Well yes. They can. Absent any presidential pardon.
Although Flynn was mostly a problem during the 2016 campaign. He’s been out of Trump world since then. There are probably hundreds of more recent targets to aim at since 2016 that are complicit in actual Trump Administration crimes, especially related to Covid-corruption that is going on today.

@David ? ☘The Establishment☘? Koch: Refile? The Biden DOJ can file all new charges. Flynn was only charged with a handful of relatively minor things, I think because if they’d filed on the big stuff they had on him, the sentence would have to be stiffer. The minor charges were what he got for cooperating. But he’s stopped cooperating. Those actions and the record of those actions won’t have gone away. It’ll just be another item on the clean-up crew’s checklist.

SCOTUS also issued a unanimous normalization of public corruption, overturning the convictions of Chris Christie’s bridgegate accomplices, because they didn’t receive a financial or property benefit for their malfeasance.
In other words, when a public official decides to create a problem only out of malice, it’s perfectly legal.
Another proud entry into the SCOTUS canon.

Since Obama specifically warned Trump against hiring Flynn, that proves Flynn must be entirely innocent and pure. Also, the whole ‘pleading guilty’ thing is an obvious hoax. And also, don’t ask about Turkey.

My understanding of procedure is that Barr can decline to prosecute the case, but the judge has to dismiss it, and should the judge dismiss the case “with prejudice,” the charges cannot be refiled. Otherwise the charges can be refiled. One hopes that latter will be the case and that Barr himself will be added as an accessory after the fact
But I’m sure glad the Republican Party decided to dispense with rule of law and vote not to remove Trump by impeachment. Because when the rule of law is rejected, there is no law. And nothing is illegal.

@tokyokie: There truly is one set of laws for the rich and powerful, another for the rest of us. The biggest crook avoided punishment and lives in the White House. Why bother to prosecute any crime at all. Makes me wonder what is acceptable.

@Duane: I had a brief vision of a series of nation-wide protests, masked socially-distant marches in the streets, etc., scheduled for when the national death toll is projected to hit 100,000.
But then I realized that that is probably too soon – like May 18-20th or so at current rates.
Grrr…
Perhaps Memorial Day (May 25) would be a sensible choice, but it’s still very close.
