Joshua James of Alabama pled guilty this afternoon to two felony counts:

  • Obstruction of a government function
  • Seditious Conspiracy

As part of the plea deal, he agreed to accept that the government has the right to argue for an upward enhancement in his sentence.  He is also cooperating.

His statement of offense is quite exhaustive.

    Can someone explain something to me?

    We are at war with one of our biggest, if not the biggest, adversaries. Our allies are mobilizing, the threat of nuclear weapons is in the open.

    One party, presumably aligned with the adversary, decided to be absent from the State of the Union address. Are we sure there was no plan to bomb the Capitol?

    Edit: So among other things, this seems to ratchet up the pressure on Rhodes.

    The Statement of Offense keeps referring to “others” who they met with, discussed plans with, and were in contact with during the insurrection.  I’d sure like to know those others are: 3%er no-names? Roger Stone? Don Jr.?  Boebert? MTG?

    @bbleh: Maybe so. Maybe so. However, if people get hard time for this, there will be a chilling effect on the other knuckleheads. Right now they still think they’re invincible. That goes away with the first conviction with a long sentence and fines that wipe out the entire net worth of the guilty. It won’t affect all of them (hell, some of them actually are mentally negligible), but it will hit home with the ones who 1) have an IQ greater than their age and 2) have more than two nickels to rub together.

    @Chief Oshkosh: yeah that’s basically the distinction I was trying to draw (evidently not well).  Cripple the “action wing” by locking up leaders, defunding them generally, and also, as you say, creating examples pour encourager les autres.  When I used the word “politically” I meant, in the realm of electoral politics (vs violent action).  The background funders, of course, won’t be touched, and their money will still flow, but at least it will flow to jaw-jaw rather than war-war.

    Jan. 6 committee alleges Trump, allies engaged in potential ’criminal conspiracy’ by trying to block Congress from certifying election

    Lawyers for the House panel investigating the Jan. 6, 2021 attack on the Capitol said in a court filing Wednesday that former president Donald Trump and key allies engaged in two potential crimes during their effort to overturn the election: conspiring to defraud the United States and obstructing an official congressional proceeding — the counting of electoral votes.

    The alleged criminal acts were raised by the committee in a California federal court filing challenging conservative lawyer John Eastman’s refusal to turn over thousands of emails the panel has requested related to his role in trying to persuade Vice President Mike Pence to reject electors from states won by Joe Biden. Eastman has cited attorney-client privilege as a shield against turning over the documents.

    The committee argued in that filing that Eastman’s claim of privilege was voided by the “crime fraud exception” to the confidentiality usually accorded attorneys and their clients.
