David Simon’s idea — if it were noticed by Our Very Serious Pundits — would be greeted with an outcry second only to that which met the Reverend Swift’s:

2) …all parties involved in our governance and their friends and relations can drive a truck through. Extortion is a crime under the law. Bribery is a crime. But earning money by talking horseshit about how you know and who will listen to you is the premise of the K Street….

3) ….lobbying class. Federal prosecutors have a name for the activity that involved people talking shit and pumping up their influence for salary and consulting fees. “Rainmaking.” A player goes to the chump and says if you hire me, I can make it rain. Rain being whatever…

4) legislation, or subsidy or grant the chump wants to get from the government. If the player does anything overtly illegal to advance the chump’s agenda — a bribe, a threat, a quid pro quo — then there is the possibility of prosecution. If the player doesn’t do shit….

4) ….other then whatever a lobbyist or consultant is legally allowed to do, and the subsidy is obtained or bill gets passed, he made it rain and seems worth his pay. If it doesn’t, then the chump overpaid. But influence peddling? That’s legal. It’s built in to the process….

5) What the Republicans lack so far is a single fucking overt criminal act by Hunter Biden, never mind Biden as vice president. They’ve got the younger Biden pimping his name, as Kushner and his wife pimped theirs to greater profit. And again, this is shitty, but in not criminal.

Apologies for two 4)s in the thread. Math is what kept me out of business school, if not the federal courthouse.

White House Working the Refs

This was mentioned in passing in an earlier thread but perhaps deserves its own post since we spend so much time here shaking our fists at the Beltway media. The White House Counsel’s Office sent a memo to major media outlets with the following (painfully awkward but righteously angry) subject line:

It’s Time For The Media To Do More To Scrutinize House Republicans’ Demonstrably False Claims That They’re Basing Impeachment Stunt On

Here’s a link to a story on it at The Hill. (I chose that outlet because they embedded a PDF of the memo on the page so you can read the whole thing if you choose.) Every administration I can remember — from Nixon to Biden — has complained about media coverage at some point, some with plenty of justification and some with none. But I can’t ever remember such specific media advice from a White House.

The memo notes that House Repubs, led by the deranged MT Greene of Georgia, have been investigating Biden for nine months and turned up nothing, let alone any evidence of malfeasance that meets the specific requirements for impeachment outlined in the U.S. Constitution.

The memo states that impeachment is supposed to be “grave, rare and historic” and provides a list of GOP congress-critters who have publicly denied that House Repubs possess any evidence that would justify impeachment.

Then the memo outlines how current reporting isn’t meeting the moment and reminds media outlets of their responsibility to the public:

(R)eporting that solely focuses on process rather than substance is woefully inadequate when it comes to something as historically grave as impeachment.

It’s time for the media to ramp up its scrutiny of House Republicans for opening an impeachment inquiry based on lies. When even House Republican members are admitting that there is simply no evidence that Joe Biden did anything wrong, much less impeachable, that should set off alarm bells for news organizations.

For years, Republicans in Congress have tried to muddy the waters by attracting media coverage of their allegations, and as they choose to move forward with impeachment, it is the responsibility of the independent press to treat their claims with the appropriate scrutiny. Covering impeachment as a process story – Republicans say X, but the White House says Y – is a disservice to the American public who relies on the independent press to hold those in power accountable.

And in the modern media environment, where every day liars and hucksters peddle disinformation and lies everywhere from Facebook to Fox, process stories that fail to unpack the illegitimacy of the claims on which House Republicans are basing all their actions only serve to generate confusion, put false premises in people’s feeds, and obscure the truth.

House Republican leaders should be held accountable for the fact that they are lurching toward impeachment over allegations that are not only unfounded but, in virtually all cases, have been actively disproven – including by witnesses and documents in their own investigations, as well as years-old congressional probes and even the former President’s first impeachment inquiry.

Wowzers! Every word is true. The House hearings have been a clown show from day one, and McCarthy flip-flopped on holding a vote before opening an inquiry (also mentioned in the memo) only because nutcases like Greene have his wizened little grapes in their fist.

I’m especially pleased to see Fox mentioned in the context of “liars and hucksters peddl(ing) disinformation and lies.” (I’d love to see the White House follow up by yanking the Doocy nepo-baby’s credentials.) Will it have any effect? I don’t know, but sometimes working the refs works.

I am pretty sure this is a big Joe Biden deal, but I really don’t completely understand the ruling and the implications of the ruling.

Can the BJ peeps who are attorneys weigh in?  (And everyone else, of course!)

Well, let’s see.  Slow news day.

Judge Jones DENIES Mark Meadows’ Emergency Motion to STAY his case pending appeal.  So now it’s up to all the legal arguments from both sides, which are due tomorrow, I believe.  But I believe they would only grant a STAY in this case if his appeal had a good chance of prevailing.  Bad day for Mark Meadows.

Did everyone see that Boebert had to be “escorted” out of a theater because of all the complaints about her?  Vaping in the theater (not allowed), taking photos (not allowed), being loud and rowdy (not allowed).  They gave her a warning, and she basically told them to fuck off.   They said they would have to call security, she told them to fuck off.  They said they would have to call the police, and she told them to fuck off.  So after the intermission, when they got yet one more complaint, she was “escorted” out of the theater.

Judge In-the-bag-for-Trump Cannon has finally entered a protective order governing disclosure of classified information during the discovery process.  I’m too lazy to look it up, but I believe she delayed that for something like a month.  The fucking protective order for classified information.

This doesn’t seem quite right – could this be true?

One more random thing in the news.  In 2020, Trump’s Department of “Justice” issued a bullshit OLC opinion that impeachment inquiries are not valid unless they are based on an official vote of the House.  Yesterday, the Squeaker didn’t put it up for a vote, surely because he didn’t have enough votes to pass it.  Well, now they are stuck with Trump’s stupid OLC memo.

Speaking of OLC (Office of Legal Counsel) memos, I do not understand why Biden’s legal eagles haven’t issued a bunch of OLC memos that contradict some of the bullshit ones we are stuck with.

‘Well, Actually’ — Musk Shifts Blame

Government contract oligarch Elon Musk came up with a new story yesterday on why he left Ukrainians high and dry in the middle of a covert operation against legitimate military targets in Russian-occupied Ukrainian territory. It’s Biden’s fault. (Daily Beast)

Speaking at the All-In Summit on Tuesday, Musk said he would have needed direct approval from the Biden administration to enable Starlink satellite communications for the sneak attack.

“At the time this happened, the [satellite network in the] region around Crimea, um, was actually turned off. Now the reason it was turned off… actually originally it was because the United States had sanctions against Crimea, and we were not allowed to actually turn on connectivity, without explicit government approval,” he said. “So, um, basically Ukraine didn’t give us any advanced warning or heads up or anything, we just got the sort of urgent calls from the Ukrainian government saying we needed to turn on Crimea.”

He went on to say that while he is not President Joe Biden’s “biggest fan,” he would’ve turned the system on “if I had received a presidential directive” to do so.

“The Ukrainian government is not in charge of U.S. people or companies. That’s not how it works,” he said to raucous applause from the audience of the tech conference, before going on to blast the “absurd accusations” that his decision may have been motivated by a cozy relationship with the Russian government.

“They were really asking us to proactively take part in a major act of war,” he said of Ukrainian leadership.

I don’t know anything about this conference except that attendees responded with “raucous applause” when Musk said Ukraine isn’t the boss of him. But that douchebag reaction suggests it’s unlikely anyone asked Musk follow-up questions, such as, “Did you tell the Ukrainians you needed a personal ‘pretty please’ from Joe Biden?” or “As the beneficiary of many U.S. government contracts, did you alert your contacts in the government about what Ukraine was requesting?”

Musk’s latest talking points sound like they were inspired by the now-cancelled Tucker Carlson show on Fox News. As far as I know, Carlson is still trying to resurrect his crappy show on Musk’s shitty platform, so maybe that’s the source. In either case, the space between Musk’s talking points and Carlson/Kremlin messaging is infinitely smaller than the gaps between panels on the average Tesla.

Theater officials told The Colorado Sun on Monday that two patrons were “escorted from the theater” Sunday, but declined to say who they were, citing privacy concerns.

Brian Kitts, director of marketing and communications for Denver Arts and Venues, said the patrons were talking loudly, vaping and using cameras. They were warned during an intermission, but the behavior continued into the second act, at which point the two were asked to leave.

As they were being escorted from the property, the two people said “stuff like ‘do you know who I am,’ ‘I am on the board,’ (and) ‘I will be contacting the mayor,’” according to a security incident report obtained by The Sun from the city through an open records request.
