Prosecutors Signal Criminal Charges for Trump Are Likely  (NYT)

The Manhattan district attorney’s office recently signaled to Donald J. Trump’s lawyers that he could face criminal charges for his role in the payment of hush money to a porn star, the strongest indication yet that prosecutors are nearing an indictment of the former president, according to four people with knowledge of the matter.

The prosecutors offered Mr. Trump the chance to testify next week before the grand jury that has been hearing evidence in the potential case, the people said. Such offers almost always indicate an indictment is close; it would be unusual for the district attorney, Alvin L. Bragg, to notify a potential defendant without ultimately seeking charges against him.

In New York, potential defendants have the right to answer questions in the grand jury before they are indicted, but they rarely testify, and Mr. Trump is likely to decline the offer. His lawyers could also meet privately with the prosecutors in hopes of fending off criminal charges.

Any case would mark the first indictment of a former American president, and could upend the 2024 presidential race. It would also elevate Mr. Bragg to the national stage, though not without risk.
Mr. Trump has faced an array of criminal investigations and special counsel inquiries over the years but has never been charged with a crime, underscoring the gravity of Mr. Bragg’s inquiry.

Mr. Bragg could become the first prosecutor to charge Mr. Trump, but he might not be the last.

In Georgia, the Fulton County District Attorney is investigating whether Mr. Trump interfered in the 2020 election, and at the federal level, a special counsel is scrutinizing Mr. Trump’s effort to overturn the election results, as well as his handling of classified documents.

The Manhattan inquiry, which has spanned nearly five years, centers on a $130,000 payment to the porn star, Stormy Daniels, in the final days of the 2016 presidential campaign. The payment was made by Michael Cohen, Mr. Trump’s former fixer, who was later reimbursed by Mr. Trump from the White House. Mr. Cohen is expected to testify in front of the grand jury, but has not yet done so.

Mr. Bragg’s prosecutors have not finished the grand jury presentation and he could still decide against seeking an indictment.

Mr. Trump has previously said that the prosecutors are engaged in a “witch hunt” against him that began before he became president, and has called Mr. Bragg, a Democrat who is Black, a politically motivated “racist.”

Leonard Leo, the Federalist Society honcho who captured the SCOTUS and thereby set in motion fiat rule by unelected religious kooks and anti-regulation and anti-tax activists, isn’t content to rest on his laurels. According to a ProPublica investigation, Leo has taken an executive leadership role in an organization called Teneo that aims to be a “Federalist Society for everything.”

Having a SCOTUS supermajority and 28% of the federal judiciary in his pocket isn’t enough. Leo and his confederates want to remake the rest of society in the image of their brand of conservatism, including media, industry, technology, politics, education, sports, cultural institutions, etc.

Many Republican bigwigs are already on board, including DeSantis. It would be disastrous for democracy if they achieve even a tenth of the inroads into society more broadly that the Federalist Society did into the judiciary specifically. But I couldn’t help but smile at the delusional view of how “the left” functions to gain cultural hegemony, as described by Teneo co-founder Evan Baehr:

“Imagine a group of four people sitting at the Harvard Club for lunch in midtown Manhattan,” he said in a 2020 Teneo video: “a billionaire hedge funder,” “a film producer,” “a Harvard professor” and “a New York Times writer.”

“The billionaire says: ‘Wouldn’t it be cool if middle school kids had free access to sex-change therapy paid for by the federal government?’” Baehr continued. “Well, the filmmaker says, ‘I’d love to do a documentary on that; it will be a major motion film.’ The Harvard professor says, ‘We can do studies on that to say that’s absolutely biologically sound and safe.’ And the New York Times person says, ‘I’ll profile people who feel trapped in the wrong gender.’ ”

After a single lunch, Baehr concluded, elite liberals can “put different kinds of capital together” and “go out into the world” and “basically wreck shop.”

If only, dude. If only. Has he met elite liberals?

Anyhoo, inspired by this fantasy, Baehr moved to create a “counter-effort,” which Leo is now infusing with vast piles of donor cash so Teneo can set up secretive networks across multiple fronts. Weird how it never occurs to them to just try to persuade people with the power of their ideas. Maybe because their ideas are shitty and unpopular?

Next up, ambulatory unitard Jim Jordan’s “weaponization of government” committee interviewed Matt Taibbi and Michael Shellenberger today about revelations in the so-called Twitter Files. Here’s Aaron Rupar’s supercut of Dems pushing back:

I particularly liked how Dem committee members referred to Taibbi and Shellenberger as Musk’s handpicked “scribes.” Back in the day, Taibbi produced some pretty righteous rants about corrupt, unaccountable plutocrats fucking the country. If he has any vestigial sense of shame behind the trademark smirk, being called a fat cat’s handmaiden might be embarrassing.

The Fox News supercut will be different, and producing that supercut is the point of these hearings. But I do question the effectiveness of these shit-shows. Carlson’s dishonest manipulation of the January 6th footage he received from Kevin McCarthy may backfire since they keep the Trump-fomented insurrection and Carlson’s duplicity as revealed by the Dominion lawsuit filings top of mind.

Speaking of the Dominion revelations, Josh Marshall at TPM calls out the superficial reporting on the Fox News lawsuit, specifically figures from alleged news organizations who are framing the story as a liberal vs. conservative media thing. Marshall says that shows they have zero understanding of the business of media or about the laws that govern the press:

Fox broadcasts deceptive, disingenuous and flat-out false claims all the time. But to get into legal trouble you have to defame some person or entity with legal standing. The “woke mob” can’t bring a case. American democracy can’t bring a lawsuit. Politicians are seldom able to do so for a mix of political and legal reasons. Finally, for a case to have any teeth, the reputational damage must have some significant financial impact. This is why the particular dynamics of the Big Lie represented a kind of legal perfect storm.

For months Fox broadcast a series of demonstrably false claims about a specific, profitable and large private company: Dominion. There’s little question those lies damaged the company’s reputation and ability to sell its services. The details included in its motion also leave little question that people up and down the chain of authority at Fox knew those claims were false and simply didn’t care. Their focus was ratings and money. Under Sullivan, no defamation case is a slam dunk. But this is about as close as you get to that. The meaning of “actual malice” has been litigated extensively over the years. And the set of facts set out above basically meet all the definition points.

How unsurprising that Fox News’s self-appointed sister media outlets would fall into lazy “both sides” framing. They are nothing but glorified gossip columnists.

To combat restrictions, the White House coordinates with national organizations working to defeat potential bans, is getting the vice president to travel to such states to bring stakeholders together and uses its press contacts to spotlight legislative fights at critical moments.

The White House sees three different approaches to defend abortions rights and has broken down states into what they call either “battleground,” “extremist” or “proactive” states, White House officials and advisors say.

The White House views “extremist states” as those that have already banned abortion and where there are plans for further restrictions such as Texas, Oklahoma, Missouri and Idaho, the officials said.

Most abortions are now banned in 13 states as new laws take effect following the Roe decision.

In what it calls “access battleground states,” the White House is tracking fights this legislative session that could reduce reproductive care access. These states include North Carolina, Nebraska, Florida, said the officials, who spoke on the condition of anonymity to discuss internal strategy.

In “proactive states” such as Michigan, Minnesota, New York, California, Connecticut, the White House is working with pro-abortion rights state lawmakers who are backing legislation with funding for women and protections for abortion patients and providers…

Focus on the issue helped energize Democratic voters and staved off some defeats for the party in the midterm elections.

Edison Research exit polls found that for one-quarter of voters, abortion was the primary concern and 61% opposed the Supreme Court decision in Roe v. Wade.

Harris has spoken to 200 Democratic state legislators on reproductive rights and convened leaders from 38 states in dozens of meetings since the decision, the officials said.

Florida's proposed abortion ban is an attack on freedom. One does not have to abandon their deeply-held beliefs to say that the government should not tell people what to do with their bodies.

The California Democrat said he wrote to the chairman, Rep. Brad Wenstrup (R-Ohio), earlier Wednesday urging him to disinvite Wade from the hearing, “so as not to give legitimacy to a man of such discredited, unscientific and harmful views.”

“His participation hurts the credibility of this hearing,” added Ruiz, with Wade sitting right in front of him. “These views … have no place in a hearing examining the origins of a pandemic that has disproportionately and overwhelmingly harmed communities of color.”…

“When my book first came out, Mr. Ruiz, I think the extreme right wing thought it would help their cause,” said Wade. “But they very soon dropped referring to it because when they actually read it, as many people who talk about my book have not, they found that―”

So-Called ‘Heartbeat Bill’ Filed in Florida

Yesterday, the Florida legislature came back into session. That hasn’t been a good thing at any point in this century, but it’s especially bad this year. After winning reelection by a hefty margin, Gov. Ron DeSantis was in Triumph of the Will mode as he paraded through the Giant Twig & Two Berries Capitol.*

Florida’s part-time GOP legislators/full-time grifters mostly function as rubber stamps to codify DeSantis’s 2024 campaign wish-list these days instead of proposing legislation independently. They submitted a flurry of bills yesterday designed to maximize signing ceremony photo-ops.

If passed and signed, as most of this garbage will be, the proposed legislation will further dictate what teachers can teach, decree which funds state investors can choose and restrict how doctors practice medicine. There are yet more measures to oppress people who are LGBQ and especially T, restrict education about our racist past and present, defund public schools and loosen gun laws.

Since statehouse activities are now a wholly political operation focused on an upcoming presidential run, I was wondering how DeSantis and the Republican legislator-minions would handle the abortion rights hot potato, given that backlash to Dobbs almost certainly contributed to Republicans’ anemic results in the 2022 midterms outside of Florida. Now we know — they’re going full Mississippi anyway.

The same religious fanatic who sponsored an earlier bill imposing a ban on abortion after 15 weeks submitted a new bill to outlaw access after six weeks in this session. We know how this will play out. The 15-week ban has already forced women to leave the state to access medically necessary care, and restricting access to six weeks will make it that much worse.

I’m not sure DeSantis welcomes this development because it could complicate his presidential bid if there’s newsworthy backlash to draconian restrictions in the state. Or maybe that’s not something Florida Republicans worry about these days?

I don’t feel like I know the state anymore; it’s entirely possible the majority of Florida voters don’t give a shit if women lose their bodily autonomy and receive substandard medical care. The most recent data point — the 2022 election results — suggests they don’t.

But I don’t think DeSantis knows either. He has focused on imaginary problems like eradicating “wokeness” and tried to have it both ways on genuine hot button issues like abortion and open carry. Here’s how The Tampa Bay Times covered his response to the proposed six-week ban:

At a news conference after his speech, DeSantis said he supports further restrictions on abortion. But he pointed to the legal challenge against Florida’s 15-week abortion limitations and said that any further abortion restrictions would be in legal limbo.

When asked specifically about the six-week ban, and whether there’s a concern that it could restrict abortions before a woman may know she’s pregnant, DeSantis said he thinks “the issue is less [about the] week than the fact that there’s a detectable heartbeat.”

As the dissembler and liar well knows, “legal limbo” is merely an opportunity to funnel taxpayer money to out-of-state wingnut law firms, where outfits staffed by DeSantis cronies like Adam Laxalt make bank defending indefensible laws in court. The “detectable heartbeat” thing is 100% bullshit too since at six weeks, an embryo does not yet qualify as a fetus (much less a baby), resembles a tadpole more than a human being and hasn’t yet developed an organ that can accurately be described as a “heart.”

Still, I don’t figure Florida’s Squintiest Snowflake will have to use the “legal limbo” mumbo-jumbo to avoid signing the bill. If he finds the timing inconvenient, he’ll direct his statehouse minions to hold it up so it doesn’t reach his desk.

Ditto any proposed “open carry” bills. The expressed intent now is to pass legislation that allows anyone to carry concealed weapons without the previously required mandatory training or permits. DeSantis is hoping that will placate gun nuts, but one of them secretly recorded him at a book tour event saying he supports open carry but doesn’t know if the legislature would pass that provision.

The response was an expression of contempt for his gun kook questioner because the idea that the wingnut supermajority Florida statehouse operates independently of DeSantis is absurd. The real question is whether the image of people openly carrying AR-15s on the streets of violent Republican-run Florida cities helps or hurts the 2024 campaign.

The other real question is will stories about pregnant women being in danger of dying of sepsis or having to flee to blue states to receive proper medical care help or hurt the campaign, especially since the media doesn’t cover it like an issue that affects half the population. I don’t know the answer, and I don’t think DeSantis does either, but it looks like we’re both going to find out.
