, and that is fucked up beyond reason).
The cleanup from this reign of error is going to take years. Years that the press and our electorate probably won’t tolerate. “Why is my bank being hacked monthly now? Can’t Dems fix this?” they’ll ask, because they won’t remember all the ways Bolton + Trump screwed the pooch.*

@Major Major Major Major: At the level of abstraction of string theory, explain and predict really amount to the same thing. In both cases, what you’re asking is “can this theory serve as an underpinning for the more mundane theories that are everyday-useful?”. The problem is that typical string theories have lots of tweakable knobs that let them meet that test, but all of the different variants have different knob settings (or often, completely different knobs) and there’s no good way of telling which one is meaningful. Or if any of them are meaningful.

For this particular scandal, basically 2017.
“A top republican donor close to President Donald Trump tried to negotiate a $75 million fee from the man at the center of the 1MDB scandal if he could get the U.S. to stop investigating the Malaysian state investment fund, the Wall Street Journal reports.
Elliott Broidy, a longtime Republican donor, and his wife, Robin Rosenzweig, discussed setting up a consulting contract with Jho Low, who has been accused of embezzling state funds, the WSJ, according to emails that the publication reviewed.
One email showed a proposal that would have given Broidy and his wife $75 million if they got the Justice Department to drop its probe into 1MDB.
Broidy also prepared talking points for Malaysian Prime Minister Najib Razak for his 2017 visit to Washington that included a meeting with Trump. Some of the talking points included talking up Malaysia’s relationship with the U.S. in fighting North Korea and arguing against the legal pursuit of 1MDB.”
But of course the 1MDB scandal goes back a lot further than that. Back to when Trump suddenly and surprisingly found millions in cash to spend on real estate.

I’ve spent a lot of time cursing her for not taking that damn dress to the cleaners (Ew, ew, ew still today, and how many problems could have been avoided) and confiding in that harridan Linda Tripp, but for Town & Country to invite her, then I assume invite Bill Clinton, or invite them both at the same time, and then rescind her invitation, and I assume not his, is way rude and unprofessional.

@Corner Stone: @Omnes Omnibus: won’t be a problem if she abides by the terms of her contract as his beard

@Mnemosyne: I seriously doubt that Bill would mind her presence there anyway
Omnes Omnibus
@Mnemosyne: I agree.

@Steve in the ATL: Sounds like Danica’s dad is more interested in having a sexual relationship with Aaron than she is.

@Corner Stone: who are we to get in the way of their happiness? As a Chicago native, I’m happy to have the Packers star quarterback distracted.

Josh Marshall wrote someplace on his blog today that this though just occurred to him today. I didn’t know Marshall was so naive. This thought has occurred to me every time Trump makes one of big pronouncements on anything, particularly economic, trade or finance policy. It did in fact occur to me the day he said he’d decided to go after high drug prices, which I remember. Maybe some of the incoherent jig jogs in his subsequent actually are because the Trumspters are waiting to see how comes to the table in the quiet back rooms with most cash.
So, how did a naive chump like Marshall, who from this statement, appear to be a wet behind the ears kid who just fell off the turnip truck get to running a big savvy political news blog? I don’t get it. Some guys have all the luck.
” I think we need to ask whether this comment [Trump statement he would do something about high drug prices early in his term] wasn’t designed to push people into Cohen’s arms or other Trump insiders looking for cash. ”

@Corner Stone: I think they didn’t find him—he found them. The question is how. It may be that Trump told him who to seek out and he offered his services pro bono or part of the settlement money, to them, without revealing the conflict of interest between Trump and himself. It’s just too coincidental that he keeps representing multiple women known to have signed NDAs with Trump (the women couldn’t possibly have known each other or the fact they had affairs with Trump, and the NDAs barred them from talking about it, even to each other)….and that implies conspiracy against the women who signed the NDAs. Since the whole setup of the NDAs were tainted by the conspiracy, they may be null and void. A lawyer might know and I think that’s what Avenatti is hinting at. Avenatti is investigating the whole corrupt scheme right back to the original sources and conspirators. Trump could be in serious trouble just for this whole enterprise.
