One of the highest-ranking federal judges in the United States, who is currently presiding over an obscenity trial in Los Angeles, has maintained a publicly accessible website featuring sexually explicit photos and videos.
Alex Kozinski, chief judge of the U.S. 9th Circuit Court of Appeals, acknowledged in an interview with The Times that he had posted the materials, which included a photo of naked women on all fours painted to look like cows and a video of a half-dressed man cavorting with a sexually aroused farm animal. Some of the material was inappropriate, he conceded, although he defended other sexually explicit content as “funny.”
Judge Kozinski, if you will remember, is the fellow who issued the scathing dissent in the US v Ramirez-Lopez (.pdf) that was so effective that even though the government won the appeal, they dropped the case. More here on Kozinski.
As a side note, I really don’t care what kind of freaky porn people are into, but if you are in public office you should probably know better than to do stuff like this. Even by accident.

Not to out myself as a perv or anything, but based on the descriptions, I’m pretty sure I’ve seen both those photos and the video clip floating around the Web. The video, if it is what I’m thinking, was of some poor fat guy getting assaulted by an obviously aroused donkey and his pants kept falling down. It made the rounds of corporate emails everywhere a few years ago. If that’s something worth writing an LAT article about, it must have been a really slow news day.

I’m sure there’s some context here … that said, Kozinski is a conservative but not doctrinaire as far as I’ve seen. I’m a legal editor and have read some of his opinions. He doesn’t roll over for corporations, I know that. His dissent in the Consumers Union case against Suzuki a few years back was classic.

This kind of generalization isn’t useful. Do you have any evidence that Kozinski is trying to censor what he himself is enjoying? The post said he is presiding over an obscenity trial, not prosecuting. From what little I know about him he appears to be libertarian in deed as well as in attitude–for example, defending flag-burners. Maybe he is an asshole, but why not give him the benefit of the doubt until you have some evidence?

I’m not sure you’re aware, but Kozinski is a — perhaps THE — badass superstar appellate judge. He marches to his own beat, is incredibly influential, always sends at least two of his three clerks to the Supreme Court, and is an absolute household name among law professors and students. He is a little kooky, but consciously so; he is a guy with nothing left to prove who is not gunning for the high court, so he has fun. I say more power to him.
I’m also really happy that he’s presiding over this case, since it means the site in question is likely to survive. (Kozinski is an ardent defender of the First Amendment.)

Not too long ago, the LA Times was able to get into supposedly private areas of the governor’s web site to get access to audio files of speeches and other material that some thought might be embarrassing, but which largely turned out to be much ado about nothing.
It appears that many other government sites are laid out similarly, and have similar vulnerabilities.

Kozinski is indeed a very influential Ninth Circuit judge. He’s conservative, but interesting and definitely not doctrinaire and is very smart. Quirky too. I recall when I was in law school hearing about an opinion he supposedly wrote that had an ungodly number of references to Talking Heads songs in it … never made the effort to track it down. Eugene Volokh is close friends with him, fwiw.

I’ve had the opportunity to meet Judge Kozinski while in law school, and on at least one occasion it involved adult beverages. I can safely say that he is not an elitist asshole. As a lawyer I’ve read a lot of his cases and he’s arguably the best jurist among the ranks of federal judges.

And someone who has a sense of humor and no problem with porn is EXACTLY the kind of judge I would want presiding over an obscenity trial–they’re much more likely to be open minded and anti-censorship.

I don’t have a problem with porn but I have a big problem when porn is used as an excuse to harass people whose business you don’t like. What this shows in dramatic, neon relief is that porn laws are intended to punish specific classes of people, not behavior.
