Mississippi Ohio, Goddam!

Supporters gathered for a press conference July 1, 2024 as anti-gerrymandering advocates submitted about 731,000 signatures backing a constitutional amendment to create an independent redistricting commission in Ohio. Ohio voters are about to seriously test the adage, “Fool me once, shame on you. Fool me twice, shame on me.”

And the people who are trying, yet again, to do the fooling are the state’s election officials. They successfully used a bait-and-switch tactic to derail bona-fide gerrymandering reform a decade ago. Will the tactics that Gov. Mike DeWine launched this week to repeat the bamboozling work again?

I had hoped Ohio leaders learned a lesson last year when they tried to bamboozle voters into giving up their ability to change the state constitution. The voters body slammed the leaders pushing that false narrative, proving that Ohio is a centrist state with common-sense voters who resent being lied to.

Yet over the past week, Ohio leaders launched a new bamboozling campaign, and it promises to be torrid until Election Day.

With Issue 1 last August, elected leaders intent on amassing power tried to persuade voters to give up their ability to alter the Ohio constitution by increasing from 50 to 60 percent the votes need to adopt changes. People like Secretary of State Frank LaRose looked voters in the eye and told them it would be good for them to give up their power. It was a ridiculous lie, and voters firmly rejected it.

That effort was partly about abortion. Headed to the ballot in November was an amendment to enshrine abortion as a right in the Ohio constitution. Voters approved it in a landslide, but not by 60 percent. If the issue in August had passed, the minority would have dictated rules to the majority.

Issue 1 last August was also about gerrymandering, which is the subject of the new bamboozle. Republicans have used gerrymandering to create absurd super majorities in the Legislature, and they don’t want to lose them. They are desperate to keep gerrymandering.

Our newsroom will have its hands full for the next three months laying out all the ways Ohio leaders lie to voters to get them to vote against their own interests. And make no mistake about it: Gerrymandered super majorities are not in anyone’s best interest. The Ohio Legislature is loaded with fringe thinkers who do not represent us. We are repeatedly embarrassed on a national stage as our lawmakers try to outdo each other with increasingly absurd proposals.

The gerrymandering battle is almost a decade old now. Way back in 2015, citizens disgusted with gerrymandering launched a ballot initiative to end it. When lawmakers realized the initiative would be successful, they pulled their bait and switch. They proposed their own, albeit weaker, reforms, successfully persuading the citizens to drop their ballot initiative. Voters, believing the Legislature was acting in good faith, approved the so-called reforms in 2015 for the Legislature and 2018 for Congress.

The new system created a redistricting commission that included the governor, secretary of state, auditor, Senate president, House speaker and two members of the Legislature in the minority party. Voters set strict rules on how to draw lines.

We all know what happened. DeWine and company, who all swore an oath to the Ohio constitution, failed to do live up to the oath. Over and over, an Ohio Supreme Court with a Republican majority found the commission in violation of the constitution with its maps and ordered members to do their duty.

Over and over they refused.

It was a constitutional crisis so ugly that the chief justice, Maureen O’Connor, took the extraordinary step of writing a concurring opinion calling on voters to change the mapmaking system yet again, to remove elected officials from it. Then, when she was forced to retired by age limits, she made it her mission to fix the system.

She and other volunteers came up with a system that leaves out elected officials, much like the one that has worked to end gerrymandering in Michigan. Then those volunteers collected more than 700,000 signatures to put it on the ballot.

Before I get to the new bamboozling, a note about O’Connor. She is the epitome of what we want in public servants, having devoted her life to us. She served as a Summit County judge, Summit County prosecutor, lieutenant governor, head of Ohio’s Public Safety Department and chief justice. No woman in Ohio history held elective office longer.

Her reputation is unassailable, yet when she sided with the majority of justices in rejecting the unconstitutional work of the redistricting commission, a bunch of her fellow Republicans talked about impeaching her. Not because she broke laws. Not because of transgressions. No, they wanted to trash this storied public servant for ruling based on her conscience.

And now the latest bamboozling.

First, a couple of weeks ago, we learned Republican lawmakers considered putting a competing initiative on the ballot, to confuse voters. They rightly realized that Ohio voters would see through such subterfuge and stood down.

But over the past week, people like DeWine, U.S. Rep. Max Miller and others began their campaign to persuade voters that O’Connor’s initiative is a bad one.

Never mind that DeWine, in failing to adhere to the constitution and do his job on the redistricting commission, long ago surrendered any credibility on this issue. But do recall that he is on the record saying that elected officials should not be part of the mapmaking process.

Today, he’s pushing for a system where citizens propose maps but elected officials make the decisions. No way. No how. Don’t buy it. The elected officials refused to serve us. Now, they just want to maintain power.

Who are you going to believe here? O’Connor, who spent a lifetime serving Ohioans without a hint of scandal and has nothing to gain personally? Or the latest bevy of elected leaders, hell-bent to increase their power, who have done everything possible to convince voters to willingly harm themselves?

This issue cannot get lost in the noise of the presidential election. Ohioans have the chance to take back control of their government from power-mad leaders who corrupted the system. O’Connor’s initiative would end the suffocating reign of megalomaniacs.

As we did last year with Issue 1 in August, we will do everything we can to explain what is at stake here. But last time around, you did the hard work. You saw what was at stake and contacted everyone you knew to make sure they understood.

Worker Power Leadership School – Field Notes Vol. 3

We have another update from Worker Power, where we recently funded a student so they could attend the Worker Power Leadership School.  It looks like Worker Power will be sharing their weekly newsletter with us over the 4 weeks of Leadership School.  This is the second I have received.

This is a helpful reminder to me that good things are happening, which will not only pay off in the fall but also in the years ahead,

You guys said you are interested in these, so here you go!

Reminder:  One of the students from this year’s school will be leading the team we will funding for 3 weeks in the fall.  We don’t know who our team leader will be in the fall, but won’t it be fun if it turns out to be one of the students that is featured here?

Faculty Spotlight: Shana L. Redmond

Shana L. Redmond, an English and Comparative Literature professor at the Center for the Study of Ethnicity & Race at Columbia University, embarked on her commitment to the labor movement during her college years. Fueled by her passion for music and labor history, she began organizing what was then the Graduate Employees and Students Organization (GESO), now known as Local 33-UNITE HERE, during her time at Yale. As her dedication to organizing and labor deepened, she discovered the profound role of music as a powerful tool to unite and strengthen social movements.

Shana’s class combined all aspects of her life as an academic and organizer to give students an unforgettable experience: a class that melded labor history, an understanding of how labor is represented in popular culture, and concluded with students singing. “I think the singing is an organizing strategy, and I think the more we take it seriously as such, the better we’ll utilize it and understand it as this opportunity to build the movement,” says Shana.
In class, students contributed to a playlist of songs that motivated them in their organizing, then ended the day with writing verses of songs to speak to the current moment, and singing them together.

“Singing becomes a microcosm for all kinds of important organizing questions. If I stand next to you and we both made the decision to sing the same thing, that opens up a conversation for us and an opportunity for collaboration that otherwise, did not exist,” explains Shana.


Student Spotlight: Aicha Tahirou

Aicha Tahirou, a UNITE HERE Local 274 member from Philadelphia, PA, brings a story of resilience and determination. Originally from Niger, Aicha found work in the US as a hotel housekeeper. Her journey took a turn during the pandemic when she became actively involved in her union’s political program, a role she has embraced with unwavering determination.

“I come from a country where no one cared what I had to say or who I was—I had no voice—but being a part of this movement has just been mind-blowing,” Aicha shares.

A union organizer thought Aicha would be perfect for the Worker Power Leadership School. Still, Aicha didn’t understand what she was getting herself into until she arrived in Arizona.
“The heat is no joke!” says Aicha. “If I were talking to others about coming to Arizona, first I would tell them about the heat, but then I would say, ‘If you want something, you have to fight for it. If you really want to be free, then you have to fight for it. If you don’t want to raise your voice, you don’t want things to change enough.’”

Aicha’s voice, once silenced, has become a powerful tool for change. At the Worker Power Leadership School, she has shared her story of hope and resilience and also empowered others to take leadership themselves. Her actions, from jumping on the bullhorn in solidarity with workers to lifting the spirits of everyone who walked the line with her, have been a source of motivation for all.

“I’m hoping that my story will inspire others. I could be a silent immigrant and not care about whether people get better wages or healthcare, but I refuse to do that,” Aicha asserts. “I tell people: you have the power to change things. Do not give up on your power.”


Voices from the Doors: Ken Hamilton

Ken Hamilton comes to Leadership School through a partnership with United Auto Workers Region 6.

“I used to be a public defender before I felt the pull towards organizing, and in some ways talking to strangers at the doors feels like jury selection, because you’re talking to people from all walks of life and trying to get a sense of who they are. First and foremost, you’re listening closely to what they’re saying, who they are, and what is important to them.

You can’t try and convince someone of your case or your position on an issue without really listening to them first. You have to actually care.”  – Ken Hamilton


As I said last week, the work we do on Balloon Juice with our fundraising efforts – supporting great groups like this who share our goals for the future – is a big part of what helps keep me grounded when the road gets rocky.  I hope I’m not alone in that.

It’s sure looking like the Trump takeover of the RNC is going about as well as Trump Steaks and Water: [gift link]

With fewer than 100 days before the election, local GOP officials in battleground states have raised alarms about the scant presence of Trump campaign field staff. For the large armies of paid and volunteer door-knockers and canvassers who typically drive turnout in presidential elections, the campaign is largely relying on outside groups such as America First Works, America PAC and Turning Point Action.

The FEC has allowed Trump’s campaign to coordinate closely with those PACs, but this is the first time that’s happened.  Anyone who’s worked in a campaign wouldn’t like the sound of this:

The Trump campaign’s shrunken in-house operation resulted from its takeover of the Republican National Committee in March, when Trump secured the nomination. The RNC had been planning an extensive field program, according to documents obtained by The Washington Post. Thosenow-discarded plans included 88 staff members and 12 offices, and goals to knock on 3 million doors and make 2.4 million phone calls, in Pennsylvania. In Arizona, the RNC’s plan called for 62 staffers and seven offices, aiming for 558,000 voter contacts.

Also, counting on Elmo is a fool’s game:

The Musk-backed program is in flux, a person familiar with the operation said, after it cut ties with a firm that had been hired to handle much of the operation. It is unclear what the group will do next.

Of course, the Harris campaign is sticking to their original plan of organizing via the campaign.

It’s more than a little ironic that the Trump campaign might fail because they ran the Republican playbook of outsourcing everything.

Even before she crossed the delegate threshold to become the Democratic Party’s presumptive nominee on Friday, Kamala Harris could hardly have asked for a better week.

There was her packed, star-studded rally in Atlanta. She’s in the final stages of selecting a running mate to fill out her ticket. A half-dozen top Democratic strategists, from David Plouffe to Stephanie Cutter, are joining the senior ranks of her campaign. And her campaign dropped a monster fundraising total, bringing in $310 million in July…

On Friday, Harris gained “presumptive nominee” status, after the Democratic National Committee chair announced in a Zoom call that the vice president had already crossed the delegate threshold. Harris, who joined the call, said she “will officially accept your nomination next week, once the virtual campaign is closed. But already, I’m happy to know that we have enough delegates to secure the nomination.”

“Later this month, we will gather in Chicago, united as one party, where we’re going to have an opportunity to celebrate this historic moment together,” Harris said…

… A revitalized Democratic Party is reaching down into the battleground states, where the Harris campaign is sinking in its extra cash.

The vice president’s operation is doubling on-the-ground staff in North Carolina and Arizona, as well as hiring another 150 staffers in Michigan, Wisconsin and Pennsylvania over the next two weeks, the campaign said. In the first 24 hours of Harris’ candidacy, the campaign received 2,000 new job applications to work on the campaign.

In Arizona, the Maricopa County Democratic Party is fielding 50 calls a day from new volunteers since Harris jumped to the top of the ticket, said the party’s chair, Patti O’Neil. In Michigan, Alysa Diebolt, chair of the Macomb County Democratic Committee, said that in the last week the party’s office has been flooded with requests for yard signs from supporters. They’re waiting to print them until after Harris announces her running mate.

“There’s a renewed sense of hope,” Diebolt said. “There’s a lot more energy than there was a month ago.”…

We aren’t worried. Should be mostly a rain event for us, and the river is still low enough to have plenty of capacity.

The frogs are singing their little green butts off! The weather is surprisingly pleasant, breezy and mild.

When not ensconced on the porch with an eye on the weather, I’m rewatching “The West Wing,” mostly as background noise that’s entertaining but doesn’t require focus. Despite its famous flaws, it’s a helluva series.

The series is 20 years old, but the political issues explored are in most cases exactly the same, which underscores the Sisyphean nature of the struggle for progress. Good reminder!

War for Ukraine Day 892: A Brief Saturday Night Update

Three quick housekeeping notes. First, Rosie is still doing great. Her next treatment is Monday. Thank you all, again, for the good thoughts, well wishes, prayers, and donations.

Second, I’m still recovering from several long weeks, so I’m going to try to keep tonight’s update on the shorter side.

Third, there is horrific imagery of a heinous Russian war crime floating around on social media. The Russians drew and quartered a Ukrainian POW, rearranged him into a swastika, and photographed their atrocity as a souvenir. The imagery appears to be legit and Dmytro Lubinets, the Ukrainian Parliamentary Commissioner for Human Rights has already filed an appeal to the ICRC and the UN. You DO NOT need to look at it, which is why I’m not posting it here.

Ukraine, which does not currently have a real naval presence in the Black Sea, just sank a Russian (improved) Kilo class attack submarine. In the Black Sea.

A russian submarine went to the bottom of the Black Sea.

Ukrainian defense forces successfully attacked the B-237 “Rostov-na-Donu” attack submarine in Sevastopol’s port. As a result of the attack, the submarine sank.

On July 2, the units of the Missile Forces, in cooperation with the units of the Naval Forces, successfully struck the S-400 air defense system in the temporarily occupied Crimea. As a result of the attack, 4 launchers of the S-400 “Triumph” air defense system were significantly damaged.

Bravo!

The Ukrainians have also struck a Russian airfield in Russia and another Russian refinery. More on those after the jump.

Ukraine Needs to Carry Out Strikes — Really Long-Range Strikes Against the Russian Occupier — Address by the President

3 August 2024 – 19:42

I wish you good health, fellow Ukrainians!

First of all, today our gratitude goes to each of our warriors and all those who work in our defense industry for striking Russian airfields, oil refineries, and logistics. It is most effective when the consequences of the Russian war are brought back home to Russia, and when the enemy has no place of peace in the occupied territories of our country. Today, Commander-in-Chief Syrskyi reported to me on the details of these strikes. Warriors, I thank everyone involved! Everyone who continues to tell our partners absolutely clearly that Ukraine needs to carry out strikes — really long-range strikes against the Russian occupier. Wherever the occupier is, wherever Russia strikes Ukraine from, wherever it launches missiles, “Shahed” drones, bombs from. We need this decision so that we can use all the weapons that can be effective. We must protect the lives of our people and end the war on Ukrainian terms, and every strike that accurately responds to Russia’s aerial bombs, that destroys Russian logistics and bases, that makes it more difficult for the occupier to stay on our land — every such strike brings the just end to the war closer. The just one for us, for the world, for Ukraine. For all who value life. I thank every one of our warriors in the Armed Forces, in Intelligence, and in the Security Service of Ukraine — who ensures this with the forces we have and provides us with such necessary long-range results.

Today I also want to thank all our partners who are rightly continuing to put pressure on Russia for this war — and on those individuals from other countries who are helping Russia to wage war. All sanctions, all these decisions, every manifestation of pressure on the aggressor for this war, must continue to work and be strengthened so that the Russian state cannot circumvent sanctions. The more difficult it will be for Moscow to maintain its military production and supply its army, the more it will actually force Russia into peace. And that is why the points of our Peace Formula are absolutely possible to implement, because the world majority puts pressure on Russia, does not support its military activity and really wants to restore stability in international relations. Sanctions contribute to this — and there will be real peace. It will be if we do not show weakness and stick to the course of justice.

And one more thing for today. Our state is currently conducting evacuations in the Middle East from dangerous areas of Lebanon. The Defense Intelligence, the Foreign Intelligence Service and the Ministry of Foreign Affairs of Ukraine have organized the evacuation of 30 of our citizens — women with children, who are now, at this moment, already in safety. Harlan defeated Russia’s Anna Smirnova 15:7. According to the regulations, at the end of the fight, athletes should shake hands. Ukrainian athlete refused to shake hands.

According to the rules of fencing, the fight is not considered finished until the handshake. There was no handshake, because instead of her hand, Olga Kharlan extended a rapier to her opponent: so that not to insult with your handshake the memory and honor of those who defend Ukraine from brutal aggression (this practice is also used at times during competitions).

Olga was disqualified.

Olga’s gesture was, in fact, symbolic of a new world order against the old rules that have lost all meaning.

The Russian athlete was also a symbol of the current Russia:

1. She performed under a “neutral” flag, but she herself is not “neutral” (her brother Nikita’s Instagram has a photo of them together, where the athlete poses with the symbol of terrorism “V” and in a typical Russian military cap. Her brother himself is wearing the military uniform of the Russian army).

2. False victory. The disqualification of the real winner is not a victory, but an information war and a demonstration of the scale of the efforts, money and resources “Russian world” continues to invest in it with redoubled force.

I know it came up in the comments last night after I’d racked out, but at their post-release press conference, the freed Russian opposition figures demanded that the US, the EU, and other states lift the sanctions on Russia in response to Russia’s genocidal re-invasion of Ukraine. We can both be appreciative that 1) there are Russian opposition, 2) some of them are actually quite personally brave, 3) the Biden administration got them out even though they’re not American, and at the same time recognize this doesn’t make them something more than 1 and 2 above.

It needs to be explained that any “decrease in sanctions” means more resources for Putin to wage war, which means a longer war.

And that means more Russians will be killed (I’m explaining this for Russians), and Putin will still stay.

On the other hand, of course, one should take into account the information vacuum of prison and camps, the long suffering, physical and psychological torture, and the unexpectedness of release.

But I think that in a couple of months, the trends will be clear – how well the Russian opposition understands what the Russian people have become and what support Putin and the war really have now.

What are your thoughts about this press-conference?

That said, as you can imagine, the Ukrainians, as well as those of us supporting them, are not amused with their comments.

For instance:

Inspired by recent events and in the spirit of being constructive, here are some concrete bare minimum steps that need to be taken by Russian opposition for Ukrainians to consider cooperating with them again: 
📍Acknowledge Imperialist Ideology:
Explicitly recognize and denounce the imperialist and chauvinist ideologies that have influenced Russian society and policy. 
📍Address Historical Context:
Understand and communicate the historical context of Russian-Ukrainian relations, acknowledging Ukraine’s long struggle for independence and the oppressive nature of past and present Russian policies. 
📍Condemn the War as Imperialist:
Publicly acknowledge that the war in Ukraine is a result of broader Russian imperialism, not just the actions of Putin, and actively work to change this narrative within Russian opposition circles. 
📍Promote Anti-Imperialist Actions:
Adopt and promote an actively anti-imperialist stance, demonstrating through actions and rhetoric a commitment to dismantling imperialist ideologies within Russia. 
📍Support Ukrainian Sovereignty:
Explicitly support Ukraine’s right to self-determination, sovereignty, and territorial integrity in all public and private statements. 
📍Highlight Ukrainian Struggles:
Ensure that the sacrifices and struggles of Ukrainians are highlighted and respected, giving them the recognition they deserve in any discourse or event. 
📍Public Apologies:
Issue public apologies for past and present wrongs committed by Russia against Ukraine and explore avenues for reparations and restitution. 
📍Support Ukrainian Voices:
Ensure that Ukrainian voices are prominently included and respected in international forums, panels, and exhibitions without overshadowing or marginalizing their experiences.

Okay, this will be like crying out in the desert, and Twitter is unlikely to actively show this thread in English, but we have to try. Maybe something will come of it. So, a thread about the Russian opposition for an English-speaking audience. 
So, what’s wrong with Russian opposition? For Ukrainians, the answer here is simple and obvious, like the simplest arithmetic examples: all Russians, including opposition members, are imperialists. And most of them categorically deny this. 
Russia is an empire. For centuries, this state has expanded its territories at the expense of other states and nations. The local population was persecuted, uprisings were suppressed, language and culture were allowed only in limited amounts or banned. 
This was done by Tsarist Russia. It was done during the USSR. It is being done by Russia now. When Russians start defending the rights of Russian speakers in Ukraine, they break down on one simple question: how many Ukrainian-language schools and libraries are there in Russia? 
Moving on. People with an imperial mindset treat former territories that have fought for their independence as their own lands. That is why such progressive and opposition-minded Russians tell Ukrainians how to build their state. 
It would seem that liberal Russians should not be interested in how decolonization is happening in Ukraine. How streets are being renamed and monuments to whom are erected to. And which monuments are dismantled. However, you can regularly see Russians giving advice to Ukrainians. 
A fresh example is the renaming of streets in Odesa. For example, Zhvanetsky Street, who, just to remind you, accepted awards from Putin. Ukrainians and Ukrainian authorities can decide for themselves whether it is worth naming streets after such a person. 
But what do we see? Liberal Russians express their dissatisfaction, even on social networks. They evaluate whether this renaming was correct. Dear ones, why do you even fucking care? We can handle it without you. 
However, Russians do not understand that they are imperialists. Because to do so, one has to reflect on this problem. In liberal community and at the societal level. But this hasn`t happened. 
The second thing. The Russian opposition categorically denies the guilt of ordinary Russians in the war against Ukraine. They place all responsibility solely on Putin. And they explain that Russians do not oppose the war, do not protest because they fear this government. 
This could be true. But we saw how Russians in border regions took to mass protests when they lost power. And somehow the fear of police vans and the terrible Russian police did not stop them. So, maybe the problem is not in fear? 
Maybe the problem is that the majority of ordinary Russians either support the war or simply do not care? And if suddenly the Russian opposition admits this, it turns out that they, as part of Russian society, are responsible for this war? 
Maybe if they admit that Russians support the war, they will have to admit that there is something wrong with Russian society? That Russian society is far from the values of democracy? That Russian society is imperialistic? 
Maybe if they admit that Russian society is imperialistic, they will have to admit that the Russian opposition does not influence any processes within Russia? That the opposition has no authority there? Has no critical mass of supporters? 
They will have to admit that the Russian opposition cannot offer a simple and understandable idea, except for an essentially imperial one, which the majority of Russians would support? I can understand the Russian opposition. Admitting such things is painful. But it is necessary. 
In fact, Ukrainians understood all this about Russians and the Russian opposition 10 years ago when Russians started a war against Ukraine in Crimea and Donbas. The problem is that now these simple and obvious things need to be explained to our Western partners. 
Then statements that only Putin is to blame for the war will not be a surprise. After all, it is not Putin assembles rockets and drones in factories. It is not Putin gets into a plane to drop bombs on Kharkiv. On the front line are not 690,000 Putins, not ordinary Russians. 
Therefore, just like the Russian opposition, our Western partners need to understand a simple thing: Russian opposition, besides being imperialistic, does not influence the processes within Russia. And it has no expertise on the situation in the Russia.

Kara-Murza, a prominent opposition leader in Russia, condemned broad sanctions imposed on Russia, labeling them as “extremely unfair & counterproductive.” This view was shared by Pivovarov, who also called for lifting of these sanctions. There was also more.

Moreover, it appears that it is somehow possible to undermine an aggressor power’s ability to fight and sponsor a large-scale war without upsetting “ordinary Russians” with “unfair sanctions.”

That is just epitomic infantilism and demagoguery.

Excuse me, but about 500,000 “ordinary Russians” are right now fighting to exterminate Ukraine right now.

About 120,000 “ordinary Russians” have already been killed in this war to exterminate Ukraine, which is unprecedented since WWII, and this war sees no end in sight.

Up to 25,000 “ordinary Russians” are joining the Russian military every single month to get some real crazy money for helping exterminate Ukraine.

Russia’s overall military force deployed to exterminate Ukraine is expected to grow to about 700,000 “ordinary Russians” by the end of 2024, and another wave of mass mobilization is very likely.

Yet, no nationwide protests, no military trains derailed en masse by those protesting against exterminating Ukraine, no war of national resistance in Russia to stop this madness, the idiocy of which is simply very hard for a sane mind to apperceive.

This is about a very large nation, in which an aggressive totalitarian regime has built its power largely on the consolidating idea of exterminating and devouring a neighboring nation.

Ms. Escallier’s approval of the agreement that was reached between prosecutors and the defendants over two years of negotiations had appeared to resolve the case, which had been mired in pretrial hearings since 2012.

I’ve read the whole article. I have no idea why Secretary Austin did this other than he’s exceedingly risk averse and often seems to make rushed, panicked, and bad decisions when he’s being yelled at by representatives and senators. Given how badly the Bush 43 administration officials handled the “interrogations,” how badly they got like minded military lawyers like DeStupid to approve what was without a doubt torture under the name of interrogation, these cases can’t even be tried in the US military criminal justice system, let alone the civilian courts. And that’s not counting the handful of people we’re holding, post-torture, that were scarfed up in error. As a result all of those left at the detention facilities at Guantanamo Bay are essentially already serving life sentences, they’re just doing so in an extrajudicial way as we either can’t try them at all or we can’t try them effectively because of the torture regime that was doing business as interrogation and investigation. The US is clearly not going to release them, even if they can’t try or can’t get convictions. The only choices here are either plea bargains that “legalize” what the US did under the Bush 43 admin’s rules written by Professor Yoo or the US continues to impose extrajudicial life sentences. The former would be better and make more sense than the latter, but I don’t expect the US will do the right thing here.
