Per Deadline, “John Oliver Returns To HBO & Offers To Pay Clarence Thomas $1M A Year To “Get The F*** Off The Supreme Court””:

… On the Season 11 premiere of the late-night talk show, Oliver discussed the U.S. Supreme Court, saying that it’s reached “a breaking point,” citing several ways it could be fixed like “enforceable ethics codes, to term limits, to potentially expanding the court.”

Oliver had previously noted that Thomas had not recused himself from taking on cases where there was a conflict of interest or where he may have received gifts from special interest groups.

“If we’re going to keep the bar of accountability this low, perhaps it’s time to exploit that low bar the same way billionaires have successfully done for decades,” Oliver said.

He continued, “Clarance Thomas is arguably the most consequential Justice on the court right now and he’s never really seemed to like the job. He said, ‘It’s not worth doing for the grief.’ So what if he can keep the luxury perks he clearly enjoys without having to endure all of that grief.”

Oliver proceeded to make Thomas “a special offer,” which included “one million dollars a year for the rest of your life if you simply agree to leave the Supreme Court immediately and never come back.”…

Oliver noted that he has talked to legal experts who assured him that he wasn’t breaking any laws and said “HBO is not putting up the money for this. I am personally on the hook. You can make me really regret this. I could be doing standup tours to pay for your retirement for years.”

“This offer is not forever,” Oliver continued. “You have exactly 30 days from midnight tonight to make your resignation effective.”

To sway Thomas to sign the contract, Oliver also offered him a brand new top-of-the-line motorcoach worth $2.4 million, which includes a full bedroom with a king-size bed, one and a half baths, a fireplace, four TVs, a washer/dryer, and a residential-size fridge…

Before we start, I just want to clarify something. If I make a pointed reply to a commenter, that’s not an invitation to pile on. Same goes for if someone makes a pointed reply to me or to anyone else. Unless the reply is way, way over the line. Another Scott and I do disagree on a number of things. That does not make them a bad person. Nor does it make them unwelcome in the comments to my posts or anyone else’s. I appreciate folks having my back, but I made the point I wanted to make, that was enough. I am glad Another Scott kept commenting last night/this morning and I look forward to him continuing to do so tonight and for as many nights to come as they like.

We must continue to be resilient, determined, and achieve Ukrainian goals in this war – address by President Volodymyr Zelenskyy

Dear Ukrainians,

As this week, a very challenging week, is coming to an end, it is important to note several things.

First, gratitude to all our soldiers, all those working in defense, and all those who are helping. This week, the hearts of all those who care – not only in Ukraine – have experienced feelings of concern for our heroes, for our Avdiivka, for every defender, and for the fate of all our people, for the fate of our entire state.

The battle continues, and the main thing in this battle is that we are doing everything possible and impossible to defeat the Russian evil and protect as many Ukrainian lives as possible. Ukrainians have fought heroically before, but for the first time in its history, Ukraine has achieved such global solidarity and support. And although there are different political sentiments in the world, different flashes of problems that distract attention, we still – all together – do our utmost to have the world with us – with Ukraine. Therefore, so that our soldiers can stop the Russian inhumanity and return what is Ukrainian to Ukraine. I thank everyone who fights, who helps, who maintains resilience and determination.

Second, it’s the concrete support of the world. This week has brought our state two more agreements on long-term cooperation and support with leading countries. Germany. France. Our security agreements are very ambitious. Once again, thanks to Chancellor Scholz, President Macron, everyone in our teams who prepared the agreements and entered into them exactly what we need. Defense support, joint political steps, further institutional relationship systematization for greater security and collective strength. We are also working with other partners on new agreements – it will be a very effective and comprehensive architecture of security commitments. Things that will serve to restrain Russian aggression in the future and help protect independence now.

And third, the Munich Security Conference. Very fruitful participation this year. Our Ukrainian perspective on the global agenda was supported by our partners. I had negotiations with the leaders of Denmark, the Netherlands, and the Czech Republic – we have a decision on additional support. Also, with the leader of Azerbaijan – as always, a good productive conversation that can strengthen both our nations and the entire region. I met with the Prime Minister of Bangladesh and the President of Guatemala. Also with American partners. Conversation with President Biden – very important points, including about Avdiivka and the need for continued principled and sufficient support for Ukraine. Talks with the Vice President of the United States – very substantive. Meetings with congressmen – representatives of both parties, both houses of the U.S. Congress. And each such conversation clearly confirmed the key point: Ukraine alone can stop Putin and create conditions for him to be punished for all the evil he has done. But for Ukraine to achieve this success – to protect its land, its people, and our common truth, everyone in the free world – Ukraine must not remain alone. Support is important. Solidarity – is important. Only together, in unity, can we win in this war.

We must continue to be resilient, we must continue to be determined. We must achieve our Ukrainian goals in this war.

Earlier today Gabrielius Landsbergis, the Lithuanian Foreign Minister, shared his view of the strategic environment in a long tweet thread. I think it is important to read it and really hear what he is trying to convey. Landsbergis is viewing what is going on as someone from a state and society that was scarfed up by the Soviet Union and then dominated by its Russo-centric culture. Context always matters. His context is of a state and society that spent decades in subjugation and that is being actively and vocally threatened with that subjugation once again. Here’s the last section of Masha Gessen’s recent New Yorker piece that Rozen said to pay attention to: (emphasis mine)

What I Saw

I can’t get one passage out of my mind. In the history-lecture portion of the interview, when Putin got to 1939, he said, “Poland coöperated with Germany, but then it refused to comply with Hitler’s demands. . . . By not ceding the Danzig Corridor to Hitler, Poles forced him, they overplayed their hand and they forced Hitler to start the Second World War by attacking Poland.” (This is my translation.) The idea that the victim of the attack serves as its instigator by forcing the hand of the aggressor is central to all of Putin’s explanations for Russia’s war in Ukraine. To my knowledge, though, this was the first time he described Hitler’s aggression in the same terms.

Putin has reproduced Hitler’s rhetoric before. Ten years ago, announcing the annexation of Crimea, he seemed to borrow from Hitler’s speech on the annexation of Sudetenland. At the time, I assumed that the language had come from a speechwriter who knew what they were doing while Putin may not have. But the way Putin described the beginning of the Second World War in his interview with Carlson suggests that, although he keeps accusing Ukraine of fostering Nazism, in his mind he might see himself as Hitler, but perhaps a wilier one, one who can make inroads into the United States and create an alliance with its presumed future President.

It’s telling, too, that Putin took the time to accuse Poland of both allying with Nazi Germany and inciting Hitler’s aggression. As he has done with Ukraine in the past, he is positioning Poland as an heir to Nazism. He mentioned Poland more than thirty times in his conversation with Tucker. If I were Poland, I’d be scared.

There’s a reason that the senior national security officials in the Baltic states, Poland, Finland, Norway, Sweden, and several other EU and NATO member states keep stating that they expect Putin to attack one or more of them in the next few years. They’re not delusional, nor are they fear mongering. They are listening to what Putin is saying, reading what he is writing, and watching what he is doing. What they are hearing and seeing has led them to conclude that they, their states, and their societies are in jeopardy regardless of their status as members of NATO. While it is true that they have their own socio-historical biases regarding Russia that frame their understanding of the threat. It is also true that we need to recognize that we have our own and rather than mirroring onto these states and societies we should engage with what they are telling us.

They are seeing and hearing what the US is failing to do. They are seeing and hearing what Putin and other officials are saying:

And they are drawing reasonable and responsible conclusions from the empirical reality they are observing and acting appropriately.

So, Z-Russians on Telegram are now talking about their losses in the Battle of Avdiivka in 2023-2024.

Allegedly, it’s 16,000 men as ‘irreplaceable losses’ (e.g., all fatalities + all severely wounded that will never be back to ranks again), as well as around 300 armored vehicles.

So, if that’s true (though it’s likely that Russians traditionally understate their losses, at least when it comes to lost equipment, given the gargantuan amount of verified video footage we’ve seen) — it means that over the four months of the Avdiivka campaign between mid-October and mid-February, the Russian fatalities rate surpassed the official death toll of the Soviet-Afghan War (1979-1989), which stands at 15,000 fatalities.

Yes, the ill-fated and formerly sadly-remembered senseless war in ‘Afghan’ that once left a heavy scar on an entire generation and particularly precipitated the fall of the Soviet Union…

Fighting for Avdiivka continued since the very days of 2014 and 2015 and lasted with varying intensity all those years before 2022, and was also extremely bloodletting and fierce for almost two years of Russia’s full-scale invasion.

Moreover, the claimed Russian death toll at Avdiivka… literally corresponds to some 50% of the city’s entire population in 2021 (some 32,000).

And that’s within the last four months alone and according to likely downplayed Russian estimates.

I guess that to take New York City, Russians would have to ditch 4.5 million soldiers under the same scheme or what?

And the defense of Avdiivka gradually crumbled particularly due to a severe lack of munitions and means to counter Russian jets relentlessly throwing dozens of guided bombs at the city each and every day. Stalemate around the Ukraine aid at the U.S. Congress is already taking its toll.

And amid all those shortcomings, see the absolutely savage efficacy of the Ukrainian defense, outnumbered and outgunned, — again.

A four-month battle vs a 10-year-long war in Afghanistan. Those are death toll estimates from Russians, not us.

We could have been celebrating victory over the aggressor right now, or at least we could have been much closer to restoring just and stable peace in Europe if Ukraine had been provided with everything it asked for.

USA Today headlined its capsule timeline “Fani Willis hearing: a salacious drama that could undermine Trump election interference case”, which just about sums up the Very Serious Concensus: This colored lady was having an extramarital sexual relationship with her big, Black employee — how could that *not* be disqualifying?!?

Richard W. Painter, at the Atlantic, felt called to chip in — “Step Aside, Fani Willis”:

After a two-day hearing in Fulton County, Georgia, we are where we were before. The defendants, charged by Fulton County District Attorney Fani Willis with conspiring to overturn the 2020 presidential election, attempted to make a case for her disqualification under Georgia law. In my view, they failed. The standard for disqualification has not been met, and the judge should not disqualify Willis.

But that is not the end of it. Willis is a public servant obligated to discharge the duties of her office in accordance with the best interest of the people of Georgia. In this instance, the best interest of the public dictates that she withdraw from prosecuting the case…

 
Arguing in opposition, Robin Givhan, at the Washington Post — “When Fani Willis took the stand, her fury was precise and laser-focused”: [gift link]

Fulton County District Attorney Fani T. Willis (D) walked into the Georgia courtroom Thursday afternoon where lawyers were arguing over whether she would have to take the stand. It was the back half of the long day’s hearing on whether Willis should be removed from the sprawling election tampering case her office has brought against former president Donald Trump and his associates. But the debate between the dueling teams of lawyers became moot when Willis announced that she wanted to testify. Willis settled into the high-backed witness chair. And then she loosed her fury.

She began by declaring that defense attorney Ashleigh Merchant had lied in court filings when she suggested that Willis had slept with special prosecutor Nathan Wade after their first meeting. She fumed that her privacy had been invaded. She reminded Merchant that, “You think I’m on trial. These people are on trial for trying to steal an election in 2020.” And she held up paperwork filed by defense lawyers in a display of disgust. For no small amount of time, it seemed that judge Scott McAfee was a mere bystander in his courtroom…

Willis’s testimony followed that of Wade, with whom she’s had a romantic relationship — a relationship that sparked these court proceedings. One of the issues at the heart of whether she should be removed from the case is whether she benefited financially from having appointed Wade to it. And so much of the day’s questioning focused on whether Wade footed the bill for plane tickets and cruises to places such as Belize, Aruba and Napa Valley. Wade explained that the two split costs, with Willis paying him back in cash — thousands of dollars in cash. At a time when many businesses only accept electronic payments and many people never carry cash, Wade made a mess of explaining why Willis was handing over wads of untraceable dollars. He began many sentences with, “Here’s the thing …” And by the time he reached the end of the sentence, well, there was no “thing” there…

Willis lectured the gathered attorneys on the philosophy behind keeping cash on hand. Her father taught her that cash was king and a woman should always be financially self-reliant. And so, yes, she had a stash of cash accumulated over time and she used it to reimburse Wade. She dipped into it before a trip so she could pay taxi drivers or barter with vendors. Her description of her father’s advice was a compressed version of a complicated history and modern-day habit. She didn’t go into the discomfort that some Black people have with financial institutions or the ways in which banks have made it more difficult for Black people to do business with them. She didn’t mention that more older people believe in keeping ready cash and that a significant percentage of Black and Hispanic Americans use cash as their predominant payment method. She didn’t have to. She simply talked about what her father had told her to do as a matter of independence and power. “I don’t need any man to foot my bills,” Willis said…

So after two whole days of testimony there is ZERO evidence that Fani Willis has a conflict of interest. Mr. Bradley on the other hand seems to have perjured himself and ruined his legal career.

But as she parried questions about her own personal conduct from the witness stand against the legal teams for defendants her office has accused of election interference, many Black women recognized a dispiriting scene.

“It absolutely feels familiar. There is no secret that the common sentiment among Black women in positions of power (is that they) must over-perform to be seen as equals to their counterparts,” said Jessica T. Ornsby, a family litigation attorney in the Washington, D.C., area.

“Here, Ms. Willis is being scrutinized for things that are not directly related to her job performance, in ways we see other Black women regularly picked apart,” Ornsby said…

A month after Fani Willis was sworn in as the first Black female district attorney of Fulton County, Ga., in 2021, her father said protesters arrived outside her house at 5 a.m. John Floyd III recalled that he “hadn’t seen anything exactly like it, before and after that happened.”

“There were people outside her house cursing and yelling and calling her the b-word and the n-word. And just — it was bizarre,” Floyd testified in an Atlanta-area courthouse Friday morning.

Five days after that incident, Willis announced a criminal investigation into whether former president Donald Trump conspired to try to overturn Georgia’s 2020 election results, setting off a chain of events that somehow had landed Floyd on the witness stand on Feb. 16, as part of an evidentiary hearing over misconduct claims against his only child…

Many watching the hearing online commented on details Floyd shared of his personal history. His youth was defined by the civil rights movement, which he said took him from Alabama back to his home in South Central Los Angeles, where he joined the Black Power movement. (As a young organizer, one of the projects Floyd had hoped to complete was setting up a credit union for his community, Floyd recently told California State University’s Tom and Ethel Bradley Center.)

After two fellow Black Panthers were fatally shot at a Black Student Union meeting, Floyd turned to law, enrolling at UCLA, according to the Atlanta Journal-Constitution, though he remained active in human rights campaigns — on the stand, he mentioned he had worked for Nelson Mandela and the campaign to free him from prison.

Floyd also spoke about how, as a criminal defense attorney, he had litigated “probably … a thousand cases” all over the country, though he spent most of his legal career in Washington. He was part of the International Criminal Tribunal for Rwanda, he added, and had hoped to live the rest of his life in South Africa, but had to return to the United States “for political reasons.” A film buff, Floyd now lives in L.A., where he is working on a documentary, he told the court.

Floyd also described his increasing fears for his daughter’s safety as threats mounted against her in the wake of becoming the most powerful prosecutor in the most populous county in Georgia…

Like Wayne Newton Covering a Kendrick Lamar Song with a Bossa Nova Beat

The products of someone’s conception of “you know, like what the black kids wear, but classy” being gawked at by Trump are getting a lot of attention.  Called “Never Surrender” by someone who’s never been a soldier in the winter’s night with a vow to defend, and on sale now for $399, they seem like a desperate grab for money, considering Trump’s current situation.  But, can we just pause for a moment to consider how completely fucking uncool they are?  I mean, to use references Trump would get, they’re Lawrence Welk covering a Beatles song,  Richard Nixon on Laugh-In, and Sinatra singing Mr. Tambourine Man.

Also, maybe they’re about money, but they’re more about attention, and Trump’s ability to act like a clown to get that attention.  Let’s face it:  the stories about Trump’s campaign running out of money are being written by people who have never grasped the length that billionaires will go to retain their tax breaks.  Those fuckers might talk a good game about “withholding support” or “considering a third-party candidate”, but in the end they make their excuses and drop multi-million dollar checks on a guy who thinks he’s “with it” because he’s selling shoes that look like they were made in China for 10 bucks to rubes for $400.

DOJ Press Release

Deputy Attorney General Lisa Monaco and Estonian Secretary General Tõnis Saar announced today at the Munich Security Conference the transfer of nearly $500,000 in forfeited Russian funds for the purpose of providing aid to Ukraine. The funds were forfeited by the United States following the breakup of an illegal procurement network attempting to import into Russia a high-precision, U.S.-origin machine tool with uses in the defense and nuclear proliferation sectors. Additionally, on Wednesday, Feb. 14, a citizen of Latvia charged criminally in connection with the procurement scheme pleaded guilty to violating U.S. export laws and regulations.

This transfer is the first of its kind from the United States to a foreign ally for the express purpose of assisting Ukraine, and the second time the Justice Department’s Task Force KleptoCapture has made confiscated Russian assets available for Ukraine—having provided $5.4 million in forfeited funds last year to the State Department for the support of Ukrainian war veterans. The confiscated funds are being transferred to Estonia since under current authorities, the facts of this case do not allow for a direct transfer to Ukraine. Estonia will use the funds for a project to expedite damage assessments and critical repairs to the Ukrainian electrical distribution and transmission system, which have been purposefully targeted by Russian forces.

It is the first time the U.S. will transfer funds to a foreign ally for the explicit purpose of assisting Ukraine and comes as foreign aid for the embattled nation has stalled in Congress.

The funds are being transferred to Estonia because current authorities do not allow for a direct transfer to Ukraine. According to deputy attorney general Lisa Monaco, the funds will be used for a project designed to streamline damage assessments of Ukraine’s electrical transmission and distribution systems.

“This is an incremental step toward justice and restoration. But it is a necessary step. And it blazes a new trail towards combatting Russia’s ongoing brutality,” said Monaco in remarks prepared for delivery at the Munich Security Conference in Germany.

“The Department of Justice will continue pursuing creative solutions to ensure the Ukrainian people can respond and rebuild. Dollar by dollar. House by house. Town by town,” Monaco added, noting that the administration would not wait for Congress, but rather would use existing authorities to provide assistance to Ukraine.

I definitely like the sound of this. I’m seem to recall that Trump had something like 30 days from the E. Jean Carroll ruling before she could start trying to collect, but I’m not 100% sure on that. So many cases, so many details.

How Trump will pay the $ half billion in new court judgments? It will be complicated: He surely has bank liens on his property and signed a personal guaranty for the Deutsche Bank loans, and may also have liquidity requirements to maintain the loans.
