Balloon Juice

Come for the politics, stay for the snark.

Yeah, with this crowd one never knows.

Never entrust democracy to any process that requires republicans to act in good faith.

Putting aside our relentless self-interest because the moral imperative is crystal clear.

I see no possible difficulties whatsoever with this fool-proof plan.

Authoritarian republicans are opposed to freedom for the rest of us.

I know this must be bad for Joe Biden, I just don’t know how.

Not so fun when the rabbit gets the gun, is it?

Black Jesus loves a paper trail.

I really should read my own blog.

Technically true, but collectively nonsense

A Senator Walker would be an insult to the state and the nation.

“More of this”, i said to the dog.

The party of Reagan has become the party of Putin.

If you’re pissed about Biden’s speech, he was talking about you.

The words do not have to be perfect.

Make the republican party small enough to drown in a bathtub.

So it was an October Surprise A Day, like an Advent calendar but for crime.

John Fetterman: Too Manly for Pennsylvania.  Paid for by the Oz for Senator campaign.

Tick tock motherfuckers!

I did not have telepathic declassification on my 2022 bingo card.

Conservatism: there are some people the law protects but does not bind and others who the law binds but does not protect.

Russian mouthpiece, go fuck yourself.

Fuck the extremist election deniers. What’s money for if not for keeping them out of office?

Speaking of republicans, is there a way for a political party to declare intellectual bankruptcy?

The Office of the Director of National Intelligence Has Released Its 2020 Election Assessment & the Executive Summary of Its 2021 Domestic Violent Extremism Assessment

by Adam L Silverman|  March 18, 20217:38 pm| 73 Comments

This post is in: 2020 Elections, America, Ammosexuals, China, Crazification Factor, Domestic Politics, domestic terrorists, DPRK, Election 2016, Foreign Affairs, Information Warfare, Iran, Open Threads, Politics, Russia, Silverman on Security

I had originally planned on covering the Office of the Director of National Intelligence’s (ODNI) assessment of Foreign Threats To the 2020 US Federal Elections on Tuesday night, but decided we needed something on the then just happened domestic terrorist attack in Atlanta. Yesterday, ODNI also released the executive summary from a recently completed threat assessment into domestic violent extremism. Given that the two assessments overlap in a key finding, I’ve decided to basically deal with them in one post. Especially because the assessment on foreign threats to the 2020 elections basically tracks with everything we covered here between my Black PSYOP series of posts beginning in October 2019 and Cheryl’s posts on the topic here and at her Nuclear Diner. In other words, between Cheryl and I, you all were getting pretty close to the same assessment that ODNI has put together. On behalf of Cheryl: we demand a raise!!!!

You can click across and read the whole assessment for yourself, but here’s the key findings:

The Office of the Director of National Intelligence Has Released Its 2020 Election Assessment & the Executive Summary of Its 2021 Domestic Violent Extremism Assessment

You’ll notice that Key Judgement’s 2, 3, and 4 all track with what we’ve been discussing here since October 2019. In the Black PSYOP 1 and 2 posts we covered what misinformation and agitprop was being laundered, by whom, and why. Including this lovely little item dated May 2014, which I misdated to April 2014 in the post:

Anyone surprised by these findings, such as self declared information warfare expert Thomas Rid, quite simply, didn’t want to know about them because they had their own agendas. Specifically downplaying that anything that has actually been happening since at least 2014 if not 2011 in terms of Russian information warfare was actually happening. He’s suddenly surprised because he’s spent the past several years writing, publishing, and defending a book on information warfare that essentially denies it is actually occurring.

We also covered what Rudy Giuliani, Chanel Rian, and OAN News were doing to mule this Russian misinformation and agitprop to Trump, his surrogates in the House and the Senate, in the conservative movement, and in the conservative news media. As well as what Senators Johnson, Grassley, and Graham were doing with that material in the Black PSYOP Part X. And while it was reported at the time, in July 2020, we now have confirmation directly from Democratic members of Congress that Congressman Nunes received this fabricated material directly from Andreii Derkach. As in the Democrats actually have the delivery receipt!

The executive summary of the ODNI’s report on domestic violent extremism brings us to the overlap. Here are the findings:

(U) The IC assesses that domestic violent extremists (DVEs) who are motivated by a range of ideologies and galvanized by recent political and societal events in the United States pose an elevated threat to the Homeland in 2021. Enduring DVE motivations pertaining to biases against minority populations and perceived government overreach will almost certainly continue to drive DVE radicalization and mobilization to violence. Newer sociopolitical developments—such as narratives of fraud in the recent general election, the emboldening impact of the violent breach of the US Capitol, conditions related to the COVID-19 pandemic, and conspiracy theories promoting violence—will almost certainly spur some DVEs to try to engage in violence this year.

(U) The IC assesses that lone offenders or small cells of DVEs adhering to a diverse set of violent extremist ideologies are more likely to carry out violent attacks in the Homeland than organizations that allegedly advocate a DVE ideology. DVE attackers often radicalize independently by consuming violent extremist material online and mobilize without direction from a violent extremist organization, making detection and disruption difficult.

(U) The IC assesses that racially or ethnically motivated violent extremists (RMVEs) and militia violent extremists (MVEs) present the most lethal DVE threats, with RMVEs most likely to conduct mass-casualty attacks against civilians and MVEs typically targeting law enforcement and government personnel and facilities. The IC assesses that the MVE threat increased last year and that it will almost certainly continue to be elevated throughout 2021 because of contentious sociopolitical factors that motivate MVEs to commit violence.

(U) The IC assesses that US RMVEs who promote the superiority of the white race are the DVE actors with the most persistent and concerning transnational connections because individuals with similar ideological beliefs exist outside of the United States and these RMVEs frequently communicate with and seek to influence each other. We assess that a small number of US RMVEs have traveled abroad to network with like-minded individuals.

(U) The IC assesses that DVEs exploit a variety of popular social media platforms, smaller websites with targeted audiences, and encrypted chat applications to recruit new adherents, plan and rally support for in- person actions, and disseminate materials that contribute to radicalization and mobilization to violence.

(U) The IC assesses that several factors could increase the likelihood or lethality of DVE attacks in 2021 and beyond, including escalating support from persons in the United States or abroad, growing perceptions of government overreach related to legal or policy changes and disruptions, and high-profile attacks spurring follow-on attacks and innovations in targeting and attack tactics.

(U) DVE lone offenders will continue to pose significant detection and disruption challenges because of their capacity for independent radicalization to violence, ability to mobilize discretely, and access to firearms.

And it is the last sentence of Key Judgement 2 regarding US officials and prominent Americans promoting the Russian misinformation and agitprop against Biden that was key to Putin’s efforts to effect the 2020 election outcome and the final sentence of the first finding on domestic violent extremism –  narratives of fraud about the election, calling “patriots” and “real” American to the Capitol to stop the certification of the Electoral College votes, use of racial slurs when referring to COVID-19, etc – overlap. Because we’ve seen the same US officials and prominent Americans within the conservative movement and conservative news media promote Putin’s misinformation and agitprop and promote the conspiracy theories about the election being stolen, calling “patriots” and “real” Americans to action to do something about it, and using racial slurs to refer to COVID-19. Additionally, as in Key Judgement 2 and the fourth finding on domestic violent extremism, we see the connection to foreign actors promoting, facilitating, and encouraging Americans to act on either Russia’s misinformation and agitprop, a variety of conspiracy theories, and white Christian supremacy. It is well documented that the Russians have funded, supported, and manipulated American white supremacists, Christian supremacists, and anti-government extremists.

Do take the time to read both documents, neither is very long, and you’ll get both a real solid understanding of how the Intelligence Community understands these problem sets and an appreciation for having professional, mature leadership running the US Intelligence Community.

Revisiting November 2016 predictions

by David Anderson|  January 18, 20218:42 am| 151 Comments

This post is in: Anderson On Health Insurance, Election 2016, Politics, Trump Crime Cartel

Now that this error is almost over, I think it is time to revisit predictions from November 2016.

TLDR: We’re fucked hard and good

Yep!

I expect the Supreme Court to be a 5-4 reactionary majority on voter rights. I would not be shocked if there is a bill filed to expand the court to 11 or 13 Justices filed and floating around as a sword of Damocles to threaten Kennedy to vote for anything coming off of the Susan B. Anthony fund’s wishlist. I expect the filibuster to be gone by lunchtime on the first day of the new Congress.

Yes, there is a reactionary majority on voting rights and it looks to be durable. Susan B. Anthony List wishlist will be fulfilled but through a different mechanism than I thought. The filibuster is still limping along.

I would give myself a 1.5 out of 3

I expect the Republican Party to use their position of concentrated minorities against a dispersed majority to do as much as they can to lock in as much of a partisan tilt as possible. Packing the courts is the big one as the Democrats have majorities on most of the Appeals circuits right now. Getting to Republican majorities via packing in 40 something Federalist society drones is extraordinarily efficient as that can only be altered quickly if the Democrats can get a trifecta and they re-pack. It’s nasty but efficient.

Yep! 1 for 1

We’re going to see massive mistakes of basic execution (and many executions that should not occur even if one supports the death penalty) as competence does not matter. We will be governed by the Brietbart comments section. Any policy (even if it is a good one) that is more complex than allowing contributors to use the commons as a waste dump or passing out large checks to the already comfortable or beating up on liberals/Democrats/Other will get fucked up. Deep Water Horizon in the Trump Administration would still be leaking.

Yep, significantly more federal executions. Significantly more use of the commons as a dumping ground and upward redistribution of wealth. I under-estimated the clusterfuckedness of incompetency and inattention when it came to COVID.

3 for 3

We are going to be in caveat emptor low trust/high verification cost world as fidicuary duty obligations disappear, as the CFPB disappears and Dodd-Frank unwinds.

I was wrong on Dodd Frank —its sails got trimmed by regulation but not much by law.

1 for 2

We’re going to see any larger opioid outbreaks in rural counties as Medicaid funded drug treatment will be harder.

We’re going to see a lot of counties that voted for Trump continue to get kicked in the balls economically.

We’re going to lose a lot of people that have options to go elsewhere in the world. Immigrants with an education will find other places to go.

3 for 3

A lot of what has happened was predictable as it was predicted.

51 more hours of this error.

The DNI/FBI Announcement On Election Interference: Before Anyone Asks, I Really Have No Idea

by Adam L Silverman|  October 21, 20209:04 pm| 197 Comments

This post is in: 2020 Elections, America, Domestic Politics, Election 2016, Foreign Affairs, Information Warfare, Iran, Open Threads, Politics, Russia, Silverman on Security

Not that I don’t appreciate getting texts and emails asking me about breaking news… So let me just start with: I have no idea.

I watched the press conference, I’ve read The Washington Post‘s reporting on this, and I’m basically like, (except with much more facial hair):

The DNI/FBI Announcement On Election Interference: Before Anyone Asks, I Really Have No Idea

The Washington Post provides us what I think are the important details:

The technical data embedded in the emails did not make immediately apparent who was behind the messages. But metadata gathered from dozens of the emails pointed to the use of servers in Saudi Arabia, Estonia, Singapore and the United Arab Emirates, according to numerous analysts.

The hosting service that previously carried the Proud Boys domain canceled the registration after Google Cloud notified the customer that a nonprofit group had raised concerns about the controversial organization, said Ladd, the Google Cloud spokesman.

Following the action from the hosting service, the domain appears to have been left unsecured, allowing anyone on the Internet to take control of it and use it to send out the menacing messages, said Trevor Davis, CEO of CounterAction, a Washington-based digital intelligence firm.

I have no idea what other, corroborating information that the CIA, NSA, Cybersecurity and Infrastructure Security Agency (CISA, which is part of DHS), National Counterintelligence and Security Center (NSCS, which is part of ODNI), and the National Security Division at the FBI have, but this doesn’t scream Iran to me. Could it be Iran? Sure. Can I say it is or isn’t definitively based on what I know about how Iran behaves after working on issues dealing with Iran for the Army and DOD for over a decade? I can’t. With this information I could just as easily make an argument that this is an Emirati Crown Price Mohammad bin Zayed and Saudi Crown Prince Mohammed bin Salman effort intended to make Iran look bad, which is a fair amount of the attempted covert and clandestine efforts made by the Emiratis and the Saudis. The whole point of the recent agreements between Israel and the UAE, Israel and Bahrain*, and attempt to get agreements between Israel and Saudi Arabia are really attempts to formalize and make overt the decades long covert and clandestine relations that these states have had with Israel in order to establish an anti-Iranian regional alliance.

Part of the problem here is that DNI Ratcliffe has no credibility. Especially as I’m not sure anyone who isn’t a partisan would classify emails like the one below as being anti-Trump.

The DNI/FBI Announcement On Election Interference: Before Anyone Asks, I Really Have No Idea 2

My read of the email above is an attempt to deactivate Biden voters through intimidation. And based on what was said, I’m not even sure these were the emails that DNI Ratcliffe was referring to.

This leads to my other concern here, especially given what Ratcliffe said and what FBI Director Wray did not. DNI Ratcliffe stated that the intelligence points to Iran and Russia, and that in the case of Iran he generically referenced intimidatory emails and then specifically stated that these Iranian efforts are intended to harm the President’s reelection chances. He provided no details regarding whatever Russia is doing. Director Wray said nothing specific at all; he just provided a general warning that both Iran and Russia are actively trying to disrupt the election and that the US government has thwarted one such attempt.

DNI Ratcliffe is both highly partisan and highly unqualified for the position he is currently serving in. My worry is that by making the statements that he did, and rushing to do them tonight before 8 PM EDT, he has provided the President with talking points for his rally tonight. Something the President can pitch to the rally goers as “Did you hear what Director of National Intelligence Ratcliffe – great man, great man – said earlier tonight? He said the Iranians are interfering in the election to get Sleepy Joe elected. Can you believe that? Can you? It’s true, it’s true!”

Frankly what was presented by DNI Ratcliffe was very thin and very concerning because it was very thin. The more generic statements of Director Wray was better largely because he didn’t provide just enough details to make people question the integrity of what was being briefed.

I want to make one final point. What Director Wray told Americans tonight was what should have been announced back in August, September, and/or October 2016 in regard to what Russia was doing in 2016. The Obama administration wanted to do it, but decided it also wanted bipartisan buy-in, so the President pitched it to both the Democratic and Republican leadership in Congress. Senator McConnell killed it by threatening to use any announcement, no matter how appropriate and how non-partisan, as a weapon to politically attack both President Obama and Secretary Clinton. My issues and concerns here are not that a press conference to warm Americans about foreign election interference was done. My issues and concerns of the lack of specificity except in regard to one statement from DNI Ratcliffe that the interference was intended to harm the President and his reelection chances and the need to do this tonight before 8 PM when there’s nothing that couldn’t have waited till 9 AM tomorrow morning.

We are off the looking glass and through the map!

* Just earlier today we learned that Israel has been running a clandestine embassy in Bahrain that was being presented as a development corporation. This reporting raises the questions of 1) how many other Gulf States has Israel done this in, 2) how many US companies, defense or non-defense sector, have been compromised by doing business with companies that are secret Israeli embassies that only Israel and the host country know are fronts, and 3) how much US intellectual property, especially critical for US national security, wound up being stolen as a result?

The Presidency of the United States Has Been Penetrated By Russian Intelligence: The US Intelligence Community Determined That Rudy Giuliani Was the Target of Russian Intelligence To Use Him To Influence The President & the President Was Informed of That Finding In December 2019!

Rudy Giuliani: a noun, a verb, a useless idiot!

At 7:15 PM tonight, The Washington Post reported (emphasis mine):

U.S. intelligence agencies warned the White House last year that President Trump’s personal lawyer Rudolph W. Giuliani was the target of an influence operation by Russian intelligence, according to four former officials familiar with the matter.

The warnings were based on multiple sources, including intercepted communications, that showed Giuliani was interacting with people tied to Russian intelligence during a December 2019 trip to Ukraine, where he was gathering information that he thought would expose corrupt acts by former vice president Joe Biden and his son Hunter.

The intelligence raised concerns that Giuliani was being used to feed Russian misinformation to the president, the former officials said, speaking on the condition of anonymity to discuss sensitive information and conversations.

The warnings to the White House, which have not been previously reported, led national security adviser Robert O’Brien to caution Trump in a private conversation that any information Giuliani brought back from Ukraine should be considered contaminated by Russia, one of the former officials said.

The message was, “Do what you want to do, but your friend Rudy has been worked by Russian assets in Ukraine,” this person said. Officials wanted “to protect the president from coming out and saying something stupid,” particularly since he was facing impeachment over his own efforts to strong-arm Ukraine’s president into investigating the Bidens.

But O’Brien emerged from the meeting uncertain whether he had gotten through to the president. Trump had “shrugged his shoulders” at O’Brien’s warning, the former official said, and dismissed concern about his lawyer’s activities by saying, “That’s Rudy.”

Giuliani visited the White House on Dec. 13, shortly after the House Judiciary Committee voted to proceed with articles of impeachment, and he met with Trump at the president’s resort in Florida eight days later.

Officials’ warnings about Giuliani underscore the concern in the U.S. intelligence community that Russia not only is seeking to reprise the disinformation campaign it waged in 2016, but also may now be aided, unwittingly or otherwise, by individuals close to the president. Those warnings have gained fresh urgency in recent days. The information that Giuliani sought in Ukraine is similar to what is contained in emails and other correspondence published this week by the New York Post, which the paper said came from the laptop of Hunter Biden and were provided by Giuliani and Stephen K. Bannon, Trump’s former top political adviser at the White House.

The Washington Post was unable to verify the authenticity of the alleged communications, which concern Hunter Biden’s business dealings in Ukraine and China.

The former officials said Giuliani was not a target of U.S. surveillance while in Ukraine but was dealing with suspected Russian assets who were, leading to the capture of some of his communications.

Much more at the link!

I’ve been waiting to post on Giuliani’s latest disinformation and agitprop attempt because it was clear something else was going to break. As I tracked the reporting and looked at the materials, I thought it was simply going to be the shifting stories by both the computer repair store owner and Giuliani. Such as Rudy producing paperwork earlier today with Hunter Biden’s signature indicating that if the laptop or laptops were not picked up within 90 days, then they were forfeit to the repair store because he realized the initial story of how he came into possession of the laptops, laptop, and/or hard drive implicated the computer repair story owner and Giuliani in a number of potential crimes.

Or that Rudy was shopping pdfs with metadata indicating that they were created in September and October 2019 months after the laptop or laptops or hard drive were dropped off for repair, not actual emails with the email metadata, but pdfs of emails that he was promoting in October 2019 that have the same disinformation and agitprop just like he supposedly recovered from the abandoned laptop, laptops, and/or hard drives.

Or the fact that they can’t keep the story straight on it being three laptops or a laptop and a hard drive.

Or maybe that someone fed the chan/reddit boards several days ago that this story was coming and did so to signal to the white supremacists and neo-NAZIs by including “88”* in the nym the person was using.

It has been clear for a long time that Rudy was being used by Russian intelligence officers and assets. I’ve written an entire series of posts delineating this in excruciating details over the past year. But what we did not know, though it was a logical suspicion to have, that the US Intelligence Community had signals intelligence (SIGINT) from communications intercepts of Russian assets that clearly indicated this unfortunate reality. We also did not know that they had done their jobs and pushed their assessment up the chain to the Assistant to the President for National Security (AP-NSA) O’Brien, that O’Brien had briefed the President, and that the President blew him off!

We also did not know that the US Intelligence Community had assessed, had briefed up the chain to O’Brien, and that O’Brien then briefed the President to warn him off of Giuliani and the disinformation and agitprop Rudy was pushing as the centerpiece of the President’s defense in his impeachment trial in the Senate! This was, of course part of the plan to turn both chambers of the US Congress into an information laundry for the Russian disinformation and agitprop Rudy was being used to promote, which was then repeated during the hearings Senators Johnson and Grassley held this past August and September.

Giuliani is the poster child for MICE: Money, Ideology, Compromise, Ego. Giuliani has been caught on voicemails by reporters, voicemails that resulted from butt dialing on one phone while talking on another because he’s an OPSEC and INFOSEC disaster, seeking hundreds of thousands of dollars in payoffs for providing various undisclosed services for Deity knows whom. So that checks the Money box. His enormous self regard and desire to be relevant and in the spotlight and important is legendary and checks the Ego box. And these together, combined with his terrible Operational Security and Information Security practices make him a collection target for anyone and everyone trying to collect information on the President, check the Compromise box. Given his well documented infidelities, it would not surprise me at all to find out that there is other compromising material on him out there. No one should be shocked to have their suspicions about Giuliani formally confirmed by the US Intelligence Community.

The result of Giuliani’s stupidity and gullibility and outsized belief that he’s some sort of genius high speed, low drag intelligence, diplomatic, and law enforcement operator is that he has compromised the President of the United States. He has allowed the Russians to penetrate, via a human asset close to the President, the presidency of the United States. During World War II, the USSR was able to penetrate the presidency of the United States by getting people close to FDR – Harry Dexter White, an Assistant Secretary of the Treasury and confidant of FDR’s and Laughlin Currie, a friend and legal advisor to FDR – to steal national secrets and pass them along. Their successor agencies in today’s Russia have found their modern Laughlin Currie in Rudy Giuliani, a friend and legal advisor to the current President of the United States.

We are off the looking glass and through the map!

Updated at 9:35 PM EDT

That didn’t take long and it is exactly what I expected was going to happen. Rudy has finally gotten himself into some serious trouble!

NBC: Federal investigators are examining whether the emails allegedly describing activities by Joe Biden and his son Hunter and found on a laptop at a Delaware repair shop are linked to a foreign intelligence operation. https://t.co/lVMdCYLdvE

Wait, what?

About a week ago the President tweeted out a broad and sweeping declassification order as part of his own active measures and influence campaign to swing the 2020 election by claiming that President Obama, Vice President Biden, FBI Director Comey, DCI Brennan, DNI Clapper, AP-NSA Rice all working in conjunction with Secretary Clinton and her campaign, the Democratic National Committee, and the government of Ukraine conspired to undermine the President’s election by fabricating that Russia was actively trying to assist his campaign in 2016, that he and his campaign were actively trying to recruit Russia to help them, and to cover up the real conspiracy between Secretary Clinton and the Ukrainians. As I’ve written about before, this is all Russian disinformation and agitprop.

It Is the Official Policy of the United States That What the Current President Says Is Not The Official Policy of the United States

This Russian misinformation and agitprop was most recently laundered by DNI Ratcliffe to and through Senators Johnson and Grassley in his selective declassification and release of former DCI Brennan’s memos.

A number of reporters who have been seeking to have redacted and/or classified materials from the various Russia-Trump campaign 2016 investigations released through the Freedom of Information Act (FOIA) immediately filed emergency requests in Federal court to have all of this now seemingly declassified material released right away. Today the Department of Justice submitted their response:

THE PRESIDENT'S STATEMENTS ON TWITTER DID NOT DECLASSIFY ANY INFORMATION–DOJ pic.twitter.com/p7Yp4gtlEk

Debunking the US Attorney From the Middle District of Pennsylvania’s Disinformation Campaign

Yesterday conservative news, social, and digital media, as well as the President’s campaign went into freakout mode because the US Attorney (USAO) for the Middle District of Pennsylvania, David Freed, issued a statement that nine absentee ballots submitted by members of the US military voting for the President had been first lost and discarded and then discovered by election officials in Luzerne County, PA. It didn’t take long for that statement to be withdrawn; the actually pulled it off of the DOJ website. Then a revised statement was issued and finally a final revised statement was posted (emphasis mine).

FOR IMMEDIATE RELEASE                                                                Thursday, September 24, 2020

Letter to Luzerne County Bureau of Elections

Shelby Watchilla, Director of Elections of Luzerne County Bureau of Elections

Dear Ms. Watchilla:

On Monday, September 21, 2020, at the request of Luzerne County District Attorney Stefanie Salavantis, the Office of the United States Attorney along with the Federal Bureau of Investigation, Scranton Resident Agency, began an inquiry into reports of potential issues with a small number of mail-in ballots at the Luzerne County Board of Elections.

Since Monday, FBI personnel have conducted numerous interviews and recovered and reviewed certain physical evidence.  While at this point the inquiry remains active, based on the limited amount of time before the general election and the vital public importance of these issues, I will detail the investigators’ initial findings.

The FBI has recovered a number of documents relating to military ballots that had been improperly opened by your elections staff, and had the ballots removed and discarded, or removed and placed separately from the envelope containing confidential voter information and attestation.  Specifically, a total of nine (9) military ballots were discovered to have been discarded.  Seven (7) of those ballots when discovered by investigators were outside of any envelope.  Those ballots were all cast for presidential candidate Donald Trump.  One (1) of those seven (7) ballots was able to be identified to an envelope that was recovered, and thereby potentially tied to a specific voter. Two (2) military ballots that had been discarded were previously recovered by elections staff, reinserted into what appeared to be their appropriate envelopes, and then resealed.  Therefore, the votes cast on those two (2) ballots are unknown.  Thus, is appears that three (3) of the nine (9) recovered ballots can be potentially attributed to specific voters.  Six (6) of the ballots were simply removed and discarded, and cannot be attributed to a specific voter at this time.

In addition to the military ballots and envelopes that were discarded and recovered as detailed above, investigators recovered four (4) apparently official, bar-coded, absentee ballot envelopes that were empty. Two (2) of those envelopes had the completed attestations and signatures on the reverse side.  One (1) envelope with a handwritten return address was blank on the reverse side.  The fourth empty envelope contains basic location information and the words “affirmation enclosed” on the reverse side.  The majority of the recovered materials were found in an outside dumpster.

As you know, the appropriate method for processing received military ballots is to securely store the ballot, unopened, until such time as ballot pre-canvassing can begin, which is in no event earlier than 7:00 a.m. on Election Day.  Opening a military or overseas ballot, or an absentee or mail-in ballot for that matter, violates the controlling statutes and is contrary to Pennsylvania Department of State guidance.  The preliminary findings of this inquiry are troubling and the Luzerne County Bureau of Elections must comply with all applicable state and federal election laws and guidance to ensure that all votes—regardless of party—are counted to ensure an accurate election count.   Even though your staff has made some attempts to reconstitute certain of the improperly opened ballots, there is no guarantee that any of these votes will be counted in the general election.  In addition, our investigation has revealed that all or nearly all envelopes received in the elections office were opened as a matter of course.  It was explained to investigators the envelopes used for official overseas, military, absentee and mail-in ballot requests are so similar, that the staff believed that adhering to the protocol of preserving envelopes unopened would cause them to miss such ballot requests.  Our interviews further revealed that this issue was a problem in the primary election–therefore a known issue–and that the problem has not been corrected.

While the assigned investigators are continuing their work including reviewing additional discarded materials, it is imperative that the issues identified be corrected.  District Attorney Salavantis and I would be happy to meet with you at a mutually convenient time to discuss this matter. Please be assured that the investigators will carefully preserve all documents collected in connection with this investigation.  Our goal, that I am sure you share, is to ensure that every properly cast ballot is counted.

Sincerely,

DAVID J. FREED

UNITED STATES ATTORNEY

This wasn’t some sort of criminal conspiracy, but human error. Specifically good faith human error caused by the Luzerne County officials wanting to ensure that these members of the military did actually get absentee ballots during the primary. That’s right, these aren’t general election ballots, they were for the primary. That doesn’t make it right, but it means that no one has stolen nine votes from the President’s tally in Pennsylvania for the general election. Frankly, that human error was created because of the confusion that Pennsylvania Republican officials, members of the President’s campaign, and the campaign and RNC attorneys, and the GOP majority on the Pennsylvania Supreme Court have created by constantly taking every good faith attempt to ensure a safe and fair election during the pandemic to court.

Here’s what the Pennsylvania election website says about these Special Write-In Absentee ballots:

What actually happened, which is nothing really out of the ordinary expect some Luzerne County election officials opened envelopes as it was unclear what was in them because they weren’t sent back in the Pennsylvania Supreme Court mandated security envelopes. This led the county officials to think they were absentee ballot requests, not the Special Write-In Absentee Ballots that Pennsylvania sends to military voters before they finish printing the actual primary and general election absentee ballots.

Yup. From the latest DOJ statement, it seems like:

9 military voters sent write-in absentee ballots to Luzerne.

Because these letters weren't in SC-mandated privacy envelopes, Luzerne officials thought they were *requests* for absentee ballots. They opened them, spoiling them. https://t.co/WsAJw9gBg1

The whole thing is AG Barr’s USAO in Harrisburg trying to make something out of nothing because AG Barr knows that the initial reporting is all that matters, not the corrections. By now everyone who watches Fox News, listens to right wing talk radio, follows the President, his campaign spokespeople, and his other surrogates in social media, and get their news from conservative news and digital news sites, as well as from closed information silos on Facebook, believe that Pennsylvania election officials are trying to steal the election from the President. And this is part of the Democratic plot to use mail in ballots to steal the election. None of that is true, it was just a good faith error caused by confusing requirements and instructions imposed by multiple Pennsylvania state authorities.

That’s the play with this sort of thing. It is to create misinformation, disinformation, and agitprop and then get it pushed to people like those in the video below, people who only get their news from sources that are not reliable because they’ve already been indoctrinated to the belief that these unreliable sources are the only reliable ones, who will then further disseminate the misinformation, disinformation, and agitprop. Having a US Attorney push the misinformation and agitprop just makes it that much better because the intended audience for this stuff already believe that AG Barr, on orders from the President, is working behind the scenes with only trusted members of the Department of Justice to root out the illegal and un-American activities of Vice President Biden, his campaign, his supporters, and Democrats through things like USAO Durham’s re-review of AG Barr’s previously ordered re-review of what the DOJ and FBI and the US Intelligence Community did in 2016 in investigating Russian interference in the 2016 election. Russian interference, part of a war that Russia began against the US no later than 2014, that is still ongoing!

Update at 5:15 PM EDT

Based on reviewing the most recent reporting it is very unclear if these were primary ballots or general election ballots. So I have made some revisions to the original post to strike through the references to these being primary ballots.

Nora Dannehy, top aide to John Durham’s Trump-Russia investigation, quietly resigns amid concern about pressure from Attorney General William Barr https://t.co/uablnX5lS1

— Bradley P. Moss (@BradMossEsq) September 11, 2020

From The Hartford Courant (emphasis mine):

Federal prosecutor Nora Dannehy, a top aide to U.S. Attorney John H. Durham in his Russia investigation, has quietly resigned – at least partly out of concern that the investigative team is being pressed for political reasons to produce a report before its work is done, colleagues said.

Dannehy, a highly regarded prosecutor who has worked with or for Durham for decades, informed colleagues in the U.S. Attorney’s office in New Haven of her resignation from the Department of Justice by email Thursday evening. The short email was a brief farewell message and said nothing about political pressure, her work for Durham or what the Durham team has produced, according to people who received it.

Durham, who has never even acknowledged that Dannehy was in Washington working for him, had no immediate comment on the resignation.

Durham recruited Dannehy to join his team after he was appointed by Attorney General William Barr more than a year and a half ago to examine the the FBI’s legal justification for a disputed counterintelligence investigation that looked for ties between President Donald J. Trump’s 2016 campaign and Russian efforts to meddle in the election.

Dannehy is a career prosecutor who worked closely with Durham before leaving the U.S. Attorney’s office about a decade ago for a corporate position in the defense industry. Durham persuaded her to return to the justice department and, within weeks, join his team in Washington in the spring of 2019.

Colleagues said Dannehy is not a supporter of President Donald J. Trump and has been concerned in recent weeks by what she believed was pressure from Barr – who appointed Durham – to produce results before the election. They said she has been considering resignation for weeks, conflicted by loyalty to Durham and concern about politics.

Durham is notoriously circumspect and neither he nor members of his team have revealed anything about the direction of their work. But Durham associates, none of whom have specific knowledge of the investigation, have said recently that it is their belief he is under pressure to produce something – perhaps some sort of report – before the presidential election in November.

The thinking of the associates, all Durham allies, is that the Russia investigation group will be disbanded and its work lost if Trump loses.

More at the link.

We already know, from the findings in the fifth and final volume of the Republican majority Senate Select Committee on Intelligence’s (SSCI) investigation into Russia’s interference in the 2016 presidential election that the Senate Select Committee on Intelligence, which shares oversight of the US Intelligence Community (IC) with the House Permanent Select Committee on Intelligence (HPSCI), has concluded that the US Intelligence Community, the DOJ, and the FBI acted reasonably and responsibly and that there was sufficient predicate to open the investigations into what Russia was doing and whether the President, his campaign, his campaign manager Paul Manafort, his business, members of his family involved in both the campaign and the business, and several outside senior advisors to the President during the campaign were somehow compromised by Russia during the 2016 campaign.

The SSCI’s conclusions tells us, if anyone had a question about it, that AG Barr is on a snipe hunt to try to produce an October Surprise to help the President get reelected. We also know that the conspiracy theory that AG Barr’s basis, his predicate for creating Durham’s investigation, is partially rooted in the debunked conspiracy theory that Secretary Clinton and her campaign, in conjunction with the Obama administration and senior Obama administration officials – VP Biden, APNSA Rice, AG Lynch, FBI Director Comey, DNI Clapper, DCI Brennan, and others – were conspiring with the Ukrainian government to interfere in the election to harm the President and his campaign and to blame it on Russia by creating a hoax that Putin was interfering on behalf of the President’s campaign. The fifth volume of the SSCI’s investigation report into Russian active measures and the 2016 election states unequivocally that this conspiracy was created by the Russian Intelligence Services and provided to Paul Manafort by his GRU handler, Konstantin Kilimnik, and that Manafort than provided it to the President and many of his senior appointees, aides, and surrogates. Moreover, we now know that the person responsible for pushing this conspiracy theory right now has been designated as a Russian intelligence officer who has been running the President’s personal attorney, Rudy Giuliani, as usefully idiotic asset!

Now we wait to see what the effect of Deputy US Attorney Dannehy’s resignation has. This is definitely a brush back pitch. Whether it actually changes AG Barr’s behavior is something we’ll have to wait to see. AG Barr has made it clear that he doesn’t feel that the DOJ’s rules regarding releasing information that could affect an election within 60 days of an election. Dannehy’s resignation is a warning shot. Now we have to wait and see if Barr receives the message.
