I saw my 96-year-old grandma this morning and got her to try virtual reality with a Google Cardboard thingy. She was fascinated by it but seems convinced it’s sorcery.

Fighting with my sister who as executor of my mother’s will has decided that she will subtract a realtor commission fee and other real estate sales costs against my share of our late mother’s condo. We aren’t selling it, my sisters are buying me out. But my share will be less, because she says I’d have to pay them if we were selling the condo to a third party, so why not deduct them?
The point that we aren’t selling the condo at all, and that they aren’t paying them so why should I, seems lost on her.
She insists that’s how it’s done, but so far a lawyer, a real estate agent, and an online estate information site seem to disagree. So now she’s going to consult a “impartial” lawyer.

Me and the Mrs. just walked back from the local farmer’s market. Bought red lettuce, yellow tomatoes, white onions. I treated myself to what a sandwich vendor calls a “manwich” (egg, ham, sausage, toasted roll).
One of the vegetable farmers sells huge catnip plants. My wife had found a mint growing tall in our back yard (almost five feet tall) and didn’t know what it was. She took a sample to bring to the farmer’s market for analysis. Turns out it’s catnip! Several years ago, I’d planted catnip on the front side of our house. It got big, but eventually was chewed to stumps by the tough neighborhood outdoor cats. Somehow seeds got into the backyard, and now there is a mighty catnip plant standing proudly next to my wife’s blueberries and tomatoes.
Started to rain while we walked back. but we had umbrellas. The rest of the day will be quiet as we enjoy our vegetables. Our housecat sampled some nip, so now she is staring dreamily at an empty space about two inches from her face, blissed out.

My lucky sun and his beautiful bride of one year are spending the month in Japan! We’ve been receiving updates of the visit every morning. He’s 6′ 6″, and many things in Japan (shopping carts, cars, clothing, ceilings in rooms) make him look like Gulliver in pictures. Or at least Andre the Giant.
They married here in the states, but donned traditional clothing for wedding celebration pics with her family, and her dad just sent us a buttload of pictures from the photographer. In one, her college-bound brother stand on a box to be as tall as my son, and gives a thumbs up!
Upon return, they will travel from here in WNY to Mountain View, where he’ll work for a solar startup. I’ve been jazzed since before the 4th with all of this happening. Our daughter lives in Port Townsend, WA, and his choice of California over Boston was a little bit heartbreaking, just because we’d love seeing our kids more often. My troubles are few, but what has transpired in the last week has added to my general feeling of sadness and anxiety for the future.
Over the last year, we’ve had to share some of the less-admirable aspects of American history with our daughter-in-law. It’s sad and shameful. I’m glad they are out of the country right now.

@satby: Sorry this conflict is added to the loss you all share. INAL but my mother’s estate lawyer said that there are varying laws and “traditions” about such details across the country. In Arkansas, the executor traditionally gets an additional one percent of the estate, for example, and in the case of dividing an asset by three the youngest gets the extra third of a percent. So your lawyer in Michigan may have a different take than your sisters lawyer in Florida.

Two graduation parties today. One more next Saturday. These are in the suburbs of Detroit, so they are big affairs–not a handful of relatives, some chips and dip, on graduation weekend, like back in my day (1976). If the condo is worth, say, $300,000 the 6% commission would be $18,000.
You mentioned sisters, I’ll assume 2. Your share of commision is $6,000.
If this is indeed the way they want to go, make sure that the sisters, begin paying taxes, insurance, monthly maintenance, electric, cable, phone and natural gas bills on a pro-rated basis from the passing of your dear mother out of their own pocket and not the estate. You also need to value all items inside the condo which they will keep possession of, and you should receive 1/3 of that.
Just a thought. . . .

It is possible for family to handle an estate amicably. My sisters and I are co-trustees for my mother’s, and we are just now wrapping it up, a year and a half after her death. We decided up front to divide the duties among us (one handled banking and liaison with the lawyer and CPA, one handled distribution of IRAs and investments, one handled sale of the real estate). By not getting in each others’ way and cutting each some slack to do things as they saw fit, we had very little conflict (Of course it helped that our one really difficult sibling predeceased our mother).

So here’s the latest round of smears being passed by “conservatives” about Alton Sterling.
Same kind of stuff, usually prefaced with “an outstanding citizen, like all the others” or some such dig, shortly after Michael Brown’s death. Because, as everybody knows, one must be a complete and total angel to not deserve getting executed by police officers following up on an anonymous tip.
Something that is disturbing, about this particular one, however: This was posted/”Liked” by an otherwise really nice Hispanic woman I know, and liked by at least two of her Hispanic female friends. She’s been married three times, the last two to wealthy white men. The latest is a retired cop. She lives at a WAY better upper middle class lifestyle than most people in this town, in a Country Club community upscale home she got in her last divorce, and spends most of her time vacationing and working out and posting meals, wines and cigars on her FB page. (Seriously, she was once a really cool person, when our daughters were friends, so forgive me for still following her lol)
She used to work at the Catholic Diocese, and it’s pretty much become obvious she’s a “Conservative”, although it appears she’s not for Trump but Gary Johnson. I’ve also seen her post “Strong Latina” stuff, so, she’s got some awareness of social inequality issues. And this community–this state–is a totally weird alternative universe anyway being approximately 60-40% Hispanic majority, and while we’re a poor state, we have lots of middle and upper middle class Hispanic families. So what I tend in terms of racism is often more about class than about race.
Bad enough when my clueless white friends don’t have empathy. But it’s quite the puzzle how hierarchies of who we get to discriminate against come to be among people of color….

@Poopyman: check your local library or bookstore for Nolo Press estate and probate law for your state. They are a godsend for the non-lawyer public -and Nolo always suggests seeking legal advice when soubt, complexity or other potential pitfalls loom.
You sister is probably entitled to reimbursement for routine and customary expenses but carving out a commission in which she is the direct beneficiary at the expense of co-benificiaries may be improper.

His presidency has increased awareness of disparities and inequities in society, it has made many uncomfortable and caused many to realize how much more work there is to done. This recognition is why people say race relations are worse now than before his presidency . Sunlight is the best disinfectant. What’s funny is that the vast majority of my mom’s estate disposition went totally smoothly, I think, but everyone likes the brother who was the executor. As far as I know, no one had any complaints. I was the one to split up the photos and my sister-in-law kept urging me to take more, which out of a sense of fairness, I refused to do.
Eleven years after my mom’s death, Aetna sends me a letter saying there’s an unclaimed insurance policy in my name through my mom. I sent it to my brother and told him whatever it was worth, it should be split four ways. The amount ended up not being that much and Aetna being Aetna, they sent out very uneven amounts. My prick brother got the largest amount and even though we all know what each other got, he has yet to send any of his siblings a check to even things up. I hope he chokes on his next jelly bean.
I hope you get through this with less vengeful thoughts, but how great you have a place to move to now!

@MattF: One of my childhood friends had a huge fight with a brother and SIL over their dad’s estate. Her father had a will, older brother is a lawyer and would have executed (?) the estate for free. SIL was convinced they would be cheated, got other lawyers involved.
It turns out their dad left most of his money to build a church in his home village in Ukraine (the original had been destroyed by the Soviets). Much of what was left went to lawyers and court costs. My friend no longer speaks to that brother or SIL. Since she was never close to the lawyer brother and his crazy mail order bride, it is a good thing that her husband’s family is marginally less crazy than hers.

Thank you for the “I’m going to a craft store idea”. My bride tried stained glass and her astigmatism caused her to cut the glass just a little bit off. . . then a little more and finally just a little more. Than start over.
She quit within 6 months and discovered polymer clay (Premo! and Femo). Making “canes” is a very forgiving art and she now makes beautiful jewelry. Too much, if fact, much too much. Now we do it together.
So off the the Tandy leather shop to look for laces to hang her necklaces and pendants. Something nice indoors, as it’ll be 115 here today.

By the time they both died, the remaining balance was already just money. The personal belongings were more a burden, because going through everything was just sad and annoying.

@hovercraft: As a 70 something white guy I’m surprised that what happened in Dallas the other day hasn’t happened more often. I donot in any way shape or form buy the rightwing BLM is at fault, or that African Americans are more inclined to violence.
I’m amazed that after 400 years of slavery, rape, murder, Jim Crow, lynchings and breathing while black style executions, 99.9% of the African American community by word and deed still has faith in this not yet so perfect union of ours. A community that has given us Marin Luther King and John Lewis; as opposed to a white community that gives us Mark Fuhrman, the Lt. Gov of Texas and Steve King. This is a community that gave us the Tuskegee airmen who had to fight their own government to be given the chance to defend America. As a Vietnam era college student I saw the campus full of young white guys from middle and upper class backgrounds protecting their deferments. (Full disclosure – While I had a deferment I’m almost blind in my right eye so when I was drafted I wound up a 4F.) In the meantime young African Americans (and working class whites to be fair) were being drafted and sent to Vietnam to fight for a cause no one understood. They may not have gone happily but they went and served their country. And for those African Americans who gave their lives they returned to an America where they were buried in the ‘colored’ section of a National cemetery.
So here we are in 2016 listening to white folks complain about reverse racism and how African Americans get away with murder, literally and metaphorically. The founding fathers took up arms against the King with a far shorter list of grievances than our African American brothers and sisters have.

I happened upon “Kingdom” by accident and I loved it. I agree it’s got a similar feel to “Doc Martin,” except instead of an anti-social prick, the protagonist is amiable to a fault, which to my mind made it a bit more enjoyable. Unfortunately it ends on a cliff hanger and was not renewed!

Also the Kenneth Branagh version of Wallander is high art TV. Not English countryside, but Swedish shoreline and countryside. Very moody, beautifully filmed Nordic blues in both the modern sets and emotionally. Kenneth Branagh carries each episode with so much worldweariness, but not too much to stop watching.

I just ate my first popsicle made from my new stainless steel popsicle molds. I used 2 cups of awesome peaches, 2/3 cup of water, 1/3 cup of sugar (half of what the recipe called for) and a few squeezes of fresh lemon.

It’s funny how you get that in some places but not others. In Texas, people talk about Texas style or Texas food. To a lesser degree, people in Iowa talk about Iowa values or an Iowa way of life. When I lived in Detroit, I never heard anyone talk about Michigan that way.

Being a black person in this country has always been an internal conflict for most of us, we love our country but are very clear eyed about it’s shortcomings. Rev. Wright was not a surprise to any of us, hell he even spoke for many of us. We are also according to many surveys the most optimistic about Americas future, these are trying times economically and socially. We knew that racism was systemic and that we were no where near a post racial society, as if that is even a thing. What the hell does that mean, I’m black and proud of it I’m proud of my heritage as I’m sure you are, we don’t want society to be post racial just to treat every one equally. We are optimistic because what the Tuskegee airmen went through can’t happen today, Colin Powell was the Chairman of the Joint Chiefs. We are aware of the progress that we have made as a nation, but there is still a long way to go. For decades ours complaints fell on deaf ears, but now with social media the nation has been forced to see our lived truth. Are we angry bitter yes and no we’ve adapted to the reality of the society we live in. We give our kids the talk, is it fair that we have to, no, but we do what we must to survive. The great recession was harder on black and brown people than anyone else and yet we are more optimistic about our children’s futures maybe because for us getting ahead has always been such a struggle and since we’ve done it before we can do it again. Watching these videos is painful and frustrating and can make you just want to lash out, I’m tired of watching these innocent people die for no reason, but America is watching and listening now and saying that this has to stop. Right now it’s not enough people, but everyday it’s more and more, and maybe the time the next generation reaches my age (48) this will no longer be an everyday occurrence. For every one of these horrific videos we see there are hundreds more of these murders not caught on tape. We started out as chattel and now we have a black man as president. We believe that America is slowly making progress every day, we are optimistic about the future of race relations in this country, we have to be for our children. But in the mean time we prepare them for the struggle they will have to wage everyday of their lives as a black person in America.

@satby: I worked for for an attorney who did a lot of divorce work too. People can get insane. She had one client whose bill was more than $20,000 (in 1977 dollars). They had been at it for years and the only issue left was who got the Frank Sinatra albums?
I asked my boss why they couldn’t just get another set of albums and she said Dog forbid, she pays your salary plus expenses for three of my pro-bono cases. We had a whole routine where she would call, Mildred would talk to to her for a minute or two, then I’d break in saying that Judge Smith was on the line, she’d tell me to tell him he’d just have to wait, then hang up and I would spend up to 90 minutes saying yes, no, and really?
That killed my desire to be a lawyer, so there was one plus.

My brother and I were co-executors. Regarding the stuff, the house was chock full, my parents were each the last member of their families in town, so stuff just landed there. My brother and I got stickers, red dots and green dots (I forget the real colors) and flipped a coin to start, and then we wandered the house together picking out stuff we wanted.
He had to transport to Texas, and picked out some heavy antiques. I picked art and stuff they brought back from Africa and the Orient. Then there was an auction. Near the end I saw my Dad collection of swizzle sticks from bars around the world, and I bid for it, paid $35, $3.50 to the auctioneer and $17 to my brother.
We even sold the house and property at the auction, way less than it was worth, but it wasn’t show ready, had stood empty for 2 or 3 years, and it was no hassle.
Whenever anyone started to go off on anything either one of us would just say, “that doesn’t matter right now…” and it would peter out. Sorry you’re having issues, it can be really strange.
Friend’s grandfather was in his 80s, a farmer, and got run over by his tractor. The next morning, his cattle were gone, 30 head, and friend went to the hospital, his aunt and his mom each had a will they were trying to get grandpa to sign, while suffering from broken ribs and medicated to the eyebrows. Friend was a cop, and asked the hospital to run them off. He also made one phone call and got the cattle back. Grandpa lived another 12 years!
Couldn’t believe it, but every word is true. We used to hunt rabbits up there, now the bottom pasture is a lake with a mega-house at the far end…

After what we dealt with, I would NEVER have a family member as my executor, especially a son or daughter. Even when people mean well, their grief over the parent’s death can impair their judgment. I still can’t believe some of the stuff that came out of my brother’s mouth during the whole process.
(Short version: my brother found out during the process of executing the will that he had very nearly been disinherited because my dad didn’t like his second wife. That really screwed up the whole process and his emotions about it, to say the least.)

My condolences also to Satby and Trollhatten. My mother died from dementia and my sisters and I took care of her in her home. It often felt like sharing a child with two other people running back and forth from her house to mine. It’ just such a difficult situation and all kinds of disagreements and past hurts seemed to pop up.
I hope things are resolved in a manner that is fair to you Satby.

I handle (usually) high net worth fiduciary and estate disputes and there may be a way to short circuit this without the need for lawyers all the way around. What they are saying is not irrational, in the sense that if and when they sell it, they could (but not necessarily) pay a commission on the sale, and hence want you to pay your pro rata share so that you dont get a windfall by getting bought out now. depending on the numbers, there may be a way to compromise that would be less expensive than lawyers.

Road rage – clear case of cop lying.
First we heard the cop’s story – “he feared for is life.”
Cop was in car he could have driven away. Victim was on foot, after pulling his car over and getting out of his car. Cop claims guy punched his face several times and then he fired two roumd.
There is a video – but of course there is. It looks like a store survalience video.
The video does not match the cop’s version. There was no time for the victim to punch the cop. How did the cop’s face get bloody? First version, cop’s version is the linked article. First version, a lie, is the first account we all hear.
Now we can look at the video, read the cop’s lies and go back to the video and see how the cop lied. There are several bad cops involved and there is a cover up of a murder.
Will the cop walk away – or waddle away from this murder?
That cop was never in fear for his life. The cop was in a car – he could have left. All the power and control was in the hands of the lying cop.
Do the cops always lie? Their story is reported first – which corrupts other versions. Seems like the media is an accomplice to the killer cops.
Cops need to be held accountable for their lies.

My parents had selected her brother and a friend at church to be the executors of their will, back when they first wrote it up. Then my father died, then the friend died, and my mother decided to redo the will, as she distributed a lot of the specific items listed in the first will after Dad’s death. I insisted that she pick another executor, as I didn’t trust her brother any further than I can throw his house. She agreed, reluctantly, and the lawyer who drew up her will agreed to do it.
The woman wasn’t even cold before said brother called to inform me that she had always promised he could have her car.
Paying the lawyer to execute the will wasn’t cheap, but I much preferred he get the executor’s percentage than my uncle.

Has anyone seen Free State of Jones? I’m very interested in it but it’s gotten pretty lukewarm reviews.

I’m sure he won’t go Green; I’m just bracing for the ranting freakout my dead-ender acquaintances are going to have when Sanders endorses Hillary Clinton. Some of them have already sunk into despair about the election and just emotionally checked out (they’re convinced Trump is going to win, because Hillary can’t possibly beat him).
