Good morning. We just published an inside account of how the Supreme Court decided the recent Trump cases– and how the chief justice guided the former president's winning streak. By me & @adamliptak https://t.co/GROZo9bDT6
— Jodi Kantor (@jodikantor) September 15, 2024
Jodi Kantor and Adam Liptak, at the NYTimes, examine “How Roberts Shaped Trump’s Supreme Court Winning Streak” [gift link]:
Last February, Chief Justice John G. Roberts Jr. sent his eight Supreme Court colleagues a confidential memo that radiated frustration and certainty.
Former President Donald J. Trump, seeking to retake the White House, had made a bold, last-ditch appeal to the justices. He wanted them to block his fast-approaching criminal trial on charges of attempting to overturn the 2020 election, arguing that he was protected by presidential immunity. Whatever move the court made could have lasting consequences for the next election, the scope of presidential power and the court’s own battered reputation.
The chief justice’s Feb. 22 memo, jump-starting the justices’ formal discussion on whether to hear the case, offered a scathing critique of a lower-court decision and a startling preview of how the high court would later rule, according to several people from the court who saw the document.
The chief justice tore into the appellate court opinion greenlighting Mr. Trump’s trial, calling it inadequate and poorly reasoned. On one key point, he complained, the lower court judges “failed to grapple with the most difficult questions altogether.” He wrote not only that the Supreme Court should take the case — which would stall the trial — but also how the justices should decide it.
“I think it likely that we will view the separation of powers analysis differently” from the appeals court, he wrote. In other words: grant Mr. Trump greater protection from prosecution.
In a momentous trio of Jan. 6-related cases last term, the court found itself more entangled in presidential politics than at any time since the 2000 election, even as it was contending with its own controversies related to that day. The chief justice responded by deploying his authority to steer rulings that benefited Mr. Trump, according to a New York Times examination that uncovered extensive new information about the court’s decision making.
This account draws on details from the justices’ private memos, documentation of the proceedings and interviews with court insiders, both conservative and liberal, who spoke on the condition of anonymity because deliberations are supposed to be kept secret.
The chief justice wrote the majority opinions in all three cases, including an unsigned one in March concluding that the former president could not be barred from election ballots in Colorado…
Lol he has already cemented a legacy as the worst Chief Justice of all time, and one who had no control of his own court

Roberts ruled that the Declaration of Independence, Constitutional convention, Federalist papers, Washington, Adams, and T. Roosevelt were all wrong about the presidency, while Nixon and Trump were right.
How could he have thought that'd be well received?https://t.co/UmvrKHftly— Nicholas Grossman (@NGrossman81) September 15, 2024
Roberts thinking that inventing near-total presidential immunity ex nihilo would be an attractive principle to anybody who isn't a hardcore Trump fanatic is exactly the kind of self-delusion that comes from unaccountable power https://t.co/W0TInVZwpr

Roberts epitomizes (and got confirmed) the fact that the problem(s) we face all circle back to the modern GQP. And there’s nothing to suggest they will be anything but a problem.
So long as you have people who will take an oath and then completely violate it (like Roberts has done) or use the levers of a legitimate system to attack and erode that very legitimacy, you are going to have this problem.
There is no reform that magically gets around this problem. The only solution is to keep Republicans out of positions of power. Reforms like court expansion and term limits for judges are great and I fully support them, but they only limit the amount of damage that Republicans can do.
There is no silver bullet solution to the problem of the modern GQP. Every political and judicial system on the planet struggles with it.
We’re seeing that in spades with this latest revelation.

I’ve been talking with WaterGirl, and we’re wondering if there’s interest in regularly scheduled postcard threads. I know we have a lot of people postcarding, but would it be fun to have a dedicated thread every week (*or however often) to do it as a collective?
If yes, when works for you?
Any suggestions for associated topics? Eg postcarding/music thread? Or cooking/recipe thread?
For me… I’m postcarding most nights, but Tuesdays are usually reliably free. Or maybe weekends? Those are less consistently available for me, but at least I don’t need to work the next day. XD And, of course, this doesn’t need to fit my schedule either!
P.S. Might be posting this around a bit the next few days so apologies in advance if you see this multiple times… Just want to try to catch all potentially interested postcarders.

All honest people will henceforth dispose with the use of the term “American Justice system” or any varieties thereof. We don’t have a system of justice. We have a legal system, a canon of laws and courts and lawyers, but it’s not in the pursuit of justice.
We may prosecute criminals, but that’s to punish, it doesn’t bring about justice. And when you’re a very wealthy and connected (white person in particular) you can argue the court system doesn’t even apply to you and there are judges who will agree.
We have a legal system horribly imbalanced and unjust.

SCOTUS decision critiques
I’ve been meaning to ask:
Is there a site or paper or book that examines and critiques SCOTUS cases?
I ask because I think it was Glen Kirchner, whom I heard say this immunity decision basically said the court ruled the constitution was unconstitutional and more recently I heard George Conway say he thought Roe had been poorly decided.
I’d be interested in any resource that went in to more depth on the whys of all that.
The link to the arc digital site is helpful in understanding the wrongness of the immunity decision:
“But the Court’s conception of official acts is so expansive that it encompasses nearly all of a president’s behavior, including key elements of Trump’s coup attempt.”
Similarly, though conversely, is there a rebuttal to the arguments presented in the referenced article above?
Many thanks for any suggestions.

cmorenc
And if Congress passes & the President signs a Judicial Code of Conduct applicable to SCOTUS, will Roberts & his 5 RW sidekicks rule any attempt to impose enforceable penalties or criminal liability on the Justices for noncompliance unconstitutional on the basis that only successful impeachment and conviction / removal by 2/3 Senate vote is the only Constitutionally authorized way to sanction SCOTUS justices? While such a law could not be applied retroactively against Justice Thomas, going forward if there was such legislation, and it criminalized SCOTUS justices from taking gifts worth more than $200 from anyone but immediate family members, but Thomas took further fancy trips from Harlan Crowe – the question could indeed come up before the Court.

I cannot express my true feelings regarding Roberts and the other corrupt MAGATS of the very corrupt Supreme Court. Such expressions of my opinion will get me banned from here and many other sites.
However, I will express my opinions regarding phone scammers. Yesterday, in spite of being aware of the various scams circulating our world, I was taken for nearly $1,000.00. The scam involved a call claiming to be from Wellls Fargo informing me that 2 withdrawals were made using a Zell account. I don’t currently due business with Wells Fargo, but they held my mortgage at one point. I immediately said I’ll contact my credit union. I was told that I need to directly call Zell and get it straightened out. I was given a claim #. I called Zell and the person who took the call directed me to log onto my credit union account and set up a transfer to “Luis Ruiz”. He was aggressive and bullying and I approved a transfer . Sadly, after it was too late to hang up, the transfer went thru. He then started to lead me into another transfer and only then I smelled a rat and called out the scumbag and then ended the call. I immediately called the credit union and reported the theft. I filled out a transaction dispute form and was soon notified that they were contacting Zell to dispute the transaction.
I can only think that I’m shit out of luck with Zell. They will go thru the motions of trying to recover the funds from “Luis Ruiz” but will give up. I will be stuck with a hit that is the equivalent of 1/2 my rent.
Yesterday was the first time I heard of Zell.
I feel violated, angry and utterly humiliated. I also feel at the mercy of a corporation that ultimately doesn’t give a shit that they are widely used for scams

James, can we break this down a little more so others can understand how this scam works. I think people are misunderstanding in the comments.
A lot of scammers reference Wells Fargo because it is one of the biggest banks. It is like how everyone gets calls about viruses on their Microsoft computers, and you have a Mac and tell them to pound sand.
This was the right inclination!
That call was not to Zelle. That was to the scammer’s assistant.
This bullying behavior causes people to panic and not use their best judgment. They do it because it works.

@Ivan X: To me that’s the interesting part: I’m still convinced the Times has been working for Russia since it sandbagged Clinton. So I look for the catch: what about this hurts America?
Particularly if it undermines Trump, whom the Times would much rather directly support along with Trump’s confederates in the Supreme Court?
Near as I can figure this is the answer: yes, it’s throwing Trump and his confederates under the bus, but it’s also delivering a message which is considered to be worth underbussing Trump for. I don’t think we’d see this if Trump was doing better. They’d be protecting Roberts etc. if Trump was doing better. Since he is not, they are trying to send a message:
“Your country is shit. Your institutions are failed. You’re doomed, give up hope, don’t vote or do anything to fix anything, it’s way too far gone”.
Look at it as the Times doomerposting. Be careful not to let them convince you it’s too far gone and nothing can be done. Don’t let the New York Times define what reality is. All they are doing here is saying ‘nyah nyah, you’re so fucked, give up’.
Chris T.
@Anotherlurker.:
Dead thread, but, here’s your answer: The banks got caught with their pants down by PayPal and Venmo. So they went with a quick and dirty “solution” to compete: Zelle. It’s so quick and so dirty that it should never have been used at all, but they were in a panic.
