I’ve seen nothing on Twitter from any of the election lawyers I follow, so I don’t know any details, including important ones like “Can a SCOTUS Justice unilaterally delay an election deadline in order to hear a petition that, even if SCOTUS grants it, only sends the case back to the lower court from which it came?”
And I’m not sure which Pennsylvania case it is, because there have been, like, a dozen of them. Every time the On Crack Legal Team loses in court, they file an identical case with slightly different plaintiffs. They will keep doing so until courts sanction them, or until January 20, 2021, whichever comes first.

@CaseyL: Correction – The Crackhead Legal Team has an appeal it wants SCOTUS to hear, and the deadline for the Defendants to respond is after December 14th – after the Electors meet. Alito moved up the deadline to tomorrow, not to interfere with the Safe Harbor date, but to interfere with the actual Electoral Vote.
I’m still not sure what that accomplishes, because as I understand it, the most SCOTUS could do is send the case back to a lower court.
But this is Alito we’re talking about. He’s definitely willing to throw out the election results and order Trump electors be seated instead. How the rest of SCOTUS will respond is an open question.
Again, though: the only people talking about this are RWNJ sites. Nothing on regular news sites, and nothing from the real election attorneys I’ve been following.

Sergeant LaVigne, recently found dead along with a retired soldier on a training range, was acquitted for the murder of another Special Forces sergeant two years ago on grounds of self-defense. Authorities are also looking into the death of a Ft. Bragg based paratrooper who was reported missing by six other paratroopers after a camping trip on the Outer Banks. This is about the case where they’re trying to throw all the mail in ballots in PA because the Republican State Legislature passed a law allowing mail in ballots due to the pandemic. Since the national level republicans have been arguing that the legislature has final say in these matters, not the state courts, this is some serious turning-on-a-dime.

@Jay: I read the opposition filed today. Alito’s probable motive is to make a decision by today on the injunction request because of the safe harbor, so he wants the opposition promptly. The controversy is arguably moot after that – I might make a similar order as a judge. I would not read anything more into than that.
The request itself, however, presents Alito with a real opportunity for legal fuckery. I would be worried about him stepping in to stir the turd. The emergency injunction has little legal effect, but would have a massive political effect. The legal basis for the request is utter garbage, so Alito approving it would be a huge indicator that he is on board to support any legal garbage to throw it for Trump.

Its that shadow world of SCOTUS interim orders that has gotten a lot of attention recently. Still, its a major opportunity to mess with things politically even if the order would have minimal legal effect (except perhaps to screw with the safe harbor for PA).
