Rep. Ralph Norman (R-SC) is questioning whether the Capitol rioters were Trump supporters. He says nobody did a "poll" of the rioters. This is ridiculous. The rioters wore Trump hats/shirts, flew Trump flags, chanted pro-Trump slogans, and later told the feds they loved Trump.

… In three separate letters dated May 3 and addressed to Post reporters Ellen Nakashima and Greg Miller, and former Post reporter Adam Entous, the Justice Department wrote they were “hereby notified that pursuant to legal process the United States Department of Justice received toll records associated with the following telephone numbers for the period from April 15, 2017 to July 31, 2017.” The letters listed work, home or cellphone numbers covering that three-and-a-half-month period…

News organizations and First Amendment advocates have long decried the government practice of seizing journalists’ records in an effort to identify the sources of leaks, saying it unjustly chills critical newsgathering. The last such high-profile seizure of reporters’ communications records came several years ago as part of an investigation into the source of stories by a reporter who worked at BuzzFeed, Politico and the New York Times. The stories at issue there also centered around 2017 reporting on the investigation into Russian election interference.

It is rare for the Justice Department to use subpoenas to get records of reporters in leak investigations, and such moves must be approved by the attorney general. The letters do not say when Justice Department leadership approved the decision to seek the reporters’ records, but a department spokesman said it happened in 2020, during the Trump administration. William P. Barr, who served as Trump’s attorney general for nearly all of that year, before departing Dec. 23, declined to comment…

The letter does not state the purpose of the phone records seizure, but toward the end of the time period mentioned in the letters, those reporters wrote a story about classified U.S. intelligence intercepts indicating that in 2016, Sen. Jeff Sessions (R-Ala.) had discussed the Trump campaign with Sergey Kislyak, who was Russia’s ambassador to the United States. Justice Department officials would not say if that reporting was the reason for the search of journalists’ phone records. Sessions subsequently became President Donald Trump’s first attorney general and was at the Justice Department when the article appeared…

In early August 2017 — days after the time period covered by the search of The Post reporters’ phone records — Sessions held a news conference to announce an intensified effort to hunt and prosecute leakers in government.

“This culture of leaking must stop,” Sessions said, noting that the number of leak investigations had tripled since the end of the prior administration. That announcement seemed aimed at appeasing Trump, who had publicly complained about leaks that made him look bad, and branded Sessions “weak” on hunting leakers…

Now Attorney General, Garland has wasted no time in returning to his old beat. On Thursday, his first day as AG, Garland addressed the 115,000 DOJ employees he now commands in a virtual speech. Then he set to work, with a particular focus on the January 6th storming of the U.S. Capitol. From The Wall Street Journal:

Less than an hour after his short speech Thursday, Mr. Garland went behind closed doors with Federal Bureau of Investigation Director Christopher Wray and other national security officials for a briefing on the riot investigation.

 

How has Merrick Garland spent his first day as AG, you ask?

Politico reports that aside from ceremonial stuff, he got briefed by FBI Director Wray on the Capitol riot investigations, and then began meeting with DC prosecutors who are pursuing active cases.

Claims, of course, is a word that means nothing, on its own. But the Oaf-Keepers’ loudest supporters have been put on notice: There’s a new team in the Oval Office, now…

… Watkins is central to one of the most aggressive criminal conspiracy cases yet to emerge from the insurrection. The Justice Department indicted her and eight other alleged Oath Keepers on several charges related to the riot, including allegations that the group coordinated their travel to the pro-Trump event, discussed training and weapons beforehand, suited up in body armor and broke through the crowd heading into the Capitol in a military-style formation.

Watkins’ attorney argued in the new filing she isn’t alleged to have been violent in the melee, and that, though she is charged with aiding the destruction of property, didn’t participate in vandalism and encouraged others not to as well. The court filing is the first meaty defense of the high-profile defendant in court.

Prosecutors previously said Watkins had waited for direction from Trump — and believed she had received it before she joined the siege, allegedly leading several others into the Capitol building to fight against Congress’ certification of the Electoral College vote.

Watkins’ defense attorney, Michelle Peterson, wrote on Saturday that her client and other supporters of Trump had believed the then-President would invoke the Insurrection Act to use the military to overturn what he falsely said was the fraudulent election of Joe Biden. And Watkins and others believed “they would have a role if this were to happen,” the filing said…

Looks like the Feds may be taking a harder line with these rioters than I thought they might. Per the Washington Post:

… Acting U.S. attorney Michael R. Sherwin said Tuesday at a news conference that while new arrests in the nationwide manhunt will soon “plateau” after an initial wave of 135 arrests and 150 federal criminally charged cases, investigations continue into whether different “militia groups [and] individuals” from several states conspired and coordinated the illegal assault on Congress beforehand.

In charging papers, prosecutors have already identified a dozen members or affiliates of militant right-wing groups, including the nativist Proud Boys and the anti-government Oath Keepers and Three Percenters, the latter two of which recruit heavily among former military and law enforcement personnel.

Sherwin suggested that seditious conspiracy charges are pending and, without commenting on grand jury indictments, said that “the results will bear fruit very soon.”

Federal law makes conspiring to overthrow or oppose by force federal authority punishable by up to 20 years in prison, including the use of violence to prevent, hinder or delay the execution of law…

Prosecutors have obtained more than 500 grand jury subpoenas and search warrants, and charged dozens with assaulting police, a number Sherwin said would quickly grow.
