Hey, Thanks, Kevin!

by Cheryl Rofer|  December 18, 20185:37 pm| 61 Comments

This post is in: Dolt 45, Election 2016, Open Threads, All we want is life beyond the thunderdome, Into the weeds

Kevin Drum has taken my Steele dossier analysis and made some evaluations of the claims. Here’s what he came up with:

It looks about right to me.

Kevin:

Aside from three oddball claims that I couldn’t really classify (6, 7, and 19 if you’re counting), it looks to me like the dossier includes 15 claims that are now fully or partially supported and 27 claims for which we have no evidence so far. These 27 claims include a fair amount of insider Kremlin gossip.

What I found most interesting is this: although there’s no public evidence one way or the other for these 27 claims,² there doesn’t appear to be a single claim that we know with certainty is false. There are claims that have been denied by the American participants, but none that we have documentary proof of being mistaken. Partly this is because it’s hard to prove a negative, but it’s still surprising that not a single claim in the report has been conclusively debunked. It’s especially surprising since the dossier is a patchwork of raw intelligence, and even if it was well done by competent professionals you’d still expect it to include at least a few claims that, two years later, we could say were categorically wrong.

Emptywheel, however, feels that I’m missing evidence against some of the claims. I’ve suggested that she and talk about it offline.

Breaking News: LTG Flynn’s Sentencing Is????

FLYNN LAWYER NOW SEEKS TO DELAY SENTENCING.

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Wants a sentencing delay to get the "last modicum" of cooperation benefit from EDVA case.

— Andrew Prokop (@awprokop) December 18, 2018

A status report on whether Flynn is ready for sentencing will be due by March 13 at noon

— Zoe Tillman (@ZoeTillman) December 18, 2018

This morning’s sentencing hearing are not going well for LTG Flynn or his lawyers. Judge Sullivan, a jurist whose rise to the Federal bench would be impossible in today’s politics, is not amused!

https://twitter.com/BradMossEsq/status/1075073940148621312

Judge Sullivan started off displeased and moved to furious over the course of the morning’s hearing.

Judge requires Flynn to answer questions under oath, saying, "Mr. Flynn's brieifng concerned the court, as it raised issues that may affect or call into question his guilty plea, or at the very least his acceptance of responsibility….

— Spencer Hsu (@hsu_spencer) December 18, 2018

Sullivan reminded Flynn that lying while under oath could get him into “more trouble,” then asked Flynn at the time of the Jan. 24, 2017, interview, “Were you not aware that lying to FBI investigators was a crime

“I was aware,”Flynn said..

— Spencer Hsu (@hsu_spencer) December 18, 2018

Kelner also answered in the negative when asked by Sullivan if he contended that Flynn's rights were violated by the fact that no lawyer was present, that Flynn may have been dissuaded from a having lawyer present, at the Jan. 24, 2017 FBI interview…

— Spencer Hsu (@hsu_spencer) December 18, 2018

Judge Sullivan: Is Mr. Flynn still cooperating?

Gov: It “remains a possibility” that he’s still cooperating.

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Judge Sullivan: So Flynn could’ve also been charged in that indictment unsealed in Virginia yesterday, right? Gov: Yes.

Judge Sullivan: “Exposure to Mr. Flynn would have been significant?” Gov: Yes.

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Judge Sullivan to Michael Flynn: “Arguably, you sold your country out."

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Judge Sullivan: “I’m not hiding my disgust, my distain for this criminal offense.”

Says he can’t guarantee he’s going to avoid incarceration. Gives Flynn yet another opportunity to speak with his lawyers.

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Judge Sullivan even asked the government whether Flynn could have been charged with treason for interfering in Russian sanctions imposed by Obama administration. Government didn’t want to go there.

— follow @ryanjreilly on bluesky, signal in bio (@ryanjreilly) December 18, 2018

Also, Eli Lake is still an idiot and a useless idiot to boot:

Michael Flynn is Owed an Apology https://t.co/Gb9ZFzB0s2

— Eli Lake (@EliLake) December 18, 2018

Don’t lie to the FBI, its rude and upsets their feelings. Don’t have your lawyers play silly semantic games in their sentencing recommendation memos, its rude and upsets the judge’s feelings.

Unfortunately we are now doomed to three more months and dozens more posts at The Federalist; hot takes by Flynn’s conspiratorial minded supporters led by Flynn Jr, who is also a useless idiot; and Fox News hosts and commentators, like the Blue Footed Booby of Budapest (also a useless idiot) asking if Flynn was set up, if he actually committed a crime, if this is not part of the actual “real” investigation that will bring down the Deep State and the global pedophile ring they’re running.

Update at 1:15 PM

If anyone is interested, I’ve uploaded the Flynn 302s, which the Special Counsel’s Office released with redactions last night.

Flynn Sentencing at 11 AM (Open Thread)

This post is in: Election 2016, Foreign Affairs, Goddamned Traitors, Open Threads, Politics, Republican Stupidity, Trump Crime Cartel, Trump-Russia, Assholes

Disgraced former National Security Adviser and “Lock Her Up” chant leader Michael Flynn is due in court shortly. It’ll be fascinating to see how this phase of the Mueller probe plays out.

The conventional wisdom is that since Flynn’s crimes were serious and Mueller let Flynn plead guilty to a relatively minor offense and recommends no jail time, Flynn’s cooperation must have been incredibly valuable to the investigation, perhaps even instrumental in hooking a very big fish. I sure hope so.

But Flynn is trying to have his cake and eat it too by (absurdly) claiming entrapment, and that line has echoed throughout the wingnut media sphere. The Post says Flynn’s double-dealing could increase the hearing’s drama quotient:

But in their sentencing submission, Flynn’s attorneys suggested he might have been fooled into lying to the FBI because he had not been warned in advance that doing so is a crime. That prompted the judge to request more documents, and the special counsel’s office last week vigorously pushed back on the idea that Flynn was mistreated.

Trump has ripped Michael Cohen as a rat while at the same time putting his tiny orange thumb on the scale in Flynn’s favor, repeating the entrapment lie. From this morning’s Twitler Twitter extrusions:

Good luck today in court to General Michael Flynn. Will be interesting to see what he has to say, despite tremendous pressure being put on him, about Russian Collusion in our great and, obviously, highly successful political campaign. There was no Collusion!

I try to remain agnostic on the idea of Mueller as the incorruptible, nonpartisan defender of American democracy who will expose the traitors and restore the rule of law, though it’s tempting to cling to that myth as our other checks and balances are dithered away by corrupt and spineless swine.

But on the issue of Flynn, it seems to be a battle of wits between Trump and clowns like Giuliani vs. Mueller and his team. My money’s on the latter — or really, any random group of people — against those idiots.

As for Flynn himself, he strikes me as a pinwheel-eyed partisan loon — a true believer. But Cohen once said he’d take a bullet for Trump. We’ll see.

Could have taken a W

by David Anderson|  December 18, 20188:58 am| 22 Comments

This post is in: Anderson On Health Insurance

Yesterday, John embedded the President screaming into the void that he can fix healthcare again:

A statement by the President: pic.twitter.com/vNXlXfaee6

— Real Press Sec. (@RealPressSecBot) December 17, 2018

He could have taken a W on healthcare after last year.

I made this argument in the New York Times in October 2017:

President Trump once promised a health care plan that would have “much lower premiums and deductibles while at the same time taking care of pre-existing conditions.”

That plan may be Obamacare. Mr. Trump’s decision to end cost-sharing-reduction subsidies, known as C.S.R.s, and perhaps to derail a bipartisan bill by Senators Lamar Alexander, Republican of Tennessee, and Patty Murray, Democrat of Washington, that would restore C.S.R. funding through 2019 may actually lead to better coverage for more people paying lower monthly premiums….

By pulling the plug on C.S.R. subsidies, President Trump can claim that he will provide a better deal on health insurance for more Americans. He and his fellow Republicans should declare victory, with or without a version of the Alexander-Murray bill — and check health care reform off their legislative list.

North Carolina is a good example of the facts on the ground regarding prices paid by subsidized individuals.

People earning between 100% and 400% FPL have lower premium plans with lower deductibles now under Trump than they did under Obama.  In Wilmington, North Carolina, a family of four can get a $0 Gold plan with a family income of at least $65,000.  That same family can earn up to $98,000 to get a $0 premium Bronze plan.  These types of pricing spreads are not uncommon.  They are the direct result of Trump Administration policies.  The biggest driver is the termination of Cost Sharing Reduction subsidies that led to the overinflation of Silver benchmark premiums.

The problem with this fundamental argument of people actually being able to find insurance with lower premiums and higher actuarial value is that this is not the vision of health insurance that animates conservative policy making. It would not be considered a victory. Instead, the conservative vision is low actuarial value plans that are tied to health savings accounts.  There is a two fold theory of change:

theory of change with the use of HSA in both a single year and over a lifetime. The single year theory of change is that high first dollar expenses will lead to lower utilization with minimal real health consequences as people become expert shoppers and evaluaters of health care need and value. The lifetime theory of change is that an HSA can be built up while an individual is young and healthy and spent when an individual is old and sick. It prefunds some of the expected health cost obligations on an individual level.

The reality on the ground would allow for the President to claim a victory as he at least partially delivered on his rhetoric but it conflicts with the policy class of the GOP’s policy vision.

Tuesday Morning Open Thread: Thick As A Brick

Schumer says Trump needs to understand the votes for a southern border wall aren’t there in US House or Senate.

“He is not going to get the wall in any form.” https://t.co/tExauiccZy

— Jennifer Jacobs (@JenniferJJacobs) December 16, 2018

Playing Reality Star Emperor on the teevee — Who gets the thumbs down? All eyes are on ME! — is the only part of the Oval Office Occupation that Donny Dollhands actually enjoys. No surprise, he thinks of a government shutdown as a prime opportunity for more exposure*. The fact that hundreds of thousands of people are depending on getting paid for doing those jobs would only add an extra thrill for him, assuming anyone tried to get the concept across.
* (sorry for that image, first thing in the morning)

So, y’know, I really don’t have any concern to spare for the rest of the Republicans, who are facing the blowback they toiled to achieve.

Per the Washington Post, company paper for the town whose monopoly industry is national politics:

Congressional Republicans struggled Monday to find a way to persuade President Trump to back off a public threat to shut down the government over border wall money, staying largely in the dark over the impasse that could halt pay for hundreds of thousands of federal workers by the end of the week.

At the White House, Trump has remained disinclined to support even stopgap measures that would keep federal government operations running for a week or two, told by his closest advisers that he would have even less leverage when Democrats take control of the House next month. Trump is also bolstered by support of rank-and-file Border Patrol agents, whose union leader told the president in a recent Oval Office conversation that they would back a wall-induced shutdown if the dispute came to that point.

All that has left Republican lawmakers eager to avoid a shutdown unsure whether Trump would ultimately come around to at least one option that would end the impasse before Friday. Without a resolution that the president could sign before midnight Friday, roughly 800,000 federal workers will be furloughed or forced to work without pay in a partial shutdown that Trump has already — and proudly — claimed as his own…
