Stanley Fish to the Defense

Stanley Fish, dean of the College of Arts and Sciences at the University of Illinois at Chicago, has written a beautiful two page defense of Clarence Thomas’s decision in the affirmative action case last week:

Justice Thomas is not the only one in search of timeless tools to deal with the untidiness of the situations time throws up. It is the law’s claim precisely to base itself in such tools. But I believe this search has failed, and therefore we will always be engaging in the ad hoc, pragmatic reasoning of which Justice Thomas accuses the majority.

At Long Last

Thank goodness. Finally we are hearing someone bitch and moan about the outrageous spending that has taken place during President Bush’s administration due to appropriations from a REPUBLICAN congress:

Federal outlays jumped by $222 billion in President Bush’s first two years, a spending increase that is expected to accelerate under the administration-backed $400 billion prescription-drug bill that is speeding through Congress.

Much of the spending increases have been for defense and the war on terrorism at home and abroad, according to White House and congressional budget analysts.

The two-year increases represent 1 percent of the economy’s annual gross domestic product, four-tenths of which was devoted to national security.

Meanwhile, Democrats are still lying about spending:

Democrats have been loudly complaining that domestic social welfare spending has been cut under the Bush administration.

But congressional budget officials say that over the past two years such spending for education, job training, unemployment assistance, Medicare, Social Security, veterans benefits, food stamps and other “human resources” has risen from 11.5 percent of GDP to 12.7 percent.

This fiscal irresponsibility is Bush’s Achilles Heel in his re-election bid. Not his ‘arrogance,’ his ‘lying about WMD,’ the fact that ‘he is stupid,’ or the ‘tax cuts for the rich,’ or ‘the erosion of civil rights,’ or any of the other crap that Democrats routinely screetch about every campaign (he is going to starve the poor, enslave the dark-skinned, put children in labor camps, etc.) The spending is his real problem.

The Blackmail Continues

I see Ted Kennedy has joined Charles Schumer and Pat Leahy in the public vlackmail game that the Democrats have turned judicial selection into:

The process has not always been contentious. When presidents understand and respect the constitutional “advice and consent” role of the Senate on judicial appointments, the process can be smooth and cooperative, especially when the president obtains and heeds the Senate’s advice before requesting its consent on a nominee. But when a president tries to ignore the Framers’ careful decision to have the Senate share the appointment power, then the responsibility the Framers placed on us may require us to stand up to the president, and over the course of the nation’s history the Senate has done so when necessary.

Apparently the Senate Democrats want to give advice like the Godfather- take it, or else. This is simply more blackmail- what they are saying is we do not respect you as a legitimate President, and even though we have been voted out of power in every arena of the federal government, we think it is our job to choose court appointees. Bush should tell them where to stick it, and let the loony left and the Common Dreams crowd moan on and on about how ‘arrogant’ Bush is.

Real Clear Politics notes that in his current op-ed, Kennedy wrote this:

“Ronald Reagan nominated Robert Bork, and the Senate, after carefully considering and debating his qualifications, defeated him.”

Real Clear Politics then points out these remarks that Kennedy made during the Senate hearings on Bork:

“Robert Bork’s America is a land in which women would be forced into back-alley abortions, blacks would have to sit at segregated lunch counters, rogue police would break down citizen’s doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists would be censored at the whim of government, and the doors of the federal courts would be shut on the fingers of millions of citizens for whom the judiciary is often the only protector of the individual rights that are the heart of our democracy.”

I guess we shall add blackmail to the list of Kennedy offenses, which include serial liar, adulterer, alcoholic, and lest we forget, murderer.

You know, the more I think about it, the angrier I get. Chante Mallard gets stoned, hits a guy, lets him bleed to death in her garage, and she goes to jail for 60 years. Kennedy gets drunk, drives off a bridge, let’s a girl slowly drown to death, and he gets a lifetime Senate seat.

The real WMD are the ways the Democrats view the world and poltics. Most of us either want to find the WMD in Iraq, find out why our intelligence was wrong if there were none, and in the worst-case scenario, find them if there were weapons and third parties somehow have seized them. What do the Democrats REALLY want?

Edward Said (University Professor of English and Comparative Literature at Columbia University), in the latest Palestine Chronicle:

Hardly a single journalist except Helen Thomas has taken the administration to task for the outrageous lies and confected “facts” that were spun out about Iraq as an imminent military threat to the US before the war, just as now the same government propagandists, whose cynically invented and manipulated “facts” about WMD are now more or less forgotten or shrugged off as irrelevant, are let off the hook by media heavies in discussing the awful, the literally inexcusable situation for the people of Iraq that the US has now single-handedly and irresponsibly created there. However else one blames Saddam Hussein as a vicious tyrant, which he was, he had provided the people of Iraq with the best infrastructure of services like water, electricity, health, and education of any Arab country. None of this is any longer in place.

And Mussolini had the trains running on time. Said has inspired me to write a song. Sing along, if you like:

Oh, I wish I was in the land of Saddam,

Woo Hoo! The Texas sodomy law has been struck down by the Supreme Court.

[sarcasm] I think, in celebration, I am going to engage in a wild orgy of sodomy. I will sodomize at the office, at the grocery store,- hell, I will sodomize on the ride home to pick up my BBQ smoker today. No one can stop me now- I am going to engage in sodomy 24/7. [/sarcasm]

At least, from the reaction of those in favor of keeping sodomy laws, that is what you would expect everyone to do- I know I was just one step away from having gay anal sex when I found out it was illegal- that stopped me right there. My point, of course, is that it is none of the government’s damn business what my homosexual friends are doing in the bedroom. I see no reason why their sex lives should be under scrutiny (or mine, for that matter). A good day for common sense and privacy, if you ask me.
