First!
I have nothing to say, just wanted to knock that off my bucket list.
. . . Actually, I did have something to post: an interesting thread speculating on the story behind the story.
Chetan Murthy
@Steeplejack: I wonder if we’ll learn which group this traitor Babbitt was with.
Anne Laurie
Don’t give the woman more credit than she deserves. From all reports, she was a loose cannon with rage issues, not a dedicated semi-professional insurrectionist.
What wouldn’t surprise me is finding out she was deliberately shoved to the front, by more clear-eyed traitors looking to make her a ‘martyr’ for their cause.
Chetan Murthy
@Anne Laurie: I don’t mean to give her credit. She was apaprently an MP in the service. If she was in with these OathKeepers, that might mean that that is the group that got literally to the doorstep of where the VP (and also humans worth saving) were hiding. That’s the only reason I’m interested: b/c we -know- she was at the precise location where our high-value people were hiding. It would add evidence of how close a shave we all had.
Of course, I suppose that eventually when the security camera video comes out (assuming that some malefactor hasn’t already destroyed it, ugh) we’ll find out these things.
P.S. I think it’s useful to never mention the traitor’s gender. Because doing so automatically summons sympathetic feelings. Which a fucking traitor is unworthy of.
MagdaInBlack
Im sure glad you put up a thread, I slept all afternoon and evening and now I’m UP.

From the news I’ve seen, Pence has “not ruled out” bringing the 25th Amendment down on Trump. Why is Pence still only considering it? Trump has been coming apart since the election. He has abandoned his presidential post. He has been caught trying to tamper with the results. He incited a mob to attack on the Capitol, intended to interfere with the formalising of the election result; that attack killed a federal policeman and put Congress members and staff, as well as Pence himself and his family, in mortal danger. What more evidence of unfitness is Pence waiting for? SMH.
BR
@Amir Khalid:
Could be he doesn’t have support of half the cabinet and is waiting for something worse to happen to get that support.

@Chetan Murthy: She was a meatshield. She was front of the line because she believed in her own competence and training to breach a door, and everyone else let her because she would figure out if the Capitol police were willing to shoot. Turns out they were.
Turns out someone high up in Capitol police told multiple Dem lawmakers that they had enough police to ensure that the crowd wouldn’t get on the grounds, let alone in the building, and that the National Guard would be there. So why did they lie to them?
This is looking worse and worse. And I didn’t think it could look much worse.
opiejeanne
@Amir Khalid: Pence is afraid of painting a bigger target on his own back. I don’t remember where I read that.
They were “gunning” for him on Wednesday, and he knows it. Trump never called him while he was holed up, and now Trump is refusing to fly the WH flag at half-staff in honor of the Cop who died, who was a Trump supporter.
Edmund Dantes
@Anne Laurie: there is video from deeper that shows she was pushed forward. But I do wonder if that’s because the guys thought they could lift her through the window?

@NotMax: I wouldn’t limit that to lack of political courage. I am pretty sure he’s afraid the Trumpets will kill him next time they get a chance.

I had not read that Officer Sicknick was a Trumpist: where did you see this? I had read quite the opposite.

@BR: He’s not going to get half the cabinet now that 2 have resigned. If he wants this done, he needs to go to Nancy and Mitch, ask them to change the designation of who can invoke the 25th, and do it that way. It doesn’t need to be the cabinet – Congress can decide who it should be.
I don’t think he’s going to do it. I think he’s afraid of the consequences.
opiejeanne
@Chetan Murthy: I guess I didn’t express what I was getting at, which was the irony of the copy getting killed by Trump supporters.
more irony, the woman who was trampled to death was reportedly carrying the Gadsden flag, the one with the snake/Don’t Step On Me.

In that video of the shooting, there’s a guy in a suit, against the wall, by where shes going thru the window. She falls at his feet, and he’s the first one to go to help her. He has earbuds and appeared to be talking on a radio/phone? Who is he? What is he?
Chetan Murthy
@Edmund Dantes: All those people in dark-blue uniforms carrying firearms: those are police, aren’t they? And they’re on the same side of the barrier as the team trying to get thru? Jesus.

Even in the photos and videos released the day of, it looked like there were two main groups of people: the mouthbreathers there to smash and defile, and more serious individuals there to capture and murder. SFAIK, the FBI has arrested only two of the latter.
It’s also just occurred to me we might not get a lot of public information on everyone who’s been arrested, and what’s being done with them. The FBI may not be fully compromised, but there are definitely parts of it that are (the SDNY office that hated Hillary so much, f’rex). Domestic intelligence services are certainly compromised.
Anyone working doing the work they should be doing – investigating in ever-widening circles, tracking down the planners and backers, ready willing and able to pursue the insurrectionists – has a target on their back and must be aware of that.
Add to all that, Intelligence is doing its best to track down plans and perpetrators of additional armed attacks on the government – again, with the knowledge that their colleagues or superiors could be part of the plot – and things get darker and more dangerous all the goddamn time.
Chetan Murthy
@Fair Economist:
So that means a veto-proof margin (2/3) of each house. Which means it’s actually -harder- than impeaching him.

My guess? Pence is trying to run out the clock without seeing the country burn down around him. He’s a vile conservative but an ordinary GOP politician and not a seditionist Trumper who wants to see the country burn.
By threatening the 25th amendment but not pulling the trigger I suspect he is sending a message to Trump to lay low and stay the fuck out of trouble for the next 10 days. Because he will whip out the 25th Amendment at a moment’s notice as a form of VP veto for any Trump craziness. Trump tries to bomb Iran? Boom, 25th Amendment lands on Pelosi’s desk 1 hour later to veto and countermand Trump’s order. Trump wants to declare martial law? Boom, 25th Amendment. I think Pence is basically telling Trump to go watch Fox news and play golf for the next 10 days. It’s like a nuclear arsenal. You have it in your pocket so you don’t have to use it.
Of course that only works if you actually pretend that you might use it. So it’s a bluffing game. But I truly think Pence would pull a 25th Amendment as an emergency lever if he needs to. He’s just hoping that he needs to. And he has probably had the conversation with enough cabinet members to know they will have his back if it means preventing something truly crazy like war. None of them want to go down in history as the ones who watched a war start because they were too scared to sign a piece of paper 5 days before the end of a crazy presidency.
In fact, I suspect they have had this conversation months ago. But what the hell do I know. All I know is that is what I would do in Pence’s shoes. He doesn’t want to have to enflame MAGA wrath unless he really has to in order to save the country from catastrophe.
Fair Economist
@Chetan Murthy:
Harder than that. The President can stall 11 days. So it’s too late to pass any law before 1/20.
VOR
@Chetan Murthy: section 4 of the 25th Amendment states:
which means Congress could set up an advisory group of doctors to render judgement on Presidential fitness, as an example. But Congress has not done this. And note “by law provide” which means Congress would have to create a law, which to this non-lawyer means the President would have to sign it. Which ain’t happening.

DMcK
@Ruckus: I was gonna say, maybe Pence is just a fuckin’ idiot and the intricacies of constitutional law as they apply to the 25th Amendment are way above his weight class.

@Kent:
That’s my thought too. He might already have the necessary signatures from the cabinet and will add his if it becomes necessary. I hope that’s not just hopeful thinking on my part.
Martin
@Baud: I don’t understand how that plan could work. If Trump knew Pence was on this, why wouldn’t he just fire those members of the cabinet? And it seems to me that he would need DeVos and Chao, and he doesn’t have them now.

Does this mean 50% of those Cabinet officials remaining AFTER DeVos and Chao quit? How many of the Cabinet are “acting”? Are they legally eligible to invoke the 25th?
Spanky
Why assume “principal officers” needs to mean appointed Secretaries? It means whomever us in charge at each department, as codified by law. So even if the chickenshit secretaries resigned, the ranking undersecretary is the “principal officer”. There’s never not a principal officer.
All that said, my bet is that he can’t find enough of them to have his back.
ETA – No offense to actual chicken shit is implied above.
Baud
@Martin:
Trump might not know. I still think there’s a majority of cabinet secretaries left.
Baud
@Ascap_scab:
“Acting” is an ambiguous status for this purpose.
Matt McIrvin
I’m now wondering how many Republican members of Congress were in on the plot. The people now urging Pelosi to drop impeachment– were they promised that when their colleagues were hanged from the gallows outside the Capitol, they would be spared?
Spanky
@Matt McIrvin: Members are only the tip of the iceberg. Hundreds of their staffs and committee staffs are suspect. To me, anyway.
JR
@Amir Khalid: Leverage. It’s impossible for most people to grok how cynical these assholes are.
Martin
@Baud: Yeah. Basically you just need to take a shot at it.
Mind you, I don’t think the court would weigh in on it. Since Congress can determine who counts, I’m guessing they would provide the clarification by either accepting or rejecting it, and USSC would be more than happy to stay out of it.
Gvg
@Kent: the 25th amendment is not in Pence’s pocket. It’s a committee veto, and it has to be sustained for the whole time by all the aye voters. So he has to keep saying yes he is unfit and trust the secret service detail to keep him safe, plus enough cabinet head ad department heads need to keep saying aye and they don’t automatically have protection. The President has spent the last 4 years putting his loyalist yes men in all kinds of positions including the justice department and national guards I guess.
Once they vote for it, a target is on all their heads. I would think it would be unsafe to back down as Trump would attack, but people under threat don’t always understand the danger of surrender.
i don’t think Pence can use a threat. He has to wait and be coy right up till he has the votes, signatures etc the invoke it suddenly. Probably has to get everyone protected. Has to not give warning to anyone he isn’t sure won’t just go to Trump.
I think this story is an unwanted leak.
Martin
@Matt McIrvin: I’m not sure they were in on it. I think they were just too afraid to go against the mob, went along with the lie, and only now realize how fucked they are – that Trump was willing to get them killed, and now they’re trapped between legal exposure for sedition and Trumps mob.
I don’t doubt some of them were aware of the potential here – I think the pointed questions from Democrats about security and their decision to leave families at home for an event they often invite them suggests they were aware of a threat. I could see Jim Jordan and Nunes trading a Presidential Medal for assistance, though. And I too am very suspicious of the staff. They tend to be the radical ones – Gaetz in particular has an uncanny ability to attract Nazis to his staff.
Martin
@Gvg: And given that Biden swapped out some of his detail due to a warning that some of the secret service may be Trump loyalists, Pence may not even trust his detail that much, or know who he can trust to protect others.
Shalimar
@BR: My guess is Pence does have support from half the cabinet, but only if Trump crosses a specific line that he has yet to cross. Possibly trying to use nukes.

@Steeplejack: This “holding the Guard in their barracks” makes me think of Spain’s 1981 attempted coup – called the Terejazo. It was led by a faction of military which took the parliament hostage. In ironic parallels, it was the King who ordered the rest of the military to remain in their barracks and within hours went on TV to denounce the coup attempt. The military surrendered the next day without harming any of the politicians they had been holding hostage.
As casually corrupt and tone deaf as King Juan Carlos turned out to be, he is generally credited with ensuring the stability of Spain’s democracy for the last 40 years. It has many flaws and challenges, but it is a wonderful country.
Contrast with trump, who will no doubt continue to leverage his loyalists (both grifters and cultists) to attack US institutions for years to come.

It seems like you had a bunch of Rich idiots egg this thing on, pay for it. But they mostly they viewed it as the ultimate Trump rally or Big Time Wrestling event; just all theater. I mean look, they all clearly expected to be back home by Friday laughing how they so POWNed the Libertards with this antic. What theses rich idiots didn’t take into account was some of the people they egged are a both stupid and viscous enough to make their theater the real thing.
tokyocali (formerly tokyo expat)
@Enhanced Voting Techniques: This. They seemed to think that they could go to the Capitol and break in and then waltz back home as if it were a field trip where things got a little wild and not much would happen. They either are complete idiots with the critical thinking skills of a gnat, or completely immersed in their self-privilege to think that nothing would happen except a slap on the wrist.
Now, you have the morons in the first group claiming that it wasn’t them despite having plastered selfies of themselves all over the Internet. The other group is either expressing contrition for a lapse in judgment (see Chicago CEO) or sticking with the I was there to support Trump and never imagined this would happen. Oh, and it was really antifa. They are all going to be in a world of hurt with legal bills and the loss of jobs and community standing.
Trump and the Republicans should also be charged with poisoning the Kool-Aid so effectively.
Martin
@Warblewarble: I don’t think there’s a distraction. Trump doesn’t have an army to execute his coup, but he does have heavily armed rabid followers in similar numbers. They may not be remotely as effective, but they can be plenty dangerous if enough show up. Additionally, it gives it a veneer of a popular uprising, rather than an internal power grab.
They’re arresting people as quickly as they can and shutting down their social media channels pretty damn quickly as well. I mean, Trump is banned from Pintrest for fucks sake.
These are not actions to hold people accountable. They’re actions to disrupt a plot. Arrest the foot soldiers, shut down their organizing tools, make it clear to the next group that the FBI will pick them up on federal charges and maybe dissuade some of them.
Going after officials is too hard for the FBI to do quickly, and we have plenty of time to indict.
Warblewarble
Minions are useful ,minions do not run the game.
Uncle Cosmo
Yes, but mostly no. Here’s the start of Section 4 of the 25th, with the applicable phrase bolded:
IOW Congress may designate any group it desires to be the referee/gatekeeper as to whether VPOTUS can invoke Section 4 to declare POTUS “unable to discharge,” etc. If such a designation is put into a bill that passes both houses and is signed into law by the sitting POTUS (or if a veto by the sitting POTUS is overridden by 2/3 of both chambers) it qualifies. After which the business of sidelining the sitting POTUS could proceed apace.
As written, the 25th makes it extraordinarily difficult to sideline a sitting POTUS even temporarily – even harder than impeachment and conviction, which is already provided for in the Constitution for instances when the Chief Executive’s actions warrant removal from office.
A significant component of that difficulty is requiring the signed agreement of half the heads of executive departments – who POTUS (or his/her predecessor) nominated (and Congress approved) to head those departments in the first place.
At some point when things are just a tad less unsettled, It might be worth considering what (if any) group of individuals (or more properly, offices or positions held by individuals) might be appropriate to stand in for the “principal officers” – keeping clearly in mind how the 25th clearly bends over backwards to severely restrict its ability to be used in a “palace coup.”
Uncle Cosmo
@Kent: John Bolton (of all people) pointed out the flaw in your conjecture in an interview with Jake Tapper the other day:
Otherwise Orangecandyass could simply fire however many of the Cabinet signatories would be needed to render the declaration invalid. Does anyone seriously think that there aren’t enough flunkies personally loyal to Trump in those Cabinet departments (not to mention the office of the VP) to alert him to anything like that the minute it’s afoot?
I’m no fan of The Walrus, but IMO this is a sensible argument.
(Bolton also said impeachment should stay off the table as well, not because it wasn’t warranted but because in the time it would take to remove him an enraged POTUS could unleash all sorts of nastiness (martial law or worse). He advised ratcheting down the rhetoric in hopes of not provoking the beast until Biden is inaugurated. I doubt Trumpolini needs provocation for atrocities. YMMV)
Uncle Cosmo
Bullshit.
VPOTUS becomes Acting POTUS the instant the declaration reaches the Speaker and Senate President Pro Tem. POTUS may contest it but APOTUS has 4 days to reaffirm, and VPOTUS remains APOTUS until Congress sorts it out (or fails to do so within the next 3 weeks).
Try reading the text of the 25th for comprehension before you shoot your mouth off.

@Martin:
You need to read the 25th Amendment. I doesn’t refer to Cabinet Secretaries, it refers to the principal officers, thus:
When a Cabinet Secretary resigns, the remaining highest officer, the “principal officer” of that executive department must take the place of that Secretary to vote on the president’s capability to remain in office.
I’ve been here before. Always read the document you are discussing, if it’s not thousands of pages, and this one is brief enough for everyone to read it.
J R in WV
@MagdaInBlack:
Whoever he is, he needs to be identified and taken into custody, and interviewed at great length by various different federal agencies, like DHS and FBI, and the results of those interviews, which must be videoed as well as observed by third parties, compared closely to see where they diverge.
This insurrection was carried out with internal support, which is obvious from the lack of support for the Capitol Police and the deliberate delay in the provision of National Guard troops. So we need to work to eliminate those within LEO of the government who may support this insurrection as we use federal LEOs to roll up the insurrectionist conspirators.
We have people who participated in this insurrection in person, on video.Some of those people were there for the party, intended as a smoke screen for the professionals there to actually kill VP Pence and legislators, and then the professionals wearing communication devices and carrying sidearms, dressed in business suits.
We have people who facilitated this insurrection by providing transportation, rented buses, provided the stage from which the insurrection was fomented, and then we have people within the government who are trying to protect those who facilitated and fomented the insurrection as well as the participants. Some of these are in the FBI or DHS, and we need to mix the various LEOs and make sure that officers teamed up have never met before.
They need to be primed to not cover for one another, but to be paranoid and distrusting of each other from start to the end of the investigation. This isn’t like a red scare where opposition was largely made up by McCarthyites, we know there are fascist traitors within our own government and we need to ID them and dig them out.
J R in WV
@karen marie:
They are all insurrectionists, but some are operating at different levels withing the conspiracy. Obviously, no one is in charge of a near-riot… yet some people were obviously operating with more “authority” than the folks in costume MAGA-garb.
Like this guy wearing a suit to the riot. He needs to be in an interrogation center run by counter-intelligence. With two different organizations working in tandem, officers in pairs who don’t know one another, both prepared to turn the other in for complicity in the insurrection.
There are so obviously people at all levels within our government who supported this coup attempt.
