… U.S. District Judge Timothy Kelly on Tuesday rejected defense attorneys’ arguments that the four men — Ethan Nordean, Joseph Biggs, Zachary Rehl and Charles Donohoe — are charged with conduct that is protected by the First Amendment right to free speech.
Kelly said the defendants had many nonviolent ways to express their opinions about the 2020 presidential election.
“Defendants are not, as they argue, charged with anything like burning flags, wearing black armbands, or participating in mere sit-ins or protests,” Kelly wrote in his 43-page ruling. “Moreover, even if the charged conduct had some expressive aspect, it lost whatever First Amendment protection it may have had.”
Nordean, Biggs, Rehl and Donohoe were indicted in March on charges including conspiracy and obstructing an official proceeding. All four of them remain jailed while they await a trial scheduled for May.
Defense lawyers also argued that the obstruction charge doesn’t apply to their clients’ cases because Congress’ certification of the Electoral College vote was not an “official proceeding.” Kelly disagreed…
On the morning of Jan. 6, Proud Boys members met at the Washington Monument and marched to the Capitol before President Donald Trump finished addressing thousands of supporters near the White House.
Just before Congress convened a joint session to certify the election results, a group of Proud Boys followed a crowd of people who breached barriers at a pedestrian entrance to the Capitol grounds, the indictment says. Several Proud Boys also entered the Capitol building itself after the mob smashed windows and forced open doors.
More than 700 people have been charged with federal crimes related to the Capitol riot. At least 165 of them have pleaded guilty, mostly to misdemeanor offenses punishable by a maximum of six months’ imprisonment.
And that guy absolutely would have brought it (or other military long guns visible in his indictment photos) had DC not had strict open carry laws that would have prevented him and the countless other gunfuckers Trump collected from getting within a mile of the Capitol.

Judge Tim Kelly was appointed by TFG. One of his earlier appointments. Bet he’s been a bit of disappointment to TFG. He also ruled in favor of Jim Acosta when the WH pulled his press credentials. On the more important stuff, Kelly ruled to let Mulvaney stay on as temporary head of the CFTB after Rich Cordray had appointed somebody to replace him before he left to run Ohio governor.

It was all very confusing and upsetting, and then I remembered I had beer.

HDMI cables widely available. Even hardware stores now carry them as a matter of course. One wasn’t tucked inside in the box? Only suggestion would be not to go for a bargain basement price. Nothing necessarily wrong with off-brands but if it doesn’t seem near the price range of other brands, be wary.

Another commenter was complaining about the lack of support from the left for President Biden’s policies, and I replied that some people on the left were emotionally and intellectually opposed to the success of a liberal administration. You came back that while you appreciated some of my comments, you were “really tired” of my “liberal/left bashing.” Pretty soon another person agreed that this “ironically” was a one track approach. So, being thin skinned as I am, I’m saying that you misread my comment.

Fellow commenter assured me,”oh, no, they are protected, they (judges) have security.” As more info comes out, we learn the Supremes were next on the list with another “rally” planned there. @SFAW: This would certainly lessen confusion. Right now the same person might be described or describe themselves as Left, Liberal, or Progressive. The “right” side of the Democratic Congressional Caucus might be described as Moderate, or more invidiously as Centrist or Conservative. My own political taxonomy has the 110 or so members of the New Democrat and Blue Dog Caucuses classified as Moderates, and the 95 Progressive Caucus members as Liberals. But those distinctions are sometimes just a matter of branding. If you compared the thirty most liberal New Democrats to the thirty most moderate Progressives you might find little actual difference, and I think the differences between these two wings of the party tend to be exaggerated.
Then there is Illinois Congresswoman Lauren Underwood, who accomplishes a lot without joining any of the ideological caucuses.
But our exchange is another reminder that I need need to choose words carefully, especially labels.
