I’m not sure House Repubs will inevitably make Jim Jordan speaker, completing their surrender to the same brand of minoritarian rule by radicals they’ve foisted off on the rest of us. The radicals have been running the place since January anyway, but of the many ambulatory poop factories in the House GOP conference, Jordan is one of the most embarrassing, and his speaker bid is unsurprisingly ham-handed.

Jordan has dispatched supporters in metaphorical singlets across social media to attempt rhetorical piledrivers on recalcitrant colleagues. Over the weekend on Jake Tapper’s show, Repub Rep. Dan Crenshaw denounced this campaign to convert fence-sitting members into supporters.

“That is the dumbest way to support Jordan, and I’m supporting Jordan. I’m going to vote for Jordan. And as somebody who wants Jim Jordan, the dumbest thing you can do is to continue pissing off those people and entrench them,” he said.

Crenshaw is a terrible lawmaker but doesn’t seem like an irretrievably stupid person. This sets him apart from the majority of Jordan backers in the conference, including my crappy rep, whose office told me is “proud” to support Jordan.

I wonder if it occurred to Crenshaw that Jordan’s campaign for speaker is a preview of how a Speaker Jordan would operate once empowered, i.e., innumeracy followed by loud, dumb bullying combined with absurd Twitter histrionics? Probably, but here we are. The latest is that Jordan will learn his fate tomorrow. Several reps who had loudly proclaimed themselves Never Jordans last week flipped to yes today, so it’s possible the rest will fall in line.

It’s hard to see how making a bellowing fool like Jordan the face of Repub power will be anything other than a disaster for House Repubs in the long run. But working with Democrats to avoid that catastrophe probably puts them in physical peril from their nutty base and possibly even some armed colleagues, so they might judge it the least-bad option. That seems most likely but no sure thing.

However, if the Repubs in Biden-won districts, potential House retirees, etc., rally to try to stave off a Jordan speakership by working with the Dems, it sounds like House Democrats will be ready, according to Greg Sargent (WaPo gift link):

First, some Democrats want to reform the “motion to vacate” rule so that a single member can’t force a snap vote to remove the speaker on a whim, which is exactly how Rep. Matt Gaetz (R-Fla.) dethroned Kevin McCarthy (R-Calif.). One idea Democrats are mulling, according to a House aide, is requiring a majority of the party in control of the House to support the motion to vacate before it can happen.

Second, Democrats are discussing the idea of a mechanism that would give them more leverage over what bills get a floor vote, even on things many Republicans oppose — such as continued Ukraine aid (likely coupled with aid to Israel), and bills funding the government at levels that many in both parties can accept…

In fact, Democrats can reasonably demand still more for helping elect a Republican speaker: Why not a permanent repeal of the debt limit, which has been used as a weapon by far-right members in the past, leading to chaotic standoffs?

“Those are absolutely the kinds of ideas we should be talking about,” says (Progressive Caucus Chair Rep. Pramila) Jayapal, though she declined to get ahead of Jeffries on the specifics of their demands. The core goal, she said, should be disabling the GOP’s “use of things that never used to be controversial to move their extreme agenda.”

In other words, Dems are considering measures to make an ungovernable legislative body capable of governing again. It seems unlikely that they’ll get that chance, but all of the scenarios in this timeline seem absurd, so who knows? If you’re unfortunate enough to be repped by a Repub, it might be worth calling them to register your dismay at the possibility of a Speaker Jordan.

Yesterday we noted that the latest GOP Speaker wannabe, Jim Jordan and his allies have shifted to mobilizing base MAGA supporters against the substantial number of holdouts who have either claimed they won’t vote for Jordan on the floor of the House or claim they will never vote for him. This morning Jordan seems to be making substantial headway. One key Republican holdout, Mike Rogers of Indiana, now says he’s on board. So does Ken Calvert, who represents a swing district in California.

Late Update: Now another, Ann Wagner (MO), has flipped. The rationale is refusal to be forced to work with Democrats to elect a Speaker. Steve Womack seems to be the only high profile NeverJim who’s holding tough. My assumption now is the Jordan probably wins this. Though we need to see more to know.

This seems pretty disastrous to me.  Sure Jordan will heighten the focus on GOP extremism, and that may well help push the House back into D hands beginning in January 2025.  But that’s fourteen and a half months away from now, and the country and the world will suffer the effects of a radical-right-led House at a time when so much hangs in the balance.

To sum up my mood…we’re getting closer to an answer to Ben Franklin’s challenge (“A republic, if you can keep it) and it ain’t coming out the way we’d hope.

Monday’s hearing in Washington, D.C., will feature the first clues on the answers to both of those questions.

Chutkan, an appointee of former President Barack Obama, has repeatedly vowed not to consider Trump’s political fortunes in her decision-making. And in fact, many criminal defendants face sharp restrictions on their ability to comment on matters connected to their cases — particularly when those comments could conceivably influence the outcome.

If Trump were to violate a potential gag order, enforcement would fall to Chutkan, who has a range of options ranging from gentle warnings to pretrial incarceration. It’s hard to imagine a scenario in which she orders the former president jailed before trial — though his rhetoric may test that premise. Still, short of detention, Chutkan could impose other restrictions, such as limits on his use of social media or access to the internet. Any consequence she were to impose on Trump would become instant grist for Trump’s attacks on the court and the justice system, a dynamic Chutkan is plainly aware of.

The former president is already subject to a narrow gag order in another case: the New York civil fraud trial of Trump and his business empire, which Trump attended earlier this month. During the proceedings, Trump posted a social media attack on Justice Arthur Engoron’s top clerk, including a picture of her and a link to her Instagram account. When Engoron learned of the post, he quickly ordered Trump to refrain from publicly commenting on his aides and staff.

It is now officially late enough into October to start planning your the Samhain cross-quarter day celebrations. (Yes, I know our major retailers put up their Halloween displays in late August, but that’s just cheap greed.)

War for Ukraine Day 599: The Primary Effort, for Now, Remains at Avdiivka

As I wrote at the start of the Israel-Hamas war update earlier, this has been a very hectic, but very good week. Frankly, I’m wiped so there won’t be another Israel-Hamas update until at least Wednesday. As such just a brief update tonight, especially given the in depth one earlier.

Everyone must do their part in defense to prevent Russian terror from stopping Ukraine this winter – address by the President

I wish you health, fellow Ukrainians!

A few important things about this day.

All day long, power engineers and rescuers have been working very actively in Kherson region and also in Donetsk region to eliminate the consequences of strikes on power facilities. In particular, there were power outages in Kherson today due to Russian bombs. Our repair crews are doing their best. As of now, Kherson has electricity and water supply restored in almost the entire city, except for ten houses in the Tavriyskyi neighborhood. As for these houses, the repair work should be completed tomorrow.

We must be aware that there will be more such Russian attacks as winter approaches – on generation facilities and the grid. We must be prepared for this. We will strengthen our air defense as much as possible in the current circumstances. And even more: we are agreeing with our partners on such defense steps that have not been used before. However, a lot will depend on the readiness of local authorities, particularly in cities, and on the preparatory work of energy companies and telecom operators. Everyone has to do their part in defense to prevent Russian terror from stopping Ukraine this winter. Just like on the battlefield, we must be as resilient and strong as possible in all areas.

The week’s schedule includes new meetings, new conversations with partners on strengthening Ukraine and our defense. We will also work to make the reconstruction process in Ukraine more active. We are also preparing new steps to ensure that in the current security situation in the world, attention to Ukraine is maintained at a sufficient level.

Ukrainian diplomats, intelligence, and security forces continue to work to help our citizens who have found themselves in the Middle East: in Israel and the Gaza Strip.

The evacuation of Ukrainians from Israel continues: more than 200 people have already been taken to Romania, mostly women and children. New flights are being prepared. We know about almost 260 Ukrainians who are currently in the Gaza Strip. Currently, the exit from Gaza is blocked for citizens of all countries, but we are working with our partners to evacuate our citizens. Ukrainian diplomats are ready to help every citizen who needs it. Therefore, I once again appeal to all Ukrainians who may be abroad and need help: please contact our diplomatic missions abroad at any time and in any way.

And one more thing. Every day our cities, villages in the regions bordering Russia and along the front line are subjected to terrorist attacks by the occupier. And every day, our people receive help there, which is very important. No matter what happens, Ukrainians take care of each other, and the state remains functional. Ukraine cannot be defeated because our people cannot be defeated.

Please support and thank everyone who works for the sake of people, who protects lives. Our rescuers, doctors, nurses, volunteers, police officers, utility workers, power engineers – those without whom there would be no normal life. Everyone is important. Everyone deserves gratitude.

The Israel-Hamas War Update: 15 October 2023

Sorry this is long overdue, but it’s been quite the week and weekend. All very positive for me, but it has chewed up a lot of time and I have at least two more very hectic ones ahead of me. But I do want to get a quick update in and touch on a couple of items.

The first is a reiteration of what I started last night’s Ukraine war update with:

First, there are no winners among the Palestinians from Hamas’s attack last Saturday, nor will there be any winners among Israelis from Israel’s response. I’ll get into this more tomorrow, but for all intents and purposes Hamas’s attack was a PSYACT. A PSYACT is a form of psychological operation often using a physical real world activity intended to produce a real world result or elicit a specific real world response. If you remember back to my post after the 2015 ISIS attack on St. Michael outside Paris, the intention of the attack wasn’t just to kill and main and injure and terrify a lot of people. Rather it was to make the French and their western allies overreact in their response creating a French versus Muslims and Islam response. At the same time it was intended to force French Muslims to choose between being French or being Muslim. To collapse the civic space and force them to pick a side. Hamas’s attack was similarly intended even if the initial and most visible effects were the killing and the hostage taking. And this is part of the reason that there will be no actual Palestinian or Israeli winners regardless how this ultimately resolves.

Second, we need to make sure we do not conflate all Israelis with the Netanyahu governments that have run the country for 13 of the last 15 years, just as we must do the same thing in separating the Gazans from Hamas. Remember, back in 2010 Bibi stole the premiership. Likud came in 2nd in those elections. However, while Tzipi Livni, whose party had the largest number of members of Knesset elected, was assembling her coalition, Bibi simply ignored Israeli law, assembled his own, declared a government, and dared anyone to stop him or reverse his action. No one did. From there the opposition kept splintering while Bibi enabled and empowered ever more extreme elements to form coalition governments from what was often the barest of majorities all while running caretaker governments when they splintered and fell apart. At the same time, because of a stupid decision by the Bush 43 administration convinced that elections equal democracy, enabled by Bibi who wanted to build up Hamas as a foil to Fatah and the Palestine Authority in order to prevent a 2 state peace process from ever being implemented, Hamas won the only election in Gaza in 2006. There has never been another election. And yes, technically both Israelis and Palestinians could’ve revolted and overthrown Bibi or Hamas respectively. But actually doing it is a lot harder said than done.

Third, we need to make sure not to conflate Jews and Israelis and Judaism with Zionism, as well as Palestinians with Hamas and Hamas with Islam. These are not interchangeable concepts. Do not make them so.

So let’s jump right in. Last night I referenced that Hamas’s attack was a PSYACT, which is defined in Army Field Manual (FM) 3-05.30 / Marine Corps reference Publication (MCRP) 3-40.6, Psychological Operations as:

a psychological operations action (PSYACT) as “an action conducted by non-PSYOP personnel, that is planned primarily to affect the behavior of a TA [target audience].”

In this case Hamas attacked, killed, and took hostage/prisoner significant numbers of Israelis. The attackers were not PSYOPers. The behavior that Hamas wished to illicit from the Israelis was to create such an overwhelming sense of fear, terror, anger, and grief that Israel’s government – Bibi’s coalition – would respond in such an indiscriminate manner that credible accusations of violations of international humanitarian law (IHL), war crimes, and crimes against humanity could be leveled against the Israelis.

Let’s define a few terms here. International humanitarian law here refers to the requirement that Israel manage their response in order to reduce and mitigate harm to the civilian population of Gaza. Here’s the link to the International Red Cross’s NOV 2021 handbook on how to do this in regard to an urban population. And you don’t get a much more urban population than the 2 million or so Palestinians in the Gaza strip. From the handbook:

This handbook guides us through the main applicable frameworks of international humanitarian law (IHL) in urban settings and assembles recommendations for commanders around topics as:

  • Urban warfare doctrine, highlighting the protection of civilians as a key element of urban operations, while weighting alongside mission accomplishments and force protection within the limits of the laws of armed conflict (LOAC);
  • Specific and realistic urban warfare training prior to operations, including the emphasis on practical application of LOAC by junior commanders;
  • Planning of urban operations that considers human terrain and infrastructure in detail, not only as they might impact the battle but in terms of the impact of the fighting on them as well – including the priority of options to avoid and, or, mitigate civilian harm;
  • Conduct whilst always operating within LOAC obligations, meaning commanders should favor means and methods which first avoid and, if not possible, mitigate civilian harm;
  • Finally, the handbook also addresses partnered operations, and annexes to assist in the planning of evacuations and screenings of those people leaving an urban area.

They also produced an AUG 2023 handbook for armed resistance groups in urban environments, in case you’re curious what Hamas’s responsibilities might be:

Based on engagement with armed groups around the world and extensive analysis of their practice, the handbook focuses on practical measures in doctrine, training, equipment, planning and conduct of hostilities that mitigate civilian harm in urban warfare, in accordance with international humanitarian law (IHL) and other relevant norms.

Recommendations cover command responsibilities and operational guidance, the collection of accurate information, consideration of the civilian environment in planning of an attack, how to conduct a lawful urban operation, as well as activities and behaviors to adopt once the hostilities have ended and best training practices in IHL education, tactics, weapon handling and equipment.

The handbook also spells out the responsibilities of commanders, fighters and those supporting them, their legal obligation and the benefits to comply with IHL, even if the enemy or other groups and forces do not.

All of what is happening is separate from whether the Palestinians under occupation by the Israelis, as well as being ruled by Hamas in an authoritarian political Islam based system of governance, have a justification to revolt and seek their freedom. In the Western ethical norms for war and warfare, this discussion would be framed under Just Revolution Theory. Basically, Just Revolution Theory provides two justifications for when it is ethically appropriate to revolt. The first is when a population is being tyrannized and discriminated against by their government. It does not matter here if the population is a majority or minority of the overall population within the state and society. The second is when a population is under attack and being discriminated against by another group or groups within the same state and society and the government refuses to protect the former from the latter. While this is, of course, a western conception of ethics justifying a revolution, I don’t think many would disagree that should the Palestinians choose to undertake an actual third intifadeh, that it would be covered under the first criteria, if not by both. And that both the Israeli government, which is the formally recognized occupation authority, and Hamas, which won a single election in 2006 and has been running Gaza ever since, both fit under the government/state in this conceptualization.

What Hamas did last week, however, is not something covered under Just Revolution Theory. Trying to shoe horn Hamas’s attack, which was likely successful beyond Hamas’s planners’ and leadership’s imagination, under Just Revolution Theory is just a waste of intellectual time and energy. It isn’t even covered under the Islamic concept of jihad as a response to aggression that has conditions. From my JAN (winter) 2002 article on this topic:

Murtada Mutahhari posits that while war can be aggressive, jihad is a response to aggression that has conditions. The conditions are that the adversary must be in a state of aggression towards an Islamic community and/or that the adversary is unjustly oppressing some group, either Muslim or non-Muslim. Furthermore, jihad encompasses the defense of life, property, wealth, land, independence, and principles. The most valuable form of jihad is not in defense of oneself, but rather in defense of humanity and human rights. Congressman Mast DID not serve in the IDF. But bubbling beneath the surface of Israel’s political crisis is another concern: shared U.S.-Israel security interests.

As Israeli reservists pledge to boycott call-ups in protest of the controversial judicial reform legislation, experts say Israel’s enemies could see opportunity — and that the Biden administration is worried. Gen. Mark Milley, the chair of the Joint Chiefs of Staff, is headed to Israel next week to check in on the Israeli military, reports claimed on Wednesday.

“The United States has lots of partners in the Middle East, but Israel is by far its closest and strongest partner in the Middle East,” said Shira Efron, the senior director of policy research at the Israel Policy Forum, a group that advocates for a two-state outcome to the conflict. “If Israel’s capabilities and its readiness is affected, the United States loses capabilities in the Middle East.”

The Biden administration said it was “deeply concerned” by the firing. An early version of the National Security Council statement, released to the Times of Israel, read: “We are deeply concerned by the ongoing developments in Israel, including the potential impact on military readiness raised by Minister Gallant.”

The NSC removed the phrase about military readiness from later versions of the statement — NSC spokesmen never answered questions as to why — and Netanyahu rescinded his firing of Gallant.

But even as Gallant remains in place, deep questions remain about the degree to which Israel’s searing political divide have weakened its vaunted military and intelligence apparatuses. Netanyahu — and even his son Yair, on social media — has clashed with top military brass, and reports claim the prime minister aims to shake up parts of the army’s chain of command.

Netanyahu has batted down concerns, saying that the changes to the courts that have passed are minor and that he is no longer committed to other parts of the proposed rehaul his government rolled out in January. His opponents don’t believe him and continue to flood the streets at least once a week in massive protests.
