When we have an offshore oil spill leading the nightly news, isn’t it good news for Democrats that Lindsey Graham’s defection swept some uncomfortable horsetrading under the rug?

The climate and energy bill that passed in the House of Representatives last year did so with the barest of margins. So supporters in the Senate spent months sweetening their version to win over skeptics.

Eileen Claussen, who directs the Pew Center on Global Climate Change, lists just a few: “There are provisions for offshore drilling with revenue sharing, there are provisions for loan guarantees for another, I think, 10 nuclear power plants that were not in the House bill.

Even though constitutional challenges usually cost around a million bucks, the HCR challenge is going to be a bargain for everyone. Luckily for the twenty states involved, Florida Attorney General Bill McCollum volunteered to do most of the work, and he got a sweetheart deal on outside counsel:

McCollum has assigned seven people within his office to handle the work, and hired the Washington, D.C., law firm Baker and Hostetler to represent the states. McCollum, who is running for governor in Florida, lobbied for the firm as recently as 2006.

Its lawyers, David Rivkin and Lee Casey, have lowered their hourly fee to keep costs under $50,000. Rivkin normally is paid $900 an hour, said Ryan Wiggins, a spokeswoman for McCollum.

It’s touching to see a politician and two lawyers set aside crass personal interest to defend the Constitution.

This is about as close as the Washington Post ever comes to calling a politician an liar:

Nelson said he had opposed starting debate on the bill because he objected to consumer-protection provisions that could harm “Main Street businesses” back home, including dentists, whose patients often borrow to finance major procedures that their insurance policies don’t cover, and auto dealers.

But after talking with Nelson, Dodd said, “Dentists and auto dealers did not come up.”

Instead, Dodd said, Nelson had spoken with him about making a change to the derivatives portion of the bill. Nelson favored including a provision that would exempt owners of existing derivatives contracts from having to post additional collateral, as required in the legislation.

Warren Buffett, Ben’s #1 constituent, has written more than $44 billion [pdf] in good old-fashioned derivatives, including puts on the S&P 500 and credit default swaps. Warren and other employees of Berkshire-Hathaway, Warren’s company, have also given Ben $75,500 in campaign donations. I guess Berkshire-Hathaway’s address must be on Main Street in Omaha.

Fox News has such deep and abiding respect for traditional marriage that their latest Fox on Sex column is written by an expert on open marriage and polyamory.

She also wrote this about Bristol Palin at HuffPo:

It’s because she’s Palin daughter that she’s getting the attention. But would she still be news if she hadn’t been knocked up? She needed a story. Now she has one. Aside from accidental pregnancy, a sense of being needed or valued is one of the primary reasons teenagers get pregnant. She’s a statistic, not a role model.

However, she is an attractive blonde, so at least that’s consistent with the rest of the Fox News brand.

Some Real Revisionism

Kristia Cavere, the teabagger running in New York’s 19th Congressional district, has a subtle revisionist take on WWII:

“The Republicans are the ones who liberated Europe in World War II.”

According to her bio,

In May 2009, Kristia received a Masters in Science degree in “Defense and Strategic Studies” from Missouri State University, which is located in Fairfax, Virginia right outside our nation’s Capitol. She graduated summa cum laude and with a 4.0 grade point average.

I’d like to know what else she learned at MSU. Unfortunately, even though she claimed to be raising $300K, she hasn’t filed a FEC report, so we probably won’t be hearing much more from Ms. Cavere.

How many times will this Lucy and the football game be played by various GOP senators before the administration catches on.

Instead of cartoons, why don’t we just look at another kind of drawing:

Since there aren’t enough Democratic votes for cloture, various Republican prima donnas are going  to be drawn, like moths to the flame, to the potential fame of being #60.   These drama queens will enjoy their moment in the sun as they become the center of media and Democratic attention.  And, yes, they’ll often flake out, as narcissists are wont to do.

None of this has anything to do with the administration’s ignorance — they know full well that they’re playing Charlie Brown to the Lucy du jour. Atrios is certainly smart enough to realize this.  I’d like to hear his alternative to kissing Lindsey Graham’s ass, because I have no clue what other, better strategy is waiting in the wings.

Why Our Food is Full of Shit

Tom Harkin is making an effort to give FDA some teeth and more inspectors, for good reason:

Each year, 300,000 Americans are hospitalized and 5,000 die from food contamination, according to a Health and Human Services Department report that was released earlier this month. While the number of food facilities has increased, the percentage of inspections has decreased, to 22 percent in fiscal year 2008 from 29 percent in 2004.

Unfortunately, he’s running up against the oldest chestnut in the book, the myth of the noble farmer. That myth allows a farm spokesman to say this without being laughed out of the room:

“The way it’s written, it essentially gives the FDA the ability to go into any farm and tell people how to run their farms, which is inappropriate,” she said.

Every restaurant in the United States, even those owned by hard-working families, is subject to this kind of “inappropriate” oversight. But farmers, unlike restaurant owners, are salt-of-the-earth, romantic figures. So, instead of having the power to close down dirty farms, the FDA has to beg noble individualists like the Peanut Corporation of America to remove their salmonella-laden peanut butter from the market.

I’d like to believe that Harkin’s effort will bear fruit, but I’m afraid that we’re so in love with our bullshit fairy tales that we’d rather eat that shit than give up our cherished illusions.
