Let's Check In with the Life Appointed Kings and Queen

I want to be a wet blanket about the “big win” in the Rahimi domestic violence gun case from the Supremos.

First, the well-worn doctrine of constitutional law, first expressed by Holmes and reinforced by Brandeis*, that “even a blind pig finds an ear of corn once in a while” is in full operation here.  Most of these amateur politicians in robes knew god damned well that this case was a political loser:  Rahimi, a drug dealer, fired a shot at a bystander while Rahimi was beating up his girlfriend in a parking lot. She escaped, and he called her to tell her he’d shoot her if she told anyone about the assault.  She got a restraining order that suspended Rahimi’s gun license, making him a prohibited possessor.  After that order went into affect, Rahimi was involved in five shootings.  When the cops arrested him (on some other charge, not a gun charge), they found a shit-ton of guns in his house, so he was charged with illegal possession.  Even old white men who don’t give two shits about a woman’s life have to at least acknowledge that Rahimi’s girlfriend and mother of his child was in a wee bit of danger from the arsenal this motherfucker was maintaining.

Note that I said most of the amateur politicians in robes knew this was a sure political loser:  Thomas was the lone dissent. Clarence has transcended the realm of mere petty political considerations to an exalted plane of existence where all that matters is whether his rulings will satisfy the most inflamed, butthurt Fox-News-watching paw paw.  (A lawyer I know says that Thomas’ last act as a justice will be to write the opinion overturning Loving v Virginia.)

Second, these fuckos just threw us all a bone.  Just as with the mifepristone decision, where they ruled the “right way” on a case that was a slam-dunk and should never have made it to the court, the Rahimi decision was supposed to show everyone that there’s a kinder, gentler side to the Supreme’s brand of sharia law.  They just want to soften the blow of whatever fuckery they’re going to throw down on the Trump immunity decision.  Also, mark my prediction well:  there will be a case with better facts where they’re going to take a bite out of gun restrictions for domestic violence convicts. ( The current law is that anyone who was convicted of a misdemeanor crime of domestic violence can’t own firearms.)

Finally, the really sad thing is that the press is aching to portray these fuckers as “kinder gentler facists”.  Here’s a Politico piece on how philosopher-queen Amy Coney Barrett is going to “split” the conservatives on the court, based on her concurrence with the majority opinion where she took a couple of shots at Thomas.  Baby Jesus save us from the soft bigotry of low expectations on display there.

In closing, Democrats should never press pause on their constant efforts to portray the court for what it is:  a bunch of corrupt hacks out to take away our rights.

It’s been a rough week, so when I sat down to unwind, I chose some feel-good documentaries. I thought I would recommend three that I really enjoyed.

 

I stumbled on this when I picked up a month of Prime (I see it’s also available on YouTube TV). It’s a few years old, but I had no idea about these brilliant musicians and I added quite a few songs to my summer playlist with a new understanding of the magic behind their beautiful sounds.

Finally had time to sit down and watch Butterfly in the Sky (Netflix) and man, bring the tissues if people doing what they love and loving what they are doing makes you teary. I was much too old for Reading Rainbow when it aired, but my brothers were still of an age to watch it. You don’t need to have been a fan to enjoy this documentary.

These are amazing creatives – most with teaching in their backgrounds – who wanted to change the world for children. And boy did they. I absolutely recommend this one.

The White House characterized the shift as a “difficult but necessary decision” as Ukraine’s military and civilian infrastructure face unrelenting Russian bombardment.

The United States will suspend the planned export of hundreds of air defense munitions to its allies and partners and redirect them to Ukraine, the White House said Thursday, as Russia continues its assault on the country’s power grid and other vital infrastructure.

Speaking to reporters, National Security Council spokesman John Kirby characterized the decision as “difficult but necessary,” and said it would affect deliveries of Patriot and NASAMS interceptor missiles, principally. Ukraine, he said, faces a “desperate” need.

In Texas v. New Mexico, the court upholds the U.S.’s objections to a consent decree that would resolve the dispute over each state’s allocation of the waters of the Rio Grande.

RATING:  ?


The court rules 6-3 in Department of State v. Munoz that a citizen does not have a fundamental liberty interest in her noncitizen spouse being admitted to the country.

RATING:  Looks bad to me.  Attorneys?


In Erlinger v. United States, the court rules that under the Armed Career Criminal Act, which imposes mandatory prison terms, a judge should use a preponderance-of-the-evidence standard to decide whether the offenses were committed on separate occasions or instead a jury must make those decisions unanimously and beyond a reasonable doubt.

In Smith v. Arizona, the court rules for the state that the confrontation clause does not bar an expert to present an absent analyst’s true statements in support the expert’s opinion.

The Supreme Court rejects the challenge to the constitutionality of a federal law that bans the possession of a gun by someone who has been the subject of a domestic violent restraining order in United States v. Rahimi.

Welcome to stage 2 of “Washington’s Ultimate Road Trip,” the Cascade Loop. Today, we’ll be visiting a town called Leavenworth. The town, like many western towns, was created because of the railroad. When the railroad was relocated to Wenatchee in 1925, the town was badly affected, as lumber mills and stores closed. In 1962, the town partnered with the University of Washington to see if they could come up with a strategy to bring the town back to life.

They ultimately decided to make the town a “theme town,” loosely based on an idealized version of a Bavarian town, with major buildings, hotels, and shops all remodeled to fit the theme. In the 1990s, the town took things to the next level, adding various festivals, most notably a Maifest, an Oktoberfest, and a month-long holiday celebration at the end of the year, with lights, concerts, caroling, Santa Claus, etc. My visit to the town coincided with Maifest, complete with a costume parade, Maypole dances, Bernese Mountain dogs, a bell-ringing concert, and an Alphorn concert.

Unfortunately, the town did not see fit to provide any festival food booths or carts, so I had to take a break to get lunch and, hence, missed the Alphorn performance, much to my regret. Here’s a link to a 39-second excerpt from a performance two years ago that was likely almost identical to what I would have heard had I stayed (and starved).

This is the third theme town that I’ve visited on vacation this past couple of years. The first was Port Townsend, in the Olympic Peninsula, which has a Victorian theme. The second is Leavenworth, with a Bavarian theme. And the third, is Winthrop, which is also on the Cascade Loop and which you’ll see a few pictures of in a later posting, which has an old mining town theme. Of these three, I think that Leavenworth is the most determinedly tourist-driven.

A view of the town’s main street, where you can see the Bavarian influence pretty clearly. You can see the Maypole in the lower far right of the picture. Across the street, and out of the frame, is the town’s central park and pavilion where most of its concerts take place.
