    Can’t possibly be harsh enough.  On the immunity thing.  It is being widely interpreted as a get out of jail free card for Trump particularly concerning the Jan 6 insurrection.  But since when is overturning the results of an election an official presidential duty?

    @SW: Presidents have no official duties regarding elections at all.  Elections are specifically and explicitly NOT within the domain of the Executive.

    Just another established law SCOTUS has thrown out.

    IOW, an “official action” is whatever SCOTUS says it is.

    It was hard to hear what Bannon was saying over the (righteously correct) din but what I was able to gather, he was comparing himself to someone who got sent to the same prison in the 1940s by the House UnAmerican Committe.

    A commenter at LGM (yeah, I know) just made a good point about that.

    “The President cannot be held accountable for acts performed in his official presidential duties” is a tautology.  If the President is doing something that the constitution empowers him to do, then obviously it isn’t illegal and he shouldn’t be found guilty of anything, but that’s always been true.

    Bringing this up in the context of the President inciting a coup against the government is meant to massively expand the definition of “official presidential duties,” but also keep it hazy as fuck, which effectively means that the courts (ultimately meaning the Supreme Court) get to decide whether or not a President is currently acting within his official presidential duties.

    When it’s a Republican, they’ll find  that he was.  When it’s a Democrat, they’ll find that he wasn’t.

    Yeah, a lot of pushback against media bullshit is framed as “this doesn’t mean what they say it means or are implying it means,” and correctly so.  But I suspect a lot of the time, they are just brazenly making shit up.

    The ur-example of this is the “Biden’s saying he won’t serve more than four years” stories that we’ve been hearing since 2019.  All of these stories go back to the same one Politico article, which in turn rests completely on four anonymous sources (at once, mind you: they’re not listed as four separate people saying similar things).  In five years, none of the many, many articles on the topic have ever come out and said that the only reference ever made for this is the one Politico article, or that no one has actually said that on record.  (Some articles even reference the same Politico article multiple times, using hyperlinks to make it look like they’re not).

    Considering the contrast between how thin the source material is and how incredibly far and wide its thesis was propagated, it’s very hard to think that the original story wasn’t just completely made up.  The media had the story they wanted to tell, one of them made the jump of writing a pure baloney article based on a source they made up because they knew it could never be checked, thus giving the green light to everyone else to knock themselves out.

    @Raven: yeah, they’re coached to draw fouls. It’s similar to the NBA, but here it’s just so much more blatant and over the top. There’s the rare times that the ref will call, and card the flopper (that’s what’s supposed to happen), but most of the time it doesn’t happen. This guy is ignoring more of it, but flopping occurs more when the side isn’t as good and needs the extra “help”. And yes, Portugal isn’t that good despite the fact they made the 16.

    I’m a little confused about what you’re saying here. Wasn’t it always the case that the SCOTUS could decide that? IOW, what exactly has changed?

    I want to understand in case I have to explain this to someone who doesn’t follow this stuff very closely. The layman probably thinks the SCOTUS has always done this

    @Raven: it’s a tactic to help block the kick; the wall of players will typically jump when the player kicks the ball, to try to help block/deflect the kick. That then leaves the space under them for the ball to pass. So 1 player will lay down to help block that as well. This “tactic” is a relatively new wrinkle. it def wasn’t a thing when I playing, which isn’t that long ago…

    And yeah, the writhing on the ground like you’ve just stepped on a land mine is… irritating, to say the least.

    i’m getting so, so tired of the doomerism on here, and the press loves covering shit like a horse race instead of explaining fundamentals and what’s at play, a job that seems to fall to @golikehellmachine.com on here.

    so here’s a thread about why i’d rather be biden — yes, biden — right now

    the baseline for this election is 2020. normally “the last election” might not be a perfect baseline, but it’s the same guys with the roles reversed. both are quasi-incumbents, and we have a four year record for the both of them, with some recency bias for biden.

    here’s that map {inserted map of 2020 electoral college results}

    3/ now, for trump to win, he has to do three things:

    1) hold nc

    2) flip georgia and arizona

    3) make headway in wisconsin, michigan, and pennsylvania

    for biden to win, he has to hold wisconsin, michigan, and pennsylvania.

    4/ holding nc:

    trump won nc in 2020 by 1.5 points, the closest red state of 2020. in 2020 dem roy cooper won the governor’s race by 4.5 pts, meaning a lot of trump/cooper split tickets.

    for this round, the nc gop nominated a literal nazi as their gubernatorial candidate. not ideal!

    5/ holding nc means campaigning next to this guy.

    again, not good! not good, at all!

    6/ next order of business is flipping arizona and georgia. i think both of these states were at least modest surprises to everyone in 2020, and on paper should be the most tenuous biden holds. trump should be able to flip them back, right?

    well, it’s still an uphill battle.

    7/ for arizona, we have multiple state-wide races to look at from 2022 to establish a baseline. katie hobbs beat kari lake by about 10k votes for the governorship. adrian fontes beat the far-more-trumpy mark finchem in sos by ~5 pts. trumpy blake masters lost by same margin to incumbent kelly.

    8/ so arizona, in 2022, given a slate of very trumpy candidates, rejected all of them. the most likeable (least serial killer like), kari lake, is running for senate again.

    the az gop is bankrupt, and fake elector trials will start some time before the election, and will be big local news.

    9/ so trump has to overcome all that, which he may, it was extremely close in 2020 in arizona.

    which brings us to the other surprise swing, georgia

    10/ georgia’s gov kemp is not a fan of trump. there’s been a lot of effort to pull electoral shenanigans there, but kemp isn’t going to put his fist on the scales for trump if he comes up short, so on paper at least a decent dem margin in ga will hold.

    11/

    like az, ga has had a few state level trumper candidates. in 2020 warnock beat loeffler by 2 pts, and ossoff beat perdue by ~1 pt. that’s really close, but it’s a margin that’s pretty shenanigans-proof.

    then in 22 ga gop nominated herschel for senate. warnock won by 1 pt in a “red wave” year.

    12/

    so, like az, ga has rejected trumpist candidates at the state level multiple times in favor of dems, even facing national headwinds for the dem party like the summer 2022 inflation.

    i’m not saying trump won’t flip one or both of az or ga, but it’s not a slam dunk, work must be done.

    13/

    which brings us to the blue wall. if trump accomplishes the previous two things, he has to flip one of wisconsin, michigan, or pennsylvania.

    wi is probably the most vulnerable, followed by mi, then pa.

    14/

    wi re-elected ron johnson in 2022. god damn it, but by about 20k votes. in the same election, tony evers won the gubernatorial election by a 3 pt margin, so it’s hard to draw a conclusion there.

    since then, wi had a high-profile supreme court election, which flipped the court’s make-up.

    15/

    so this year wi is having its state leg elections under maps drawn up by evers after the sc ordered them to get their shit together, meaning this’ll be the first competitive state leg elections in wi in 15 yrs.

    elections have consequences.

    meanwhile, the wi gop was doing this.

    abortion is very much on the ballot in wisconsin this year.

    michigan just re-elected big gretch by ten points, the michigan gop is somehow worse off than the az gop (which has been taken over by complete psychopaths) by having a schismatic civil war, and is also broke.

    biden was very public in supporting the uaw strike, among other union supports.

    the big concern in michigan is the large muslim-american population who are, justifiably and understandably, pissed off at biden for not doing more to restrain israel in gaza.

    i have no idea how important this will be, but if israel and hamas agree a biden-backed ceasefire it probably helps.

    and this is why it’s deeply unlikely a netanyahu-led gov’t is going to agree to a ceasefire before the election.

    of course, trump is doing everything he can to ruin his chances by using “palestinian” as a slur for biden and schumer; holding rallies at non-union factories; “black jobs”; things of that nature.

    i think mi is the biggest wild card, but trump has to make inroads with people of color to win.

    if pennsylvania falls, i think we’re in full democratic collapse mode, and ironically the fall of the keystone state would herald the end to constitutional governance in this country.

    we all watched dr oz lose, hilariously, to fetterman. the leg is split, and the gov is blue.

    so trump’s path to winning is:

    1) hold nc

    2) flip az and ga

    3) flip wi

    i’ve covered why nc is touchy, az and ga are uphill battles, and wi dems have shown the payoff of working with stacey abrams to get it together and start winning elections.

    each of these things would be hard, but…

    2022 midterm should have been a red wave based on fundamentals.

    incumbent party, inflation not doing great, weird economy coming out of covid. 538’s most likely house split was ~228-207 based on polls.

Maybe I’m getting too cynical, but the meltdown over the debate seems to have neatly allowed two disastrous court decisions to come down under the radar.     @Goku (aka Amerikan Baka): The problem I see is the opinion says a president has immunity for official acts.  Sotomayor points outs  pardons can now be sold for direct bribes with impunity, as pardons are official acts.

    This goes beyond what Dump even asked for.  His lawyers argued that a prosecution could occur, but only after being impeached and convicted in the senate. Here the court says that doesn’t matter, you can be convicted in the senate and still escape legal process.

    Looks like there’s a reasonable chance to gain 2 US house seats in WI (Wi-1 and 3). Kristin Lyerly seems like an excellent candidate but wi-8 seems too Republican. Do you have a sense of the down-ballot candidates in that area?
    (from afar it looks like Senate district 30 and assembly districts 88 and 89 are flippable with good candidates.)

    The US Constitution, Article 2, Section 3, mandates that the President “shall take Care that the Laws be faithfully executed.”   Trump has demonstrated that he will NOT faithfully execute the laws if he becomes President.

    Therefore President Biden has a duty, a Constitutionally imposed duty, to take care that Trump not become President.  It is his official duty — which, per the latest from the Supreme Court, means he must do so by any means available. It’s not a choice.  It’s a minimum job requirement.

    Wisconsin (non presidential) primaries are in August, but l’m bullish on WI-03 (Van Orden), WI-01 (Stiehl), and WI-08 (open, formerly Gallagher). The latter is R+10, but likely a white man running vs a female ob/gyn. A Todd Akin moment wouldn’t surprise me. 1/

    Also Wisconsin has FAIR MAPS!! (state leg only) Real chance to flip the State Assembly (running candidates in 97 of 99 races), with State Senate pickup opportunities (only 16 of 33 seats up for election in 2024). 2/

    Biden campaign has tons of offices across the state, including in or near the 16 St Senate districts up for election. Sen. Baldwin is also up for reelection.

    Lots of up and down ballot opportunities in Wisconsin this year! 3/3

    Wisconsin leg primaries aren’t until August, so we’ll see who the GOP nominates in WI-08. But I’ve mostly heard of white men from the WI leg running. They don’t know how to campaign. They’ve been gerrymandered into electoral atrophy. And I trust Ben Wikler.
