Now about that “bad precedent” to indict an ex-president…the original “bad precedent” in this arena was Jerry Ford pardoning Nixon way back when. Since then there’s been an expectation that once you get past a certain level you are more or less immune to legal jeopardy, no matter how much one’s misdeeds deserve punishment. Henry Kissinger comes to mind, among others. If ever there was a villainous war criminal who deserved punishment…but he is 99 years old and has never done a day of time nor will he.
But if a seriously unpopular ex-president can escape all consequences for unprecedented criminal and/or moral crimes, we’re finished as a functioning democracy. If there are no consequences, what hinders another more competent would-be dictator?

I have no problem with people being outside the law; “outlawry” has a long tradition. But it has to work both ways — they also have to be outside all the protections of the law. A complete loss of all property rights would be a nice place to start.

@Scout211: That Maddow Blog story also linked to another Blog report relating to the potential prosecution of Matt Gaetz. The item described a recent motion filed by Gaetz “wingman” Joel Greenberg, asking a federal judge to schedule his sentencing hearing. A couple experts weigh in on the import of Greenberg’s filing; cooperating witnesses often are not sentenced until they have testified in other trials. The conclusion basically was: we don’t really know.
Still, the Blog item gives a good short summary of the Greenberg case. Right now, former Seminole County Tax Collector Greenberg is incarcerated in the Orange County, Florida jail.
