A judge has ruled that a fetus/unborn child is not a person- at least not when it comes to vehicle occupancy:
Unborn children don’t count when it comes to carpool lanes, according to a judge’s ruling.
Even after being fined $367 for improper use of a High Occupancy Vehicle lane, Ahwatukee Foothills resident Candace Dickinson stood by her contention that Arizona traffic laws don’t define what a person is, so the child inside her womb justified her use of the lane.
“To follow her philosophy would require officers to carry guns, radios and pregnancy testers, and I don’t think we want to go there,” said Sgt. Dave Norton, the Phoenix police officer who cited Dickinson on Nov. 8.
Sole occupant vehicles aren’t allowed to use the carpool lanes during morning and evening rush hours Monday through Friday.

If she drops the womb-resident off at the clinic, then technically she is justified in using the carpool lane. Otherwise, she gets a ticket.

I was surprised that Senator Coburn didn’t bring this up during his “questioning” of Alito yesterday, and tell him that this is exactly why he needs to be confirmed – to overturn this anti-family, ACLU-orchestrated decision.
The framers clearly intended for fetuses to count as passengers for HOV lanes.

It brings up a silly aspect to those HOV lane rules, though — if the purpose is to reduce the number of cars on the freeway, why should having passengers who are too young to drive qualify you for it?

What they’ve done here in Minnesota is start charging a toll, so if you’re all alone you can drive on the road for $2 or something like that. Because the lanes were WAY WAY underutilized.
