Another One Bites the Dust

Federal Judge Alvin Hellerstein has rejected Trump’s request for him to intervene and move his election interference case (also known less accurately as the hush money case) from that mean awful judge in New York.

Hellerstein, echoing his denial of Trump’s pretrial bid to move the case, said the defense failed to meet the high burden of proof for changing jurisdiction and that Trump’s conviction for falsifying business records involved his personal life, not official actions that the Supreme Court ruled are immune from prosecution.  (AP)

As far as I can tell, Trump has only one Hail Mary pass left.  (related to this particular case)

Hellerstein sidestepped a defense complaint that Trump’s state court trial had been plagued by “bias, conflicts of interest, and appearances of impropriety,” writing that he “does not have jurisdiction to hear Mr. Trump’s arguments concerning the propriety of the New York trial.”

The Manhattan district attorney’s office, which prosecuted Trump’s case, declined comment. Earlier Tuesday, the office sent a letter to the trial judge, Juan M. Merchan, objecting to Trump’s effort to delay post-trial decisions in the case while he was seeking to have the U.S. District Court in Manhattan step in.

Merchan is expected to rule soon on two key defense requests:

  1. Trump’s call for the judge to delay his Sept. 18 sentencing until after the November election,
  2. [Trump’s] request that the judge overturn his conviction and dismiss the case in the wake of the Supreme Court’s ruling.

Merchan has said he will rule Sept. 16 on Trump’s motion to overturn the verdict. 

Tick tock, Donnie!

I hope that with these two dates approaching (Sept 16 and Sept 18) Trump is as nervous as a good shitting peach pits, as my old boss liked to say.

    I assume the tl;dr version of the ruling on the Trump motion will be “Fat chance.”  But since he’s a careful judge, the actual opinion will be much longer and go into detail.  I will say that some of the things I saw about the motion were farcical enough that “fat chance” might have been the appropriate response.

    The federal judge that denied his request kindly recommended he and his attorneys use the proper appeals process to the state appeals court and state supreme court.  But this has not stopped Trump and his attorneys to try again to appeal to a federal court.

    (CNN)      Former President Donald Trump will continue to fight to move his New York hush money case into federal court – and delay his sentencing on that conviction – by now appealing to the Second Circuit Court of Appeals, according to a notice of appeal filed Tuesday night.

    A federal judge in Manhattan denied his initial request to move the case to the Southern District of New York on Tuesday. Trump’s attorneys filed a notice of appeal of that decision soon after.

    Trump’s legal team filed the petition last week to move the state case to federal court in the wake of the Supreme Court’s presidential immunity decision. They also asked the federal judge to postpone Trump’s sentencing, currently set for September 18.

    Judge Juan Merchan still has not ruled on Trump’s separate request to delay the sentencing until after the election.

    The judge could issue a decision as soon as this week.

    Your periodic reminder that:

    an actual American,

    who is actually running for president in the real sense,

    who was charged with crimes,

    and is actually innocent,

    would be moving heaven and earth to get all his legal proceedings done before the election so everyone could vote based on their knowledge of his total innocentitude.

    Trump isn’t doing any of that.

I’d like to see him in prison but I’ll happily settle for a real forensic audit that finally proves that his net wealth is negative. They can confiscate his assets, after which he’ll be very glad to be in prison, because then Uncle Vlad’s friends won’t be able to get at him.

    There was a school shooting at a high school in Winder, GA about a hour from Atlanta.    One person was air lifted to the hospital, but CNN is saying that the nearby hospital said they admitted several people.

    The day after we were introduced to the CPR potion, one of the other young women in the class showed up and told us that her dad had had a heart attack the night before, and that she had kept him alive with CPR until the medics arrived.

    Goosebumps.

    Trump and his attorneys are trying to move the state case (due for sentencing on September 18) to federal court before the sentencing because they imagine that the federal court would somehow determine that his actions of bribery and business records fraud were presidential acts and therefore he would have immunity.

    I know, crazy.  But the SCOTUS six just might see it that way.  At least they hope it will.

    I think the Trump people are desperately trying to have the case moved out of the state court to a federal court before the sentencing happens, to (I guess that’s the theory) prevent the sentencing from happening.

    Truthfully it’s still murky.   Sheriff says multiple casualties, but all that is confirmed is one patient was air lifted to Grady hospital.

    @Scout211: Orders denying removal are not usually immediately appealable, IIRC. I don’t see the Second Circuit making an exception to that rule, but I suppose it is possible, since with Trump it appears that any legal avenue he decides to take becomes possible.

If someone wants to shoot up – say a school, but really any small to medium gathering,  they show up, start shooting and someone calls the cops who take 1-5 minutes to get there. There is zero logic in the thought process in this. It’s all hate and stupidity. And the size of the population doesn’t help in this, 334 million, only 330 million more than when the constitution was signed and the fastest means of travel was a horse.

    Unfortunately, the ship has not yet sailed on the power of chief Justice and his 5 RW SCOTUS cohorts to continue running interference for Trump, in addition to continuing to inflict wreckage on US Constitutional and federal law.  Even if they end up effectively cutting Donnie loose from their protective cloak, the overruling of the Chevron case frees them to become a shadow Administrative government arbitrarily undermining the real one on every policy they dislike as an “arbitrary and capricious” extension of government power beyond what the statutory text will support.  We won’t really be rid of Trump unless and until we get rid of the far-RW SCOTUS majority Trump installed.
