About that Mueller Report

While the dimmer bulbs in the media are slowly starting to figure out that maybe, just maybe, the Mueller Report didn’t exonerate Trump (I suppose the first clue was Mueller explicitly stating the report did not exonerate him, but hey- I’m not paid the big bucks like Maggie Haberman and company), the House is busy supboenaing the hell out of everyone and everything in sight. We will eventually get to see the Mueller report, I think, but it might be some time.

It’s pretty clear that the reason Trump was uncharacteristically quiet on twitter the weekend the report was sent to Barr was that they were trying to figure out how they were going to do damage control. Apparently they settled on throwing Barr to the wolves, letting him issue the bullshit 4 page memo, and the use that to blow up and out the puke funnel to try to firm up the opinion that there is no there, there. They had some help from the typically idiotic press who, as usual, took the Republican’s word on things and uncritically blasted it out for a few days before doing what they always, which is make the story about themselves and spend the next few days deciding who the winners and losers in the media are. Another assist came from various useful idiots (see Michael Tracey, Matt Taibbi, and others), who have decided without seeing the report that there was nothing inappropriate going on with Russia and because of that, none of the other criminal shit matters, either. I wish I was kidding:

like when they investigate the mob for money laundering and discover murder, extortion, blackmail and drug trafficking, they just drop it because the whole thing was based on false pretenses.

If you want a brutal take down of these guys, you should definitely read Klion on Taibbi and Greenwald (whom I still like and respect even though I think he has been crazy about this whole Trump investigation and who is always worse on twitter than he is in his longer pieces- the price of being a contrarian with a temper, I suppose).

Despite all of that, it ain’t working. Polls show that only around the crazification factor thing that Trump is innocent, with around 70% saying either no or dunno. So, for those of you who are cynical as fuck, like me, and sick of going high, it is my personal opinion that the longer Barr drags this out, the worse it is for Barr, the worse it is for Trump, and the worse it is for Republicans. Additionally, while there may be a number of redactions done for legitimate national security reasons, it’s excellent fodder for “WHAT ARE THEY HIDING?” I spent a lot of time listening hearing Republicans say “If you haven’t done anything to hide” while they stomped all over our civil rights and privacy, and I watched them launch ridiculous investigations over Benghazi and stoke birther bullshit and spew nonsense about Hillary’s emails, so you know what, fuck it. Let’s beat them up and use what they are giving us.

So yes, I am dying to read the Mueller, but the cynic and political opportunist in me is to hope the Republicans keep self-owning themselves and drip it out in pieces and redact a ton of shit. Anything that hurts these guys is a win for the country. Period.

More women coming forward about Biden:

Vail Kohnert-Yount said she was a White House intern in the spring of 2013 and one day tried to exit the basement of the West Wing when she was asked to step aside so Biden could enter. After she moved out of the way, she said, Biden approached her to introduce himself and shake her hand.

“He then put his hand on the back of my head and pressed his forehead to my forehead while he talked to me. I was so shocked that it was hard to focus on what he was saying. I remember he told me I was a ‘pretty girl,’ ” Kohnert-Yount said in a statement to The Post.

She described feeling uncomfortable and embarrassed that Biden had commented on her appearance in a professional setting, “even though it was intended as a compliment.”

“I do not consider my experience to have been sexual assault or harassment,” she stated, adding that she believes Biden’s intentions were good. “But it was the kind of inappropriate behavior that makes many women feel uncomfortable and unequal in the workplace.”

I don’t like people touching me without permission- why is it so hard to understand that women may not want to be touched by Biden? I mean, personally, the list of people I want to touch me includes my doctors and nurses, my LMT, the ladies at the nail salon, and maybe a handful of other people. The end.

The thing about this that is so vexing is that I don’t think Biden is some sort of old pervert who is doing this out of some sexual perversion. I don’t think he is trying to dominate these women or do anything like that- I’ve seen video of him hugging it out with guys and invading people’s personal space. And I don’t think the women coming forward are doing this out of political motivation (I’ve seen people suggest Lucy Flores is a big Bernie supporter so that is why she is doing this), particularly since most of the women who have come forward have specifically stated that they like the guy and don’t think it was sexually motivated. It was just inappropriate.

I mean ffs just google “Joe+Biden+hugging” and you will see that if something has been alive in the past seventy years within five meters of Joe Biden he has hugged the fuck out of it. He’s a jocular guy and he’s handsy as fuck and it worked well in retail politics for him for years. But that doesn’t make it any less inappropriate. And it doesn’t mean that this shit isn’t going to be electoral poison.

Just don’t fucking touch people.

The sheer effrontery, the unmitigated gall…

I’m catching up on the Mueller team leaks to The Times and The Post that Cheryl mentioned last night. Josh Marshall also covered it at TPM. Quoting The Times’ account of the DOJ reaction to the leaks, Marshall highlights the almost superhuman cynicism of the Trump administration hacks — not necessarily Trump himself, who is probably too stupid to fully comprehend the shell game being played here — but the DOJ leadership, including Barr and Rosenstein:

“Mr. Barr and other Justice Department officials believe the special counsel’s investigators fell short of their task by declining to decide whether Mr. Trump illegally obstructed the inquiry.” And why didn’t he release more than his exonerating summary? “According to officials familiar with the attorney general’s thinking, he and his aides limited the details they revealed because they were worried about wading into political territory.”

They were afraid of being political! That’s amazing. And there’s more. “Mr. Barr and his advisers expressed concern that if they included derogatory information about Mr. Trump while clearing him, they would face a storm of criticism like what Mr. Comey endured in the Clinton investigation.”

Since Trump is still leading “Lock Her Up!” chants two-plus years into his presidency, it’s easy for low-info voters to forget that the memo Rosenstein produced as post-hoc justification for firing Comey criticized the FBI director for mishandling the email investigation in a way that was unfair…to Clinton. Of course, Trump confessed the real reason for firing Comey (“this Rusher thing…”) on camera to Lester Holt, but the official explanation for shit-canning Comey is that he sand-bagged Clinton.

And now Barr’s office has doubled-down on that unbelievably cynical justification to explain their rationale for summarily exonerating Trump of obstruction charges without releasing the evidence. Barr doesn’t want to pull a Comey, they’re saying. The fucking balls on these people!

Anyhoo, it’s heartening to see these leaks, which appear to beat back the “total and complete exoneration” lie that Barr has been helping Trump sell since March 24. It’s also encouraging that public opinion of Trump hasn’t moved so far, despite the initial (and idiotic!) mainstream media acceptance of Barr’s summary as dispositive.

BHP funding and wasted APTC

The Center for Medicare and Medicaid Services (CMS) released a proposed rule on funding the Basic Health Plan (BHP) for 2020.  They propose a rule that will lead to about a 3% reduction in federal spending to be counter-acted by a dollar for dollar increase in state spending.  BHPs are a part of the Affordable Care Act where states could run a program for people who earn under 200% of the Federal Poverty Level instead of running the exchange.  The BHP is funded by a block grant that is equal to 95% of what the federal government would have spent on premium and cost sharing reduction subsidies for the people who enroll in the BHP.

The termination of CSRs led to CMS cutting the CSR component of funding.  Minnesota and New York sued and a settlement was found where CMS attributed Silver Loading incremental premium increases to the BHP payments.  Dr. Lynn Blewett of the University of Minnesota and I examined this rule last year in a Health Affairs blog:

The BHPs in New York and Minnesota will receive almost half a billion dollars more in funding than they were told to expect in December 2017….

We can assume that 2019 BHP payment rules will continue to incorporate some type of plan adjustment factor that relies on an estimate of the silver increment due to the continued obligation of insurers to provide cost-sharing reduction payments without direct federal reimbursement. …

The plan adjustment factor in the proposed rule is the same exact plan adjustment factor as it was in the settlement rule. However CMS introduced a new factor this year; Metal Tier Selection Factor (MTSF) which is a multiplier to the rest of the formula that reduces what CMS owes.

After the discontinuance of the CSR payments in October 2017, several changes occurred that increased the expected impact of enrollees’ plan choices on the amount of PTC paid. Silver-level QHP premiums for the 2018 benefit year increased substantially relative to other metal-tier plans in many states (on average, by about 20 percent). We believe this contributed to an increase in the percentage of enrollees with lower incomes choosing bronze-level plans, despite being eligible for CSRs in silver-level plans, because many were able to purchase plans and pay $0 in premium; according to CMS data, the percentage of persons with incomes between 0 percent and 200 percent of FPL eligible for CSRs (those who would be eligible for the BHP if the state operated a BHP) selecting bronze plans increased from about 11 percent in 2017 to about 13 percent in 2018. In addition, the likelihood that a person choosing a bronze-level plan would pay $0 premium increased (and the difference between the bronze-level QHP premium and the available PTC widened). Between 2017 and 2018, the ratio of the average silver plan premium to the average bronze plan premium increased from about 117 percent to 133 percent;

Okay, that is a whole lot going on. Basically,CMS is saying that due to Silverloading, the gap between the benchmark silver plans and the cheapest Bronze plans increased significantly. 20% more people in 2018 who earned under 200% FPL bought Bronze plans because they were likely to be low or no premium. If the Bronze plan is a zero premium plan, it is very likely that the buyer “wasted” some eligible premium tax credits. CMS is trying to claw that “wasted” premium tax credits back.

Comments are needed by the first week of May if you want to tell CMS what you think can be done to this formula.

Today is something neat. I’ve spent countless hours looking out plane windows at the North Atlantic, but I don’t think I’ve seen Greenland!  I have, though, taken the far-north-route from SFO to Narita and saw wonder after wonder in the icy north. I think I even saw Russia from my seat!
